    Now this applies to the current Pakistani situation very well, the NRO case coming to the supreme court has shown complete failure of democracy and the parliament of Pakistan.

    A parliament of personal servants, partners in crimes and men and women with no respect and regard or even common understanding of the people who elected them was and is the reason that the good people of Pakistan welcomed the dictatorships in the past.

    Corrupt and characterless leaders who came into power to make their immediate families untold amounts of wealth, looted from the treasure of the country and were never able to even provide the basic necessities for the people were or even now are not trusted and well liked by the masses of Pakistan.

    Pakistan supreme court sent the NRO back to the parliament to decide but the dung beetles and political prostitutes of Pakistan parliament did not have the courage to reject or accept the criminal law.

    I will bet anything that if you do a referendum in Pakistan and ask them that would you like this current judiciary to run the government for next ten years compare to the failed, family and ethnic run political Mafias a great majority will say Yew!

    Pakistani political parties should wakeup and be democratic within themselves and select the best people not the best slaves, servants, compromised criminals and prostitutes as their party leaders or members.

    NRO should be the beginning of the end and from here onwards the Pakistani parliament should “free” the judiciary for the real role of interpretations of the laws of the land and prosecuting the criminals.

    I like govt stance as it did not want to be a party in the court. Lets court decide.

    I think the govt/intelligence agencies should understand what the guys are planning. It is quite clear to the people at large that MQM wants to create a situation in which all Pakistanis (less mujahirs of Muhajir Qaumi Movement) & the army are pitted against these Muhajirs to further break-up the left-over Pakistan of 1971.
    If God-forbid that happens then majority of Pakistanis feel that the MQM party’s post-holder/party-leader, Muhajirs should be sorted-out once for all, that such trouble-makers like Altaf Hussain/others should be physically eliminated so that they do not raise their ugly heads again.

    I do not think so. May be Kiyani, Gilani and others are discussing different aspects of a possible decision and the situation of post decision, effects and the ways to control the situation.

    Apex court must consider public sentiments in province of sindh. 16 december 1971 and now 16 december 2009. Our elites have learned nothing. Nawaz sharif and musharaf and all other political parties politicians are totaly free of corruption and guilt during their tenure……..? No case no prosecution against them……? But today again province of sindh has to face another big blow as the decision is expected whether it derail this democratic system or not…….! Lets wait and watch. Hopefully our honorable cheif justice will do better for our country in the light of constitution and current national and international scenario. He reiterated that we won’t let this democratic system be derailed. He also censured assumptions and he said that we are custodian and bastion of democracy.

    But our enemies led by the muhajirs of the Muhajir Qaumi Movement are hell-bent on playing their Sindh-Card to whip-up turmoil to break-up the left-over Pakistan.
    Like it happened many times before in our short national history, let us not, for ALLAH’s sake & also for the sake of our children, keep our eyes ‘closed’ like that proverbial pigeon who does not open it’s eyes before the proverbial cat, fearing that if it does so, then the cat will pounce upon it.

    ISLAMABAD: In a country where over 40 per cent of the population is said to be languishing under the poverty line with families surviving on less than $2 a day, the shameful revelation of the filthy rich getting loans worth over Rs100 billion written-off owing to their formidable clout is shocking the nation. And this shameful list carries some of the biggest names of our power elite.

    The names of Ch Shujaat and Ch Pervez Elahi were found among about 1,000 influential businessmen and Army men who got a total of Rs18 billion loans written-off from the government-owned banks during the first three years of the military government. The list was submitted in the NA when Zafarullah Jamali was the prime minister and Shaukat Aziz was the finance minister.

    The first loan of Rs70 million was outstanding against the Punjab Sugar Mills and was written off by the National Bank of Pakistan along with the actual loan amount. The mill was owned by Chaudhry Shujaat Husssain, Chaudhry Mansoor Elahi, Chaudhry Pervez Elahi, Chaudhry Gulzar Mohammad, Chaudhry Wajahat Hussain, Chaudhry Sabhat Elahi, Mrs Qisara Elahi (wife of Chaudhry Pervez Elahi), Mrs Kasur Hussain (wife of Chaudhry Shujaat Hussain), Mrs Khalida Begum (wife of Gulzar Muhammad).

    The second loan of Rs15 million was written off by the UBL outstanding against Punjab Sugar Mills. The beneficiaries were once again Ch Manzoor Elahi, Ch Shujaat Hussain, Pervez Elahi, Wajahat Hussain, Shafaat Hussain, Gulzar Ahmed and Mrs Qaisra Elahi, Khalida Begum, and Kauser Hussain. The UBL once again wrote off another loan of Rs34.1 million outstanding against the Spaco Private Limited. The beneficiaries were the same — Ch Pervez Elahi, Shujaat Hussain, Manzoor Elahi, Wajahat Hussain, Sabahat Elahi, Mrs Kauser Hussain, Qaisra Elahi.

