U.S. Supreme Court Decides Presidents Are Not Above the Law
There have been two very important cases in recent decades in front of the U.S. Supreme Court involving the exemption of a sitting president from judicial process when there was possible criminal or civil misconduct at issue. In both cases, the Court ruled that separation of powers required that a president not be able to escape the judiciary and be above the law.
The first of these cases was United States v. Nixon in 1974 in response to the Watergate break-in and subsequent cover up scandal. The second was Clinton v. Jones in 1997 where the issue involved the right of a sitting president to avoid civil liability for actions that were out of the realm of his official duties. Each case proved that the Court strongly believed in the checks and balances of the original U.S. Constitution.
In Nixon’s case, it was widely believed that he had a role in the break-in of the Democratic headquarters at Watergate and sanctioned illegal wiretapping. Once elected, he was also believed to be hiding evidence crucial to the prosecution of the seven defendants as this evidence would implicate himself. He attempted to use the right of executive privilege to circumvent the special prosecutor’s subpoena of documents relating to conversations about the cover-up of the break-in.
The opinion of the Court, led by Chief Justice Warren Burger, was unanimous in its decision Justice Rehnquist recused himself due to having served under Nixon in the Justice Department during Nixon’s first administration. The remaining eight justices limited executive privilege to areas that did not interfere with due process, in this case compelling the production of evidence necessary for a fair and complete trial of the seven defendants.
U.S. Supreme Court Decides Presidents Are Not Above the Law
In the Clinton case, a sitting president attempted to avoid a civil suit arising from alleged sexual misconduct prior to his presidency and during his tenure as the governor of Arkansas. President Clinton’s response to allegations brought by Paula Jones, a former state employee, was to invoke presidential immunity, the constitutional protection that frees a president from fear of civil suits arising from unpopular consequences resulting from the performance of his official duties. This immunity has been consistently deemed necessary for the president to function and make decisions without his proverbial hands being tied by the threat of civil suits.
While the lower federal court denied Clinton’s right to categorically avoid the suit and allowed discovery to continue, it postponed any possibility of trial until after he was to be out of office. On appeal, the Supreme Court was again unanimous in its decision that judicial process had equal power to the president and refused him both immunity from the suit and an unconstitutional delay of due process for the plaintiff.
At issue in both of these cases was whether the separation of powers built into the federal government by the Constitution gave equal weight to all three branches of government. The Courts, charged with interpretation of the law since the Marshall era, answered with a resounding yes. Both cases clearly showed that the President could not invoke executive privilege or presidential immunity in matters that had no bearing on national security or interests. In Nixon’s case, his refusal to submit evidence was viewed as an obstruction of justice; in Clinton’s case, his personal behavior outside of the realm of presidential duties were seen as giving him no allowance to avoid consequences. Both of these cases served to limit presidents ability to function as absolute powers that could operate in the dark and not answer to the courts as any other citizen would have to under similar circumstances.

He is talking neither about the ” Rubber Stamp Parliament” nor about the
”Independent Judiciary” . He is just talking about the Constitution , the same Constitution under he claimed that the Chief Justice of Supreme Court could not be removed by the Prime Minister or he President. He could only be removed through the Supreme Judicial Council.
In particular, it is being asked whether Article 248 of the Constitution grants immunity to the president from any criminal or civil legal proceedings. Is that really possible?
Sub-clause (2) of Article 248 stipulates: “No criminal proceedings whatsoever shall be instituted or continued against the President or a Governor in any court during his term of office.” Repetition of this on TV news channels by the president’s protectors establishes an impression of absolute presidential immunity. However, logic and common sense cannot accept the notion of a ruler enjoying absolute immunity from prosecution despite any crime “whatsoever,” and getting away scot-free. Say, if a president commits murder, would he not be liable? We need to adopt a more nuanced interpretation of Article 248 of the Constitution and explore more deeply the whole notion of executive immunity.
The concept of immunity is not unique to the Constitution of Pakistan; it is present in most of the democratic constitutions in one form or another. The constitution of the United States furnishes one good example, and there have been some informative deliberations on this topic by the US Courts.
The archaic concept of sovereign immunity provided absolute immunity for the monarch on the basis that “the king can do no wrong.” In a democracy, however, the president is no longer the symbol of sovereignty, which, instead, is deemed to rest in the people. And, in any event, the doctrine of sovereign immunity applies to limit governmental rather than personal liabilities.
This does not mean that in a democracy a president is not eligible to any immunity. In fact, the presidency is a unique office which enjoys the greatest immunity possible in a modern state. The supporters of absolute immunity for the president of Pakistan advance this cause on two grounds, which are nevertheless recognised in most other republics. First, the head of state needs to work without any distraction and fear of being sued in a court of law, which enables him to conduct effective governance. Second, the separation of powers between the organs of state requires the various branches, in particular the judiciary, to stop interfering in the affairs of the other branches.
Interestingly, the subject of presidential immunity in Pakistan has not previously been under serious consideration. However, a good case study in this regard would be the constitutional jurisprudence in the United States, which like us has a written constitution and where presidential immunity has been the subject matter of some notable cases where the US Supreme Court elaborated on this issue.
The earliest decision of the US Supreme Court is Mississippi vs. Johnson in 1867, in which Chief Justice Marshall placed the president “beyond the reach of judicial direction, either affirmative or restraining, in the exercise of his powers, whether constitutional or statutory, political or otherwise, save perhaps for what must be a small class of powers that are purely ministerial.”
Until 1974, this remained the established principle of absolute immunity and in 1974, in the case of Nixon vs. Fitzgerald, the Supreme Court elaborated further the concept of executive immunity. In this case, the president was sued in a civil suit and the US Supreme Court was asked to consider a claim by former president Richard Nixon that he enjoyed an absolute immunity from a former government employee’s suit for damages for his allegedly unlawful official conduct in office. The Court endorsed a rule of absolute immunity, concluding that such immunity is “a functionally mandated incident of the President’s unique office, rooted in the constitutional tradition of the separation of powers and supported by our history.”

