There seems to be some sense in this forum. My question however is, whose shariat meaning whose interpretation of shariat. We cann’t bring in shariat unless we as a nation and a country agree on one form of shariat or something which is agreed by all the sects in the country and that is for obvious reason not gonna happen as every so called religious organization or party have their own axe to grind. This my friends was a bit of negative part now towards the positive. The way out is education education and education both boys and girls no discrimination in this. Only then we can develop understanding in the people and give them the power to choose or otherwise. LAHORE: The Punjab government has planned to set up a Burn Centre of international standard at the Jinnah Hospital in Lahore with an estimated cost of one billion rupees.
According to a private TV channel, it will be a joint venture of Pakistan Bait-ul-Maal and the Punjab government, which is likely to complete in March 2009.
The centre will be equipped with the latest equipment besides providing all kind of plastic surgery related tests and treatment for burn injuries.
THE Punjab government would launch tunnel farming in order to introduce technology needed to grow off-season vegetables. The Punjab government will hand over 4,600 high and shallow tunnels to farmers of the province at a cost of Rs 550 million. An official of the Agriculture Department, Punjab, said that arrangements to launch the scheme were complete and it would be launched soon. The government will launch the scheme through an advertisement. Forms to apply for tunnels will be available with district agriculture officers, he said.
He said the total duration of the project was two years and it aimed to promote tunnel technology used to grow off-season vegetables. Farmers who have less than 12.5 acres of land would be given 2,300 high and 2,300 shallow tunnels. In the first year, 2,000 tunnels would be given to farmers while in the second year, 1,300 tunnels would be given to intending candidates.
Farmers will bear 50 per cent cost of tunnels and the government would bear rest of the cost. He said an applicant should be a vegetable grower owning less than 12.5 acres of land. Growers will install the tunnels themselves and later a representative of the Punjab government will inspect the site and release 50 per cent amount to growers, he added. I want to convey my complaint to Khadim-e-Aalaa Punjab, abt Secretary IT, Mr. Shamail Ahmad Khawaja who is also having additional charge of Chairman Punjab Information Technology Board.
Dear CM, since this person has taken charge of the Information Technology Board, almost 18 of senior officers have resigned and left the job, including General Managers , Project Director & many managers, only because of his humiliating attitude towards these senior people who are highly qualified and are asset for this nation. But dear CM, you can appreciate, there can be no output when there is no peace of mind, no respect for work and no dignity to one’s self.
PITB was formed as autonomous body, with pay are perks competitive to the market, to attract the talented and skilled professionals.
Dear MR. CM, if you see & compare the performance of PITB with the IT dept headed by Mr. Khawaja, you can very well judge how compitent and capable he is. How many projects they had and what kind of work they are doing compared to PITB.

This should ensure that these tanga parties do not exist and that national parties have democracy and we do not have the likes of Nawaz sharif and Zard-ari, Fazl-ur-Rehman, and Qazi.
We want to go forward. Shariat would force us to go backward. There are reasons:
1) The man who brought and imposed shariat was the most modern man in his time in the whole world. He gave women rights of inheritance, right of divorce etc. But if you give any inept man or woman so much authority, they would only abuse it and not be able to modernize it. You would frequently hear about child abuse in mosques because the people who are authorized to investigate would not have to power to blame the imam. Just the other day a friend of mine told me that he caught the qari sahib of his family in a room, not teaching his 3 year old sister, but molesting her by removing all her garments.

xISLAMABAD: The Law Ministry’s ability to vet key agreements on mega projects has been exposed by an official report that has pointed out a number of serious flaws in a joint venture pact signed between the Pakistan Housing Authority (PHA) and Imperial Homes Ltd (IHL).
Filed by the Finance Ministry’s Infrastructure Project Development Facility (IPDF), the report lays bare the errors in the joint venture agreement, approved by the Law Ministry. Unconfirmed reports suggest the ministry hastily vetted the JV agreement following pressure from Law Minister Farooq H Naek. But the minister was not available to offer his comment on the issue.
The controversial pact is now being replaced by an addendum to the agreement to address apprehensions of the bureaucracy about a Rs60 billion scam in the making in the Prime Minister’s Housing Programme.