    It may be added that these loans were written off after declaring their industrial establishments as “sick industry or on the pretext of bankruptcy.” Many of them denied having got their loans written-off.

    The political sources claimed that Shahbaz Sharif and Nawaz Sharif knew this troubling fact about the Chaudhrys of Gujrat. Even Imran Khan had been showing the official documents of another bank, which had also written off loans to get the Chaudhrys disqualified from contesting the elections. But his desperate pleas were never entertained by the Election Commission of Pakistan courtesy the might and clout these cousins enjoyed during the early years of General Pervez Musharraf in power. The sources said, on the basis of their own knowledge about the Chaudhrys loan write off, the Sharif brothers were agitating the issue of loan write-off in the media with the public demand to put all the loan beneficiaries on trial after recovering the written-off amounts.

    The mighty Chaudhrys of Gujrat — Ch Shujaat Hussain, Ch Pervez Elahi and their family members — reportedly got three different bank loans of Rs120 million written off from the National Bank and United Bank of Pakistan during their heady days of power. This has been revealed in the official record of the National Assembly library, which has now formally confirmed that several top politicians and their family members had quietly got several bank loans written off, which had been outstanding against their sugar and textile mills and other industrial units.

    These bank loans were mainly written off by the state-run National Bank of Pakistan and United Bank Limited in the past. The official record available with The News, which was placed in the NA in the last one decade, revealed that a total of Rs30 billion loans were written off between 1985-2002, which had been outstanding against the top politicians and powerful industrial groups of the country. The list was compiled by the then caretaker government of 1993 led by Moin Qureshi.

    In 2007, Auditor General of Pakistan revealed in its report that during the period 2002-2007, a sum of Rs54 billion was written off by Musharraf government. Thus, total figure had reached to Rs85 billions. But, now the recent official report to the NA during the question hour revealed that the total figure of written-off loans had finally crossed over Rs100 billion, after adding the loan amounts written off during two years of PPP government since 2008.

    The official list of loan write-off beneficiaries of different periods since 1985 to 2002 revealed that former speaker Gohar Ayub Khan’s family and former Chief Minister Balochistan Jaam Yousuf, are also among other prominent politicians, who got the loans written off from the banks.

    The three mighty business families of Pakistan are also among the beneficiaries of these loan write offs in the past. The former housing minister of General Pervez Musharraf -Abbas Sarfraz is also among the beneficiaries who got a massive loan against his sugar mill written off. Lt General Habibullah and Brig M Jan are among the list.

    The Saifullah family of Lucky Marwat got four loans written off from different banks. The names of Anwar Saifullha Khan, Javed Saifullah, Hamayun Saifullah, Arbab Saddaullha Khan, Shah Jehan Khan, Nisar Khan are part of the list submitted in the NA in 1994 in response to a question by MNA Barjees Tahir. First, the Saifullah brothers got loans written off against their mill— Ms Kohat Textile Mills from the National Bank. The matriarch of the Saifullah family, Mrs Kalsoom Saifullah also got a loan of Rs12 million written off from NBP against Ms Frontier Towel Works, Kohat. Industrial bank also wrote off loan of Rs26 million of Javed Saifullah, Salim Saifullah, Hamayun Saifullah and others against Kohat Textile Mills. The MCB also wrote off loan against the Kohat Textile Mill. Jatoi family of Sindh also got a loan of Rs6.7 million written off from UBL. The beneficiary was Dr Ghafar Jatoi and his brothers. Leghari family also got Rs67 million loans written off from UBL. The beneficiaries included Jafar Khan Leghari, Jamil Ahmed Khan Leghari, Yousuf Khan Leghari, Tariq Khan Leghari, Atta Mohammad Leghari, etc.

    Saigal group got the loan written off against Omaryar Limited, Lahore. The group got another loan of Rs4 million written off from the UBL.

    A loan of Rs10.3 million was written off by Investment Corporation of Pakistan. Iqbal Z Ahmed, Mrs Saira Ahmed also got a loan of Rs5.5 million written off from United Bank of Pakistan. Another small loan of Rs1.4 million got written off from UBL against Hassan Ali and company. A loan of Rs18 million was also written off against Hashoo Holdings.

    Meanwhile, investigations conducted by this correspondent after going through the official record of the National Assembly Secretariat, where all these loan documents were placed from time to time since 1994, even Daewoo Corporation of Pakistan was one of the beneficiaries of such big loans written-off by the government banks. National Bank of Pakistan had written off a loan of Rs10 million against Daewoo. The loan was outstanding against Kim Waoo Choong, Kim Joun Sung, Lee Woo Bok, Yoon Nuke NEON, Chui Myoung Kul.