وہ مالی ، مالٹے ، چور اور درخت پر چڑھنے کی مثال دیتے ہیں لیکن بات نہیں بنتی ۔
وہ آرٹیکل ٢٤٨ کی دیوار کے پیچھے چھپنے کی بات کرتے ہیں تو انہیں بتایا جاتا ہے کہ کانسٹیچیوشن دیوار ہی نہیں ایک فصیل ہے ۔
وہ آرٹیکل ٦٢ اور ٦٣ پر زرداری کے پورا اترنے کا سوال کرتے ہیں ۔ انہیں سپریم کورٹ کے فیصلے کی روشنی میں بتایا جاتا ہے کہ ہر اس شخص کو آئین کے ان آرٹیکلز پر پورا اترتا ہوا تصور کیا جائے گا جب تک عدالت فیصلہ نہ کر دے کہ کوئی شخص ان پر پورا نہیں اترتا ۔
زرداری فوبیا میں وہ شخص نہ صرف یہ اپنا توازن برقرار نہیں رکھ سکا بلکہ بہت سے سادہ لوگوں کی گمراہی کا باعث بن رہا ہے ۔

کہتا ہے کہ تمہیں رقیبوں کے شوروغل سے نہیں گھبرانا چاہہیے کیونکہ کتوں کے بھونکنے سے فقیروں کا رزق کم نہیں ہوتا۔ عرفی کے شعر والے کتے واقعی
ایسے ہوتے تھے کہ فقیران سے نہیں گھبراتے تھے۔ ان کتوں نے گاءوں کے تحفظ کی ذمہ داری لی ہوتی تھی اس لیے جیسے ہی کوءی اجنبی چہرہ دیکھتے
تھے تو اس پر بھونکنا شروع کر دیتے تھے ۔ تھوڑی دیر تک بھونکنا جاری رکھتے اور پھر اپنی دنیا میں مگن ہو جاتے۔ یوں اجنبی کو پتہ چل جاتا تھا کہ

شکار والے دن ایک ٹولی ڈھول بجانے والوں اور کتوں کو لے کر جنگل کی طرف نکل جاتی ۔ ڈھول بجانے والے اور بھونکنے والے کتے ایک بڑے علاقے سے
گھیرا ڈالتے ہوءے شکار کو پریشان کرتے ہوءے ایک خاص سمت میں آنے پر مجبور کرتے ۔ آہستہ آہستہ گھیرا تنگ ہو جاتا اور کتے اور ڈھول والے شکار کو

Until last year, the closest the Army came to accounting for its work was its annual budget submission: a single, bottom-line dollar figure that the government was constitutionally bound to approve. Even now, after a much-hailed move toward more oversight, the Army’s most recent annual budget submission was just two pages. And Pakistan’s Inter-Services Intelligence (ISI) — a powerful and independent military agency — is no better. Last year the Interior Ministry requested that it report to the government; the ISI declined the invitation.
Long before the Bush-Musharraf agreement, money from such unsupervised budgets had enabled the Army to become one of the richest and largest industrial, banking, and landowning bodies in Pakistan. The military formed its own networks of political patronage, co-opting existing political parties with threats and bribes. With the injection of the U.S. cash, this already prevalent military corruption was thrust into high gear. The extra money further discouraged the military and intelligence services from submitting to civilian control — a precondition for the country’s democratization.
Pakistan did not use the majority of the funds for the agreed objective of fighting terrorism. Instead, the money was looted and deposited in foreign banks by Musharraf cronies,now enjoying musics and indian pubs in UK…..etc. .