While Housing Minister Rahmatullah Khan Kakar refers to the vetting of the Law Ministry to prove that everything is going well and it is the bureaucracy trying to foil the project, the eight-page report of IPDF Chief Executive Officer Adil Anwar Warraich uncovers major defects in the JV agreement.
Five pages of the report talk of the flaws in the JV agreement. Questioning the ability of the Law Ministry experts to vet a document regarding the Rs60 billion project, the IPDF CEO noted: “The JV agreement has not been exhaustively drafted.
“Some basic and fundamental clauses are completely missing in the JV agreement or defectively embedded, causing the JV agreement to be substantially lacking in prescribing manifest and unequivocal extent of parties,” he wrote.
“Some of the missing clauses include, inter alia, I. Entirety Clause. II. Termination Clause. III. Force Majeure Clause. IV. Disclosure Clause. V. Warranties Clause. VI. Exclusion Clause for implied terms. VII. Escrow Agreement Clause. VIII. Monitoring Clause (empowering PHA to check satisfactory discharge of performance obligation by IHL). IX. Delay in performance.”
The Law Ministry simply ignored what the IPDF pointed out whereby the participating interest of the state-owned PHA in the JV Company is zero and that of IHL is 100 percent. This, according to the IPDF CEO, is an equitable arrangement against the interests of PHA.
Experts of Law Ministry also failed to point out the imbalance in favour of the IHL and against the PHA in the JV Company’s Board of Directors. Though the Law Ministry could not see it, the IPDF report pointed out: “As mandated in the JC Agreement, the Board of Directors of the JV Company would have three members of IHL and two of PHA, with the CEO from IHL, which means that effectively IHL would be controlling the JV Company.
“The Board would even be empowered to amend the JV agreement (Clause 8.5-iv). It is surprising to note that Clause 13.1 unjustly empowers IHL to solely operate the JV Company accounts, whereas the same need to be jointly operated.”
In the absence of the Force Majeure Clause, Warraich added, the rights and liabilities in the case of the Agreement frustrated due to a political event, non-political event, an external, uncontrollable event causing a delay or lack of performance by either party, were not mandated anywhere in the pact. “In the absence of the same, Clause 9.2 (ix) inequitably imposes the responsibility of industrial cost escalations and related factors upon PHA.”
The government’s legal brains could not grasp the fact that Clause 9.2(x) prescribed an unfettered and absolute discretion to IHL to impose “any other obligation” upon PHA as and whenever it deemed necessary. Inclusion of such a broad/wide term in the JV agreement cannot be justified.
The Naek-led ministry also ignored Clause 16.1 which, according to IPDF, empowers IHL to sell, assign or transfer its rights and liabilities to any of its subsidiaries whereas there has to be a restriction in the given circumstances.
The IPDF continued: “Clause 17.3 stipulates that in case of default by IHL, the latter should be restored back to its original position whereas in contrast there has to be a punitive measure like damages attached to such a breach.”
Additionally, the Law Ministry let go Clause 17.4 which, according to IPDF, unduly imposes an unconditional and unequivocal responsibilities upon PHA to procure a sovereign guarantee to IHL for all subsequent payments to the JC Company at the scheduled dates, failing which would be considered a default on the part of PHA with consequential repercussions.
The CEO alleged the JV agreement included a misleading reference to IPDF guidelines and termed it uncalled for. “The IPDF guidelines do not support any such project financing structure. This JV agreement cannot be classified as a Public Private Partnership Agreement (PPP) under the standard PPP modality.”
He observed the basic form and spirit of PPP was optimal risk allocation/risk transfer between the public and private sectors, wherein usually financing, designing, building, operating, market (demand and collection) risks were transferred to the private sector. But in this JV agreement, the IPDF said, such risk allocation was envisaged, which was completely against the Public-Private Partnership Policy of the government, approved in Nov 2007.
Simply rejecting what the Law Ministry had vetted, the CEO clearly said: “The said JV agreement, in its form and spirit, is neither a PPP agreement, nor a JV agreement. Rather it is in the nature of a construction contract/sale agreement, wherein minimum risks have been transferred to IHL and most retained by PHA.” The IDPF has given the PHA its strong opinion that it should not proceed with the JV agreement and incorporate the envisaged JV Company.