    The list showed that Karachi-based businessmen have been treated with exceptional kindness by the National Bank of Pakistan. According to the list of such people whose loans and principal amounts were written-off during the last three years, National Bank of Pakistan wrote off billion of rupees from taxpayers’ accounts. Most of the written-off loans went to the textile and industrial giants of the country owned by mighty businessmen, politically influential, former bureaucrats and military officers.

    The big industrialists like Adamjee Industries owned by Farooq Sheikh, Mrs Shireen Farooq, Mumtaz Sheikh, Tahir Sheikh got Rs448 million written-off from the NBP. Mohib Textile owned by Asif Saigol also got Rs1.1 billion written-off in 2002.

    The other big names included in the list are First Tawakkal Modaraba owned by Abdul Qadir Tawakkal, Mohammad Rafiq Tawakkal, Alif Husain Mooney, Abid Hussain Rs621 million written-off, National Frutctose Limited owned by Shairullah Durrani got Rs681 million written-off, Glamour Textile Mills owned by Iftikhar Ahmed Malik got Rs533 million written-off and others. Two foreign nationals also got the loans written-off.

    Pakland Cement got Rs10 million written off, Cast N Link owned by Anwar Ahmed got Rs159 million written-off. Taha Spinning limited got Rs64 million written off.

    Following is the list of mighty individuals and business tycoons whose loans were written-off in majority of cases along with principal amount from National Bank of Pakistan (NBP).

People like Bilawal Bhutto, who knowingly has been Brest fed on the blood of the poor and living large by selling the crushed bones, and human misery , should be declared demonic offspring and should not be allowed to step-in the country, they have been sucking the blood off, without due justice.

    The whole race of these children and their families, who enjoyed the misery, death, poverty, poor health, malnutrition, robbing the majority from basic education for their “most expensive education around the world for few”, haplessness, economic migration of millions should be expelled from the country or should be allowed to live in the ghettos of Pakistan for rest of their life as a punishment as social workers.

    We have been ruled by snakes and the baby snakes who have drunk the milk of corruption and loot of the poorest people in the world in style, have developed the venom of lies, deceit, shamelessness, arrogance and superiority complex. We must defang the parents along with the baby snakes before allowing them back in to the society.

    I agree with one of the commentator that PPP government should be given credit especially to Prime Minister who has made sure to remain impartial and neutral during all this process and let the Court take its decision.

    So this decision has strengthened the democracy rather than to threaten to derail it until and unless we say democracy just consists of Zardari and he feels threatened to be derailed.

    This is what democracy is about and it should be a lesson to Zardari also that when he was negogiating with Musharraf instead of insisting on NRO to get off the hook of his looted wealth he should have concentrated on getting benefit for his party.

    He has tried to play every dirty card including Sindh Card and lately through his Barrister Kamal Azfar tried to say that GHQ and CIA are out to throw him out. He doesnt realise that he has made the biggest blunder in saying that because he has done nothing but increased hatred from everyone.

    Many things have happened during this year which were never supposed to happen. So keep your hopes alive ;) You will see at least ministers/ambassadors resigning or being fired in days to come. At the very most, they will be given a face saving exit by holding a farce on Saturday during CEC meeting. No sindhi “topi drama” is going to save their a$$ this time. When SC can fire NAB chairman, prosecutor general and his deputy then it can do the same for ministers either. Look at it with the same importance when SC gave 4 months time to govt in July to clean up the mess which by its shear incompetency is made even worse. I don’t think govt has that much time this time around and just by looking at the frequency of gilani-kiyani meetings now a days, I am assuming most ministers will not see their offices by year end.

    A judge in Switzerland has found former Pakistani Prime Minister Benazir Bhutto and her husband, Asif Zardari, guilty of money laundering.

    Investigation Judge Daniel Devaud in Geneva sentenced them to a six-month suspended jail term, fined them $50,000 each and ordered they pay more than $2m to the Pakistani Government.

    He said they had illegally deposited millions of dollars in accounts in Switzerland, and ordered the money be returned to Pakistan.

    The decision is good only if we consider it as a first episode of a serial that would conclude on getting rid of all corrupt people regardless of their camp or creed.

    I see the current decision in a way which can be explained by the analogy that if it is clear that the surgeon is not qualified and rather have a bogus degree but after hearing you still let the surgeon continue performing brain surgery !!