I do not how many of the bloggers cast thier vote. It is the common people who select the assembly members. ڈاکٹر صاحب ایک ہم قومی مسئلے کو ڈسکس کرنے کا بہت شکریہ. امید ہے آپ آئندہ بھی قومی مسائل ہی کو اہمیت دیں گے اور ایسے معاملات کو زیادہ اہمیت نہیں دیں گے جن سے قوم تقسیم ہوتی ہے. اس وقت ہمارہ مسئلہ نہ تو زرداری ہے اور نہ ہی این آر او. مجھے علم ہے کہ میرے بہت سارے دوست میرے ان جملوں کو آصف زرداری کی حمایت سمجھیں گے اور مجھ پر تنقید کے تیر برسائیں گے لیکن وقت بتا رہا ہے کہ سچ کیا ہے اور زمینی حقایق کیا ہیں. کل تک جو کچھ میں کہ رہا تھا آج وہ سب کچھ زرداری کے سخت مخالف امیر جماعت اسلامی منور حسن اور دوسرے لوگ کہ رہے ہیں. یہ ایک حقیقت ہے ہے آصف زرداری اسوقت ملک کے صدر ہیں. وہ اچھے ہیں یا برے، یہ ایک الگ بحث ہے. اسکے غلط کاموں پر تنقید کرنا ہر ایک کا جمہوری حق ہے. لیکن یہ بحث اس وقت ملک کے عوام کو تقسیم کر رہی ہے اور اسوقت ضرورت قوم کو متحد کرنے کی ہے تقسیم کرنے کی نہیں. اس بحث کا نتیجہ پچھلے دنوں آپ جئے سندھ کی کراچی میں کامیاب “آزادی ریلی” کی صورت میں دیکھ چکے ہیں. آصف زرداری جو کچھ کر رہے ہیں انکو بلکل نظر انداز کارکیا جا سکتا اور نہ ہی انہیں ہر غلط کام کرنے کا سرٹیفیکیٹ دیا جا سکتا ہے. گزارش صرف اتنی سی ہے کہ تنقید کرتے وقت یہ ضرور ذھن میں رکھیں کہ آپ کہیں صدر کے عہدے کو کمزور تو نہیں کر رہے. اگر صدر کمزور ہوگا تو وہ آسانی سے ملک دشمنوں کے آگے جھک جائے گا اور انکی تمام باتیں مان جانے گا جو وہ منوانا چاہتے ہیں جیسا کہ پرویز مشرف نے کیا ہے. اگر صدر کو پتہ ہوگا کہ میرے عوام میرے پیچھے سیسہ پلائی کی دیوار بنے کھڑے ہیں تو وہ دشمنوں کے لیے لوہے کا دشمن کے آگے نہیں جھکے گا.ہمارے دشمن چاہتے ہیں کہ ہم باہم دست و گریباں ہوتے رہیں اور وہ آسانی سے ہمیں شکار کر لیں. اب یہ ہمارے اوپر ہے کہ ہم دشمن کی چالوں کو کہاں تک کامیاب ہونے دیتے ہیں. آصف زرداری اس ملک میں نہ تو پہلا اور نہ ہی آخری آدمی ہے جو اس ملک کو لوٹ رہا ہے. وہ ساری عمر اس عہدے پر بیٹھا بھی نہیں رہے گا. اسے ایک نہ ایک دن عوام کے اور انصاف کے کٹہرے میں آنا ہے. ہمیں آصف زرداری کو نشانہ بنانے کا درس دے کار جو مقاصد حاصل کرنے کی کوشش کی جا رہی ہے اسکو بےنقاب کرنا ہے. ہماری توجہ بیرونی مداخلت سے ہٹانے کے لیے جو نیند کی گولیاں کھلائی جا رہی ہیں ہمیں ان گولیوں کوڑے کے ڈھیر میں پھینک کر ان دشمنوں کو پہچاننا ہے جو خدا نخواستہ ہمیں سقوط بغداد جیسی صورت حال سے دوچار کرنے کی سوچ رہے ہیں اور اپنے ناپاک عزائم لیکر اس ملک میں داخل ہو چکے ہیں. اگر ہم جاگ رہے ہیں اور دشمن کی چالوں کو سمجھ رہے ہیں تو دنیا کی کوئی طاقت ہمیں شکست نہیں دے سکتی. اگر ہم سلطنت عثمانیہ کی طرح باہمی دست و گریباں رہتے ہیں تو کسی کو ہمیں مٹانے کی ضرورت ہی نہیں ہم خود ہی اپنے آپ کو ختم کر لیں گے. فیصلہ ہمارے اپنے ہاتھ میں ہے

One point the whole media is missing is that even if the president enjoys constitutional immunity from prosecution, shouldn’t the parliament impeach him if there is clear evidence of his Swiss accounts and corruption? Party is just a name, a dead entity. It is the members of that party which matters.
Well: It was the good characters of past who earned fames BUT what about the current
characters ?. These party members are Busy all the time..depositing

Despite the immunity under article 248 of the constitution, Zardari should go to the court and clear his position, this is a chance he will not going to have it again.