It is a matter of great shame for us all that so far we have been unable to compel the dictators and agents of America to reinstate the constitutional Chief Justice Iftikhar Chaudhary. Is he the chief justice only for the lawyers? When lawyers take to streets we don’t join them in the way we should. Isn’t it shame for us?
We have been unable to compel dictator Musharaf – an American agent – to face trial for his dastardly act of removing Justice Chaudhary and committing high treason. We should have sacrificed our lives for the sake of this hero – who is the first and, perhaps, the last in this country.
His successor Zardari has gone one step ahead of Musharf in proving his loyalty to the US in order to lengthen his stay in power. But there has not been even a small protest against his acts. Again for a living nation, it is a great shame.
Where are those PPP leaders and workers who had their heads cracked, limbs broken, backs bent for the sake of Justice Chaudhary reinstatement? Not only this, dozens of PPP frontmen died while protesting for the restoration Justice Chaudhary. Khosa, Zamarud, Israr etc – are you listening? Had there been an iota of shame, honesty in you, you will have distanced yourself from Zardari and his company like Aitezaz Ahson – another hero. If Justice Chaudhary is the hero of the bench, Aitezaz is of the bar.

I want to convey my complaint to Khadim-e-Aalaa Punjab, abt Secretary IT, Mr. Shamail Ahmad Khawaja who is also having additional charge of Chairman Punjab Information Technology Board.
Dear CM, since this person has taken charge of the Information Technology Board, almost 18 of senior officers have resigned and left the job, including General Managers , Project Director & many managers, only because of his humiliating attitude towards these senior people who are highly qualified and are asset for this nation. But dear CM, you can appreciate, there can be no output when there is no peace of mind, no respect for work and no dignity to one’s self.
PITB was formed as autonomous body, with pay are perks competitive to the market, to attract the talented and skilled professionals.
Dear MR. CM, if you see & compare the performance of PITB with the IT dept headed by Mr. Khawaja, you can very well judge how compitent and capable he is. How many projects they had and what kind of work they are doing compared to PITB.
Its actually people like him, who give reasons for downfall and ill repute of any govt. I think they are themself Non progressive and have some complex in their mind.
I would also want to say that is there any criteria to check the performance of such people or whomsoever is in good books of cheif secretary is qualified to hold a better post.
There must be some profiling abt such officers, some kind of feedback from their co-workers, about their attitude and behaviour and competence.
Running a department is very easy, as compared to running a hi tech organization like PITB.
I request you to personally probe into the matter and you can confirm all the facts.
Such people must be sent on some posts, where they have least public interaction and least nuisance value.
His personal repute can be asked from any of his colleague who is in secretariat , IT dept, finance dept or any other dept. You need not to go far.
Its my humble request, that he must be immediately removed from the post, and there should be a way that all the qualified and technical persons, who have left / resigned because of his nonsense attitude, should be brought back to the board, so that they can efficiently serve the people of pakistan.

Shariat: Have you woken up after being asleep for 1400 years? I apologize for this remark, but your mention of Shariat suddenly brought to mind Nawaz Shareef’s inclination of imposing Shariat law. And of Fazl-ur-Rehman’s diesel permits and land transfers during the days that they were busy in negotiations with Musharraf. It brought to mind pictures of those pathetic Mullahs, the dukandars, who would not get ANY importance from sensible people, and only are prominent because they keep shouting Shariat Shariat and Mustafwi Inqalab, do unjust things in the name of religion, later to use the term “repentance” (toba).
Interesting: When FazlurRehman, the horrible man, and most obscenely corrupt figure, more than Zardari or Nawaz or army, is accused of illegal land grabbing through compromises, he suddenly began shouting against America. Was this the answer people of Pakistan were looking for? Does he take Pakistanis to be gullible creatures susceptible to nonsense?
The mention of Shariat brought to mind some other pictures too. Jamat-e-Islami always siding with the army against civilian inept governments, giving army the blank check to do everything because they know religion and because people voted for them in Islam’s name.
Since the time of our birth in 1947, these mullahs collect chanda from their pupils in the name of Shariat or revolution and have always been in connivance with the army. In fact, I was shocked to see Qazi Sahab shouting against army. It was not because he really despised the army, but because he was too upset why Fazl-ur-Rehman was getting all the importance and he was not offered anything.