    Therefore, it is sad to see that although judiciary did declare that the corrupt people benefited and it is a bad law but there has been no concrete punitive measures taken. The logical consequence was that the decision should have included a part declaring all those disqualified for public office who had any conviction at the promulgation of NRO. Just suggesting some action against Malik Qayuum and NAB officials is clearly punishing the punishable and leaving the un-touchable. I am sorry to see the decision this way and hope it was clear and reflective of “Andha Insaaf” but clearly the judges had a soft hand for the hard stuff of the tough corners of power corridor.

    The court could not do it because that would have been travesty of law as the people who benfited from NRO were accused and not convicted. So until they are convic ted in a court of law they are presumed to be innocent. That what the Pakistan law states and that is what the consitution states. To let the accused off the hook by a law like NRO is no doubt a crime but that does not mean they have commited a crime also – until they have exhausted all the avenues open to seek justice for the accusations that have been made against them. So the Court in no way could declare NRO beneficiaries as convicted – it could only open up the cases so that the law can take its due course which now it will. Thats why it ordered for Swiss cases to be opened up but that does not mean that Zardari has been convicted of any crime. There is no doubt he will be in future but until then he should be presumed to be innoncent under the eyes of the law of Pakistan as it is his funadmental right to defend himself in any court of law if any accusation is made against him.

    Ofcourse there is no doubt that he is guilty otherwise why would he have asked from withdrawal of Swiss cases because one court he would have expected full justice would have been Swiss court even if he thought a Pakistani court might be biased against him. He has yet to deny any of the Swiss accounts in his name plus he has yet to deny the allegation by Ansar Abbasi about his geting 300 acre of land in Islamabad through a front man. That man has come in open and Zardari hasnt sued him as yet.

    So lets not rush and let the courts decide – the process of pursuance of course of justice is as important as the end result – meaning the judgement.

    By the way not all brain tumours are amenable to surgery – in some cases you have to chemotherapy and radiotherapy.

    What was role of Gen. Kayani in NRO and why, it can’t be specified! At that time it was a very difficult situation, it was quite important to get rid of Musharraf who had brought country almost on the end, so this was one way to move ahead, i think. NRO iss say pehlay kay haraam key barray main tha!

    Well, who knows what the intention of Mr. Kayani was? it is very much possible that he wanted to come forward to do good for the country and its people and had not greed for the post! His positive actions on all fronts so far show that he is a sincere and fair man.

    Do bear in mind that because of removal of Musharraf, somehow country and system started to move ahead, political system started to function somewhat and Judiciary was restored and so on, and that NRO today has been canceled by the Judiciary…. iss tarah saanp bhi mar gia or laathi bhi nahin tooti!

    Pakistan Army has been fighting against anti-Pakistan forces and they have given all kinds of sacrifices for that including people of high ranks. Army has worked positively for the strengthening of political system. Last but not least it was active and positive role of Gen. Kayani along with Nation which resulted in restoration of Chief Justice and his Companions!

    I hope and pray that this decision against NRO proves a big step in curbing the corruption and injustice in Pakistan. It is good decision but still there are many challenges and more fights are waiting but we will, with our determination and help of Allah(SWT), succeed.

    Even though PPP have most of the state machinery under they belt, these cells will keep some sought of check and balance over who they appoint as Prosecutors
    and whether the documents that go back to the Switzerland authority have been tampered with in anyway. It will be interesting to know who is appointed as prosecutors and what they credentials, the media has big part to play.

    Zardari and Co will try all sorts to get out of it but eventually they will have to do Hands Up. The interesting thing for me is what happens when cases of the bureaucrats are dealt with and what comes out closet from them guys will be fascinating.

I have mentioned that it was not clear what his role was, we just can speculate and make guesses! How would you define that what a person can do under oath? I have mentioned that it was a difficult situation and it was necessary to break the deadlock.

    Almost everybody knew about accounts of corruption of Zardari and even those who elected him as president but one can’t do all the things all the time, it takes time and efforts! Have you forgotten that people voted again for the PPP although being aware of their corruption! So ask people to resign also! Similarly, it was not always possible to remove or stop Musharraf to do all what he did, it takes time, in army it is also important to obey the Chief and unfortunately army got a wrong person in the form of Musharraf.

    He is not Moses that he can throw his cane and it will swallow all the Pak Army top brass. As long as the army stay’s neutral and stay busy with its mercenary duties for the West, we should strengthen the democracy first and cleanup the mess.

    Army should take heed from the fact that they will be accountable if they interfere in the public affaires and once we have a true peoples Parliament, we can start controlling the military budget and hierarchy with strong Parliamentary committees.

    One step at a time my overly excited brother……It’s not a good time to start a war with the ethnic mafia’s of Sindh, MQM , the Taliban’s and the Pak army top brass at the same time. It is a wishful and idealistic dream one can only conceive from the safe haven of Canada from a comfortable home and belly full of food.

