جسٹس افتخار چوہدری نے صدر پاکستان کو سفارش کی ہے کہ :
١ – خلیل رمدے جو سپریم کورٹ سے ریٹائر ہو چکے ہیں ، انہیں سپریم کورٹ کا ایڈہاک مقرر کیا جائے ۔
٢- خواجہ شریف کو لاہور ہائی کورٹ میں چیف جسٹس کے طور پر رہنے دیا جائے ۔
٣ – جسٹس ثاقب نثار کو سپریم کورٹ کا جج مقرر کر دیا جائے ۔
یہ تینوں سفارشات آئین کے منافی ہیں ،کیونکہ آئین کے مطابق :
= کسی عدالت میں مستقل جج کی آسامی خالی ہو تو ایڈہاک جج مقرر نہیں ہو سکتا ۔
= سپریم کورٹ میں جج کی آسامی خالی ہو تو سینئر موسٹ چیف جسٹس کو سپریم کورٹ کا جج بنایا جائے گا ۔
۔ اس کے مطابق جسٹس شریف خواجہ کو سپریم کورٹ میں جانا چاہئے ۔
= کسی ہائی کورٹ میں چیف جسٹس کی آسامی خالی ہو تو اس کے سینئر موسٹ جج کو چیف جسٹس بنایا جائے گا ۔
۔ اس کے مطابق جسٹس ثاقب نثار کو لاہور ہائی کورٹ کا چیف جسٹس بننا چاہیئے ۔
سنجیدہ دوستوں کی خدمت میں التماس ہے کہ براہ کرم یہ دو پروگرام ضرور سنیں ؛
۱۔ ،،پالیسی میٹرز،، از نسیم زہرہ ۔ ۱۸ جنوری ۲۰۱۰
۲ ۔ ،،کیپیٹل ٹاک،، از حامد میر ۔ ۱۹ جنوری ۲۰۱۰
ان دونوں پروگراموں میں ملک کے قابل اعتماد اور نامور قانون دانوں نے روشنی ڈالی ہے اور اگر انسان چاہے تو آسانی سے اس معاملہ کی تہہ تک پہنچ سکتا ہے ۔ اور مزید وضاحت کی ضرورت ہی نہیں رہتی کہ جناب چیف جسٹس صاحب کے مطالبات آئین کے منافی ہے ۔

Iftikhar Gilani, Justice Tariq and even Barrister Zafarullah who filed case in support of Zardari agreed on on epoint without any ambiguity……………CJ CONSULTATION is binding for appointment of new judges, similarly Governors need to act and clear the files, if they don’y have any cogent reason.
On adhoc judges, there is a need of presidential approval. CJ recommends and President approves. Here the word consultation has not been used in Article 182, but in any case the Chief Justice has the constitutional right to recommend some one as ad hoc judge.
So, please do not confuse people by wrong interpretation.
Lastly, NRO detailed judgement has humbly sought return of national wealth looted by zardari like Marcos.
I hope you people would support the fact that all th elooted money should return to Pakistan.

Zardari and his gang must be punished. He was making all the “cheekho pukar” to frighten judiciary that he would attack them if they give the right decision. So, let’s face it.
Regrading some posts above, I feel it is the dirty work of some people like Fauzia Wahab and her son, who have been programmed to utter some illogical things all the time.
Iftikhar Gilani was perhaps the most sensible legal expert in PPP, but sensible people do not suit Zardari. Zardari likes Babar Awan who tells him every day that he is the most popular leader of Pakistan and he should use all hi spower to crush the institutions which challenge his authority or question his corruption. Khosa, Farooq Naik, Babar Haiwan all “IL-LEGAl” wizards of Zardari.

Samsam Bukhari was badly humiliated in front of the whole nation when NM read the SMS about power plants and Bukhari challenge was nullified right there.Then he turned around and said that NM should invite some expert on electric power plants.I wonder what is Bukhari,s job? to tell the lies to the nation.
Samsam Bukhari instead of giving straight answers was so quarrelsome.It shows the frustration and incompetence of the government.

Barister Zafrullah Khan i believe had only one point to talk ,immunity for president under the constitution.OK but who is challenging that? no body.Barister Zafrullah did not make much sense about the issue under discussion.

Iftikhar Gilani is one of the very old member of PPP.He was once law minister in PPP government.He rightly said that today PPP just use the name of Z A Bhutto in reality they dont even remember his ideology.How long PPP will play with sentiments of the people in the name of ZA Butto and BB.

Brother the point is yes president has final word but on the recommendation of CJ not of his own or his own choice.If president is not agreed with the suggested names by CJ he has to give solid reason based on logic.Othewise president has no right to over turn CJ suggestion.

Yes but Bukhari was acting rediculous in the whole of the show.In the last 5 minutes he was almost ready to fight just because he was so frustrated having no answer of any question.