Please say which country after the time of the prophet had imposed Shariat and prospered, and there was real respect for human and animal rights with the best rule of law paralleling the Roman system of justice (for Romans) and American or British justice system (for Americans and British).
The truth is that there is no such instance.
Recently, a country in Africa wanted to impose Shariat and there was resistance within the country. Can anyone answer what the rulers did? They butchered their own population to impose shariat.
So my friend, the name Shariat has been used and abused to suit the mentality of these obscenely corrupt Mullahs, who wanted importance. Why doesn’t the Jamat-e-Islami have internal elections? Do you know how Qazi Sahab came to sit on the throne of Jamat-e-Islami? In the face of Afghan jihad, the ISI thought that Qazi sahab is a pathan and he could be used for calling people to Jihad. So, Qazi sahib came to sit on the throne of Jamat-e-Islami.
There is a good remedy of all political parties including those asking for the imposition of shariat laws. Pass laws in all assemblies, provincial and national. Make it an act of parliament that a political party will not/never have a student wing. That a political party will have internal elections within every two years. And no political party head would be allowed to stay in his seat for more than 4 years. This should ensure that these tanga parties do not exist and that national parties have democracy and we do not have the likes of Nawaz sharif and Zard-ari, Fazl-ur-Rehman, and Qazi.
We want to go forward. Shariat would force us to go backward. There are reasons:
1) The man who brought and imposed shariat was the most modern man in his time in the whole world. He gave women rights of inheritance, right of divorce etc. But if you give any inept man or woman so much authority, they would only abuse it and not be able to modernize it. You would frequently hear about child abuse in mosques because the people who are authorized to investigate would not have to power to blame the imam. Just the other day a friend of mine told me that he caught the qari sahib of his family in a room, not teaching his 3 year old sister, but molesting her by removing all her garments.
If you give men like that qari power to interpret law, what will become of us? One needs only to use their imagination.

xISLAMABAD: The Law Ministry’s ability to vet key agreements on mega projects has been exposed by an official report that has pointed out a number of serious flaws in a joint venture pact signed between the Pakistan Housing Authority (PHA) and Imperial Homes Ltd (IHL).
Filed by the Finance Ministry’s Infrastructure Project Development Facility (IPDF), the report lays bare the errors in the joint venture agreement, approved by the Law Ministry. Unconfirmed reports suggest the ministry hastily vetted the JV agreement following pressure from Law Minister Farooq H Naek. But the minister was not available to offer his comment on the issue.
The controversial pact is now being replaced by an addendum to the agreement to address apprehensions of the bureaucracy about a Rs60 billion scam in the making in the Prime Minister’s Housing Programme.
While Housing Minister Rahmatullah Khan Kakar refers to the vetting of the Law Ministry to prove that everything is going well and it is the bureaucracy trying to foil the project, the eight-page report of IPDF Chief Executive Officer Adil Anwar Warraich uncovers major defects in the JV agreement.
Five pages of the report talk of the flaws in the JV agreement. Questioning the ability of the Law Ministry experts to vet a document regarding the Rs60 billion project, the IPDF CEO noted: “The JV agreement has not been exhaustively drafted.
“Some basic and fundamental clauses are completely missing in the JV agreement or defectively embedded, causing the JV agreement to be substantially lacking in prescribing manifest and unequivocal extent of parties,” he wrote.
“Some of the missing clauses include, inter alia, I. Entirety Clause. II. Termination Clause. III. Force Majeure Clause. IV. Disclosure Clause. V. Warranties Clause. VI. Exclusion Clause for implied terms. VII. Escrow Agreement Clause. VIII. Monitoring Clause (empowering PHA to check satisfactory discharge of performance obligation by IHL). IX. Delay in performance.”
The Law Ministry simply ignored what the IPDF pointed out whereby the participating interest of the state-owned PHA in the JV Company is zero and that of IHL is 100 percent. This, according to the IPDF CEO, is an equitable arrangement against the interests of PHA.
Experts of Law Ministry also failed to point out the imbalance in favour of the IHL and against the PHA in the JV Company’s Board of Directors. Though the Law Ministry could not see it, the IPDF report pointed out: “As mandated in the JC Agreement, the Board of Directors of the JV Company would have three members of IHL and two of PHA, with the CEO from IHL, which means that effectively IHL would be controlling the JV Company.