    It is possible but again it was done to get rid of Musharraf and to bring country back on track i think! I can’t say what happened exactly as i don’t have information.

    Bracketing Aitzaz Ahsan (AA) with PPP crooks is the height of paranoi, consipracy theory given mindset and the fact that we never see the things in the right context. What else do you expect from AA after his role in restoration of democracy. AA is someone who we all should be all proud of. He risked everything, his political/ legal careers and personal/ family prestige during the Movement for Restoration of Democracy. He fought hard within the party as well and won his CEC membership. He is the sole stalwart in PPP to lead it at this moment if Zardari fades out.

    Who can deny the fact that Zardari has constitutional immunity under article 248 and AA is simply explaining that. If there is another petition challenging that in the Apex Court tomorrow, I am sure AA would say that Apex Court has the jurisdiction to adjudicate on that in the given scenario. So plz give us a break on this and dont confuse the readers of this site without your lopsided comments. You need to look beyond your nose to see the real AA. I am proud of him and he is my hero.

    If these corrupt people resign then other corrupts will join the Govt. and came up with scheme “karz utaro mulk sawaro”. Nothing will change except of faces in Govt. People dont know who is good and who is bad, people only knows who is popular and influencial and who is bhoka nanga. You are right even if NRO disposed off it will take years to get this parasite convicted. All his accounts are in Swiss banks and Govt. need to reopen those cases and start things from beginning and have to spend millions for Swiss lawyers to handle those cases, if something is possible it is all those who are already convicted should resign and face their convictions but we all know all of them are the federal ministers and SC cant pressurize them. Only hope in this case for Pakistan is parliament and lets hope that someone from coalition(MQM, ANP, JUI) stands up against them this is the only possible way to get rid of them.

    Frankly tell me, is it me alone who had such feelings or was it the same with nearly everybody/majority of us, Pakistanis? Some of very close confidants of mine also expressed similar feelings, which were akin to the period before ‘BB’ was murdered & again when Musharaf was planning to escape abroad.

    I live in Ireland and here also we hear stories of corruption by the politicians – two years ago Prime Minister of Ireland Bertie Ahern had to resign because he had taken 300000 pounds from his friend 14 years before that when he was not even in power and had deposited in a bank and he could not account for how did he get it. The probable reason was that at that time he was undergoing separation from his wife and for legal reason he borrowed that money from his friend and did not want to show it. But he was accused that he had tried to take a bribe from this friend. After 14 years – after thrice being elected Prime Minister of Ireland and a very successful one – he had to resign.

    So what I am saying that if we make our media and judiciary strong Inshallah we would be able to control corruption to a large extent – although it cannot be eliminated completely.

    Recently many MPs in House Of Commons were caught for submitting excessive expenses to the House of Common Committee for reimbursement and it was leaked by Daily Telegraph and many of them had to resign – the biggest resignation was that of House of Commons Speaker – unheard of in last three hundred years. Its another thing that Prime Minister Gordon Brown got him elected to House of Lords. Politicians are by nature corrupt but we have to make difficult for them.

    The good thing about judgement of Supreme Court is that now no one can feel safe to do corruption and get away with it. If President Zardari chooses to hang on to his job – he can do so – but whats the use because he has lost all the respect and moral authority and in fact it rather confirms that he has something to hide thats why he is hiding behind the immunity. If he is clean and everything was engineered against him then he should trust Justice Iftikhar Chaudhry’s court and should come forward to prove his innocence. But he never will because he is no doubt guilty. Let him stay in Presidency and for the rest of his tenure get the abuses and curses of the people of Pakistan. That is what he deserves. Bakray ki maan kab tak kher manaye gi – kabi na kabi to churi kay neechay aye gi na.

    Husband of one of the MP had actually claimed money for hiring porno movies to watch at home and he had the audicity to actually submit that in his claim in front of House of Commons and it causes so much embarrassment to his wife that he had to resign. Another MP of Pakistan origin Shahid Malik also had to resign because he was claiming on a second home when he had actually rented that to another money and had also claimed for a plasma TV for this home.

    So we dont have angels anywhere – just humans – the only way to deal with their mistakes is to make the insitutions and systems strong.

Even if we have to live with the current number of provinces then autonomy is the way to go.
    In terms of your views that Bhuttos were hanged/killed in Punjab, I can not buy this idea. Bhuttos were equally loved and honored in Punjab. Their killing in Punjab is not that something Punjabis did. We all know and have an idea that their assassinations were an international issues. I request my Sindhi brothers to stop this blackmailing and abusing punjabis for this.
    Our political parties are not democratic. Does not matter if this is PMLN, Q or PPP. The current politicians are pinheads and slaves of these khandani parties. I don’t say anything on Mr. Zardari. Everyone can have his own views. Anyone can take him as a prophet (Mr. Clean) or Mr. 10 or 100%.     All corrupt should be jailed no matter who they are and where they belong.
    I have been a presiding officer in many elections and know the voters and their mind very as well. I believe education and equal opportunities for everyone will make a difference in future but let us move forward with love of the country in mind and actions. We should not be slaves of any khandani political party.

    In terms of your views that these politicians are elected by people. I disagree because I know politics in Pakistan. Sindh assembly has teh right to pass any resolution but today’s in favor of Zardari is blackmailing and threat. For just information I hate Sharif’s slogan of Jaag Punjabi Jaag in past.
    In my views Mr. Mahmood Achakzai should be the President of Pakistan.
    The changes should be made in the constitution that all prominent positions should be shared by the politicians from all the provinces. Abb Sadar Sindhi, Speaker Sindhi, Chairman Senate (I think from Sindh but not sure but he is a Bhutto family slave) and useless Prime Minister kept for a reason to be PM who is directly answerable to Bilawal Bhutto and AZ. Mery bhai abb tumhin Sindh nazar nahin ata. Please khuley dil say her issue ko evaluate karin.

    واشنگٹن. . . .. . . .امریکا میں تعینات پاکستانی سفیر حسین حقانی نے امید ظاہر کی ہے کہ صدر آصف علی زرداری اور ان کی حکومت کے خلاف بغاوت نہیں ہورہی۔ واشنگٹن میں امریکی ٹی وی پر صحافی ولف بلٹزرسے گفتگو کرتے ہوئے حسین حقانی کا کہنا تھا کہ انھیں امید ہے کہپاکستان میں بغاوت نہیں ہورہی۔ ماضی کی بغاوتوں نے پاکستان کو بہت نقصان پہنچایا۔ پاکستان میں اعلیٰ فوجی قیادت سمیت سب ہی یہ طے کرچکے ہیں کہ فوج کو ملکی سرحدوں کے تحفظ پر توجہ مرکوز رکھنی چاہئے اور منتخب حکومت کو آئین کے مطابق ملکی معاملات چلانے چاہئیں جبکہ عدالتوں کو قانون کی روشنی میں فوجداری اور آئینی معاملات پر فیصلے دینے چاہئیں۔انھوں نے مزید کہا کہ امید ہے پاکستان میں ہر ایک اپنا آئینی کردار ادا کرے گا اور ملک بغاوتوں کے راہ پر گامزن نہیں ہوگا کیونکہ ان بغاوتوں نے ماضی میں ملک کو تباہی سے دوچار کیا ہے۔

    I want to ask you one very very simple question – Lets assume that Zardari had no assets in Switzerland and all those accounts are false. Right. And lets assume that he is innoncent and he has been implcated in that. If that is the case then whey did he want to get rid of Swiss cases through NRO. He should have gone to the court himself and demanded that he should be heard and given justice because he is clean. But he didnt do it because by doing so he would lose claim to those accounts and they run in millions of dollars.

    Now dont say the old argument – everyone has done it before so what if he has done it –
    To that I would say that everyone has done it before but that does not mean we should allow to get it done again. This is like saying to a woman who has been raped once not to protest at the subsequent rape and accept it. So you want us Pakistanis to accept every corruption because we have been cheated before.

    Actually what the PPP does not realise that Pakistan has changed completely because of this information explosion and development of media. Now you cannot stop people from questioning. Young generation is not like old generation to accept

    Dear Chief Justice Iftikhar Chaudhury

    It seems you are an activist chief justice, and are quite eager to take up Suo Moto actions supposedly to bring about justice and resolve outstanding issues that confront Pakistan.

    Here are some my suggestions to you; three issues that many Pakistanis feel deserve your immediate attention.

    Initiate Suo Moto action against the people who orchestrated an attack on Pakistan’s Supreme Court at the time when the then Prime Minister Nawaz Sharif was about to be disqualified from holding public office. If the issue of NRO, which is insignificant given Pakistan’s other challenges, can be tried and decided with such swiftness, the attack on the Supreme Court that you now chair deserves to be examined as well.

    Seek and deliver justice to retired Chief Justice Sajad Ali Shah. Otherwise, those Pakistanis who feel your actions in negating the NRO was merely targeted at people from smaller provinces, especially from Sind, will have their fears justified.

    Institute an independent panel that shall review corruption charges levelled against you by General Musharraf. It will only be fair if an independent body of legal experts, accountability professionals and other law enforcement official reviewed all the facts and evidence against you and make recommendations based on their findings about your suitability as a Chief Justice . Until then you should step aside so that not justice is done.