“The Board would even be empowered to amend the JV agreement (Clause 8.5-iv). It is surprising to note that Clause 13.1 unjustly empowers IHL to solely operate the JV Company accounts, whereas the same need to be jointly operated.”
In the absence of the Force Majeure Clause, Warraich added, the rights and liabilities in the case of the Agreement frustrated due to a political event, non-political event, an external, uncontrollable event causing a delay or lack of performance by either party, were not mandated anywhere in the pact. “In the absence of the same, Clause 9.2 (ix) inequitably imposes the responsibility of industrial cost escalations and related factors upon PHA.”
The government’s legal brains could not grasp the fact that Clause 9.2(x) prescribed an unfettered and absolute discretion to IHL to impose “any other obligation” upon PHA as and whenever it deemed necessary. Inclusion of such a broad/wide term in the JV agreement cannot be justified.
The Naek-led ministry also ignored Clause 16.1 which, according to IPDF, empowers IHL to sell, assign or transfer its rights and liabilities to any of its subsidiaries whereas there has to be a restriction in the given circumstances.
The IPDF continued: “Clause 17.3 stipulates that in case of default by IHL, the latter should be restored back to its original position whereas in contrast there has to be a punitive measure like damages attached to such a breach.”
Additionally, the Law Ministry let go Clause 17.4 which, according to IPDF, unduly imposes an unconditional and unequivocal responsibilities upon PHA to procure a sovereign guarantee to IHL for all subsequent payments to the JC Company at the scheduled dates, failing which would be considered a default on the part of PHA with consequential repercussions.
The CEO alleged the JV agreement included a misleading reference to IPDF guidelines and termed it uncalled for. “The IPDF guidelines do not support any such project financing structure. This JV agreement cannot be classified as a Public Private Partnership Agreement (PPP) under the standard PPP modality.”
He observed the basic form and spirit of PPP was optimal risk allocation/risk transfer between the public and private sectors, wherein usually financing, designing, building, operating, market (demand and collection) risks were transferred to the private sector. But in this JV agreement, the IPDF said, such risk allocation was envisaged, which was completely against the Public-Private Partnership Policy of the government, approved in Nov 2007.
Simply rejecting what the Law Ministry had vetted, the CEO clearly said: “The said JV agreement, in its form and spirit, is neither a PPP agreement, nor a JV agreement. Rather it is in the nature of a construction contract/sale agreement, wherein minimum risks have been transferred to IHL and most retained by PHA.” The IDPF has given the PHA its strong opinion that it should not proceed with the JV agreement and incorporate the envisaged JV Company.

It is a matter of great shame for us all that so far we have been unable to compel the dictators and agents of America to reinstate the constitutional Chief Justice Iftikhar Chaudhary. Is he the chief justice only for the lawyers? When lawyers take to streets we don’t join them in the way we should. Isn’t it shame for us?
We have been unable to compel dictator Musharaf – an American agent – to face trial for his dastardly act of removing Justice Chaudhary and committing high treason. We should have sacrificed our lives for the sake of this hero – who is the first and, perhaps, the last in this country.
His successor Zardari has gone one step ahead of Musharf in proving his loyalty to the US in order to lengthen his stay in power. But there has not been even a small protest against his acts. Again for a living nation, it is a great shame.
Where are those PPP leaders and workers who had their heads cracked, limbs broken, backs bent for the sake of Justice Chaudhary reinstatement? Not only this, dozens of PPP frontmen died while protesting for the restoration Justice Chaudhary. Khosa, Zamarud, Israr etc – are you listening? Had there been an iota of shame, honesty in you, you will have distanced yourself from Zardari and his company like Aitezaz Ahson – another hero. If Justice Chaudhary is the hero of the bench, Aitezaz is of the bar.
We have the wrath of God Almighty Allah visiting on us due to our failure to rise against the agents like Musharaf and now Zardari. They destroyed the judiciary. Remember that no nation can survive without an independent Judiciary. If we want to survive as a nation we have to struggle for the reinstatement of Justice Chaudhary. Without him we are headed for doom.
It is time to wake up and play our role.