    Chief Justice, are you prepared to appoint an independent panel to review the corruption charges levelled against you by General Musharraf?

    Many Pakistanis find it intriguing that there is nothing in your NRO judgment against the people, prime minister and government that helped General Musharraf in creating and establishing the NRO amnesty law. Why is it that those who facilitated and backed the NRO under General Musharraf have not been held liable for their action, notwithstanding the fact they now claim to be against the very law they helped introduce in this country?

    I am sure you will understand most Pakistanis feel your actions are not the first time that the Pakistan Army has played a role in undermining a civilian government using NRO or some other such excuse as a cover.

    Your critics claim that the labels, the charges, the smokescreen may have change, but the end result has remained the same. For example:

    ZA Bhutto became a victim of the cooperation between the military and part of the judiciary.

    Nawaz Sharif was thrown out by the military and his expulsion, especially the second one, was promptly validated by the judiciary to help a military dictator strengthen his grip on power.

    Benazir Bhutto’s governments were overthrown by the army because she was trying to take put of Pakistan’s foreign policy in the control of parliament and away from the generals.

    And now President Zardari is being hounded out of pwer by the same forces – the judiciary and army.

    Pakistanis understand why whenever a civilian leader, who is also democratically elected, tries to apply brakes on the unchecked growing power of men in uniform, there is always a crisis created, allowing the army to step in, ostensibly to ’save the country.’

    Many of us feel what is happening in Pakistan is wrong, and that it should be stopped. The country should not forget that Al-Qaeeda and the Taliban have declared war on Pakistan. We feel that by exploiting heated sentiments, you, Chief Justice Iftikhar Chaudhry, are playing with fire and your reckless attitude could ignite nationwide flames of hatred, division, and cynicism.

    More importantly, if you do not pursue genuine corruption cases against politicians from other parties and provinces, especially PML (N) and PML (Q) with equal zeal and vigour, Pakistanis will have no choice but to believe that the sole purpose of throwing out the NRO amnesty law was to settle scores with President Zardari and General Musharraf at the cost of Pakistan’s future.

    Your actions reflect a medieval mindset of revenge and tribalism, not the rule of law that so many of your supporters had expected when they campaigned for your restoration.

    Looking forward to the day you appoint an independent panel to review the corruption charges levelled against yourself.

Please do not deprive Pakistanis of their only hope and the reason to live by ivoking the finer points of jurisprudence. Courts will learn their lessons and hand out better verdicts.

    It is also wrong that courts are carrying out selective accountiblity. Consider these:
    = 9 Mar 07 Chief Justice defied a generalismo which led to 20 July 07 restoration of the CJP. Wasn’t that saying no to a Martial Law Administrator?
    = Emergency of 3 Nov 07, CJP again said no and a 7 member bench passed the judgement against that. The process led to recruitment of 3 sets of PCO judges in Supreme Court and High Courts. What was that?
    = 31 July 09 verdict which sent home more than 100 plus superior judiciary judges. Wasn’t that accountibility of judiciary? Did that ever happen before in the history of Pakistan?
    = Musharraf, a all powerful Chief of Army Staff was sent home/ humilitated because of our judiciary ably supported by parties like PML-N, JI, Tehreek Insaaf, PK MAP etc. Wasn’t that accountibiltiy of Army?
    = Zardari was directly beneficiary of the judicial activism. If Musharraf was not weekened by judiciary, the events which later occured would not have occured the way they did.
    = Yes, one can say that there are no cases against Sharifs or PML-N but then they were mostly wronged in last 10 years during Musharraf rule when PPP was busy making deals. Judiciary first undid those wrongs. And remember who is forcing their MNAs/ MNAs to resign on petty allegations. Remember MNA Haji Pervez and MPA Shumaila Rana.
    = Supreme Court recently cancelled the lease of Army Welfare Trust in Karachi which is also unprecedented in Pakistan. I can also see that Asghar Khan petition about the distribution of money to IJI bu ISI will be taken up by Supreme Court sooner rather than later. So is it selective accountibilty?

    On the day after an unprecedentedly broad bench of Pakistan’s Supreme Court pronounced its death sentence against the National Reconciliation Ordinance (NRO), the government in Islamabad felt obliged to dispel rumours of a coup in the making.
    The perception that something extraordinary was afoot was reinforced when immigration authorities prevented the defence minister, Ahmed Mukhtar, from boarding a flight for an official visit to China.

    The government rallied its thoughts and opted for defiance. Four officials lost their jobs over Mukhtar’s humiliation, and Prime Minister Yousuf Raza Gilani declared that President Asif Ali Zardari would ignore opposition demands to step down. He also made light of a reported arrest warrant for the interior minister, Rehman Malik.

    A hurriedly convened session of the ruling PPP central executive resolved that, contrary to the advice of the recently reinstated Aitzaz Ahsan, there would be no ministerial resignations, and that ministers facing revived legal proceedings would have their day in court.

    That’s not an unreasonable response in the circumstances, given that it explicitly incorporates acceptance of the Supreme Court’s verdict, and it’s perfectly valid to draw a distinction between corruption charges and proof of guilt. It is also gratifying that the temptation among hotheads to launch a crusade against the judiciary has thus far been resisted.

    What’s harder to understand is why the government was apparently caught off-guard. After all, what were the chances of the court endorsing the NRO? That the government did not seek to legally counter the petitions challenging the ordinance suggested it was aware that the law introduced by former president Pervez Musharraf was effectively indefensible.

    Could it be that the implications of the generally predictable verdict were not quite clear? After all, although accountability has frequently been a catchcry of successive administrations, it has hitherto been invoked exclusively against the opponents of the party or junta in power. Which helps to explain why accountability campaigns have tended to be invalidated in the popular perception by the stigma of politically motivated vindictiveness.

    Last week’s judgment represents a change in this pattern that, on the face of it, deserves to be welcomed. The NRO wasn’t Musharraf’s first volte-face in this context. For all the pious talk about combating corruption, the politicians who pledged loyalty to his dictatorship were spared the indignity of financial probes.

    Musharraf can claim that the NRO was effectively forced upon him by external pressures as a means of facilitating Benazir Bhutto’s return to Pakistan, but no comparable excuse can be cited for the extrajudicial exoneration of the Q-branded PML stalwarts.

    When the NRO became law in October 2007, it entailed a sweeping amnesty for more than 8,000 politicians, bureaucrats and political workers who had been accused of pecuniary improprieties, murder or terrorist activities in the period between Ziaul Haq’s martial law and Musharraf’s coup. This meant a clean slate for, among many others, the then Dubai-based PPP chairperson, her New York-based husband and a handful of their leading aides, as well as for the London-based Altaf Hussain and fellow leaders of the MQM.

    Given the context, it is probable that some of these charges were tendentious while others were likely based on instances or well-grounded suspicion of wrongdoing. Ultimately it ought to be a matter for the courts. Unfortunately, Pakistan boasts a tradition of justice invariably delayed and frequently denied. The acquittal earlier this month of all 18 policemen accused of involvement in the murder of Murtaza Bhutto, who was gunned down in a police encounter outside his Karachi residence while his sister was prime minister, could be seen as yet another instance of this trend.

    It has long been the received wisdom that judges at all levels are prone to pressures and other inducements from the powers that be and other vested interests. There have always been honourable exceptions, too — the names of M.R. Kayani and Dorab Patel spring readily to mind.

    Iftikhar Chaudhry’s refusal to kowtow to Musharraf’s coterie and the lawyers’ movement that twice led to his restoration as chief justice are widely seen as unprecedented developments that have bolstered the rule of law. Back in July, the reconstituted Supreme Court struck down the emergency of Nov 3, 2007, albeit without specifically impugning its architect, and asked the government to refer the NRO to parliament.

    The government baulked at this when it realised it didn’t have the numbers. But supposing parliament had ratified the ordinance, how would that have affected the legal decision on its validity? Following Chaudhry’s second restoration, one of his biggest supporters expressed the hope that ‘in the larger interest of justice’ the chief justice ‘himself would not hear the case against the NRO.’

    In that instance, too, Aitzaz Ahsan’s well-intentioned advice went unheeded. And it is unfortunate but true that segments of last week’s short order are open to interpretation as indications of a personal agenda.

    Judicial activism will lose its lustre unless it can also be seen, broadly if not universally, as judicious activism. Ideally, rather than an occasional blast from the past, accountability ought to be a perpetual process whereby everyone — be they in power or out of it, and in uniform or out it — is answerable for culpable wrongdoing.

    There have, inevitably, been calls from among PPP ranks for corruption cases against PML-N leaders to also be revived. Beyond the tit-for-tat politicking, the demand isn’t altogether unreasonable, given that both parties competed arduously for power and pelf during the superficially civilian interregnum of the 1990s.

    Yet the khaki party that has been in power the longest seldom faces demands for accountability, although its conduct in any number of spheres has rarely been above reproach. That’s unlikely to change in the foreseeable future.

    Kamal Azfar, meanwhile, wasn’t exactly wrong in pointing to the GHQ and the CIA as sources of the biggest threats to democracy in Pakistan. But he would have come across as considerably more credible had he also shortlisted a third culprit in this context: our self-serving politicians.