Corruption is a result of not allowing the Democracy flourish in the country. The same Chief Justice who is heading the Supreme Court had given life to Mr. Pervaiz Musharaf in his judgment in 1999. He even went further by declaring in the verdict that this coup is according to the Islamic tenants. Now the majority is feeling some rat smell in this judgment because it is pointing all its fingers to one person called Zardari. I think a very Big Game is being played by the forces who have nothing to do with Democracy. People in Pakistan are waiting for some better sense to prevail other wise we might be heading towards some big disaster. If corruption is the only issue then All Heads are corrupt.
President Zardari has become the punching bag of Pakistan. The same old stinking rhetoric is being used pulling out his old history examples of corruption. All people see is what he did long time ago and give him no credit for what he did now. I am not well-versed with nitty gritties of Pakistan political system, but Zardari for sure is not the one to ruin the political system.
Zardari no longer has the moral authority and ground to head the federation,whether he will do so or chose to seek cover behind the cloak of immunity guaranteed to Presidents under the constitution is another question.

Arguments against Absolute Presidential Immunity
While many people believe in absolute presidential immunity, this issue has always been, and remains, contentious because there are also many who believe in the doctrine of limited presidential power and control in a nation.
Historically, presidential privilege has always conflicted with the doctrine of separate but equal distribution of powers amongst the legislative, judicial, and executive branches of government.
Those who believe in and support the doctrine of the separation of powers have argued that the powers of the legislative, judicial, and executive branches of a government constitutionally are separated but must remain coordinated and distributed equally amongst the three branches of government.
Anything short of this shall woefully amount to the abuse of power by a president. Advocates of limited presidential power and restricted privilege further argue that while the Constitution distributes and diffuses powers amongst the legislative, judicial, and executive branches of a nation’s government in order to better secure liberty and justice, it also commands coordination and interdependence amongst the three separate but equal branches of government for the purpose of equal justice and better governance.
The doctrine of separation of powers conflicts with the granting of absolute and unrestricted power to a president. Allowing a president to have absolute power could conflict with the provision of equal justice and human rights in any developed and developing society.
It could be a troubling and terrifying environment if unrestricted and unchecked powers were to be granted to a former or current president. Therefore, there must always be checks and balances on the powers of a president regardless of if he or she is a president of the Western World or in the troubled environment of Africa.
The president and other government officials are also subject to the same laws that apply to all citizens.
Since granting unlimited and unchecked powers to a president cannot be accounted for and sustained under the doctrine of the separation of powers, there is no precedent for such occurrence.
Some argue that to compel a current or former president to appear before a court to account for his or her unofficial and unlawful actions might appear to leave a nation and its executive branch of government without a president. However, it is the power and province of the courts to say what the law is.
Therefore, the legislative, judicial, and executive branches of a government must always act as checks and balances of a former or current president’s acts.
Anything short of this is equal to asking a nation, Western or African, to place its president above the rule of law, equal justice, and the respect for human rights. Please see Marbury v. Madison (1803), Baker v. Carr, Youngstown Sheet & Tube Co v. Sawyer, Article III, Sections, I and II, P15, and the Liberian Constitution Articles 65 and 66.
You need integrity specially in politics. Zartdari should not have entered into politics and stayed in the background as a temorary party leader grooming his son to take over at the appropriate time. But no, he could not resist the temptation to come in the front line. This was a mistake because he did not have a clean background and also carried a bag of worms, his companero spread across in several countries, holding more than one residence and equally considered corrupt. People in the country have gone bonkers becaus of foreign interventions and weak leadership.

You are putting Bawa on a pedestal and seemingly you have anal fixation with him. Bawa is entitled to his opinion and can change it when he feels fit. Get a life and write something original. Zardari is an excellent mask of democracy because he was/has been/is much more corrupt than the military Generals and he serves the US interests in S.Asia beautifully
In the larger interest of Pakistan Zardari should step down and face courts, It will be in his own interest, it will be in the interest of his party and it will be good for the system!

افسوس کہ من حیث القوم ہم ابھی تک بالغ نظر کہلانے کے حقدار نہیں ہیں ۔ ہماری ذہنی سطح اس حد سے اوپر تو اٹھ ہی نہیں رہی کہ جو شخص سپریم کورٹ کے فیصلے کی تائید کرتا ہے اسے ہم زرداری کا دشمن قرار دیتے ہیں ۔ جو شخص سپریم کورٹ کے فیصلے پر تنقید کرتا ہے اسے زرداری کا چمچہ قرار دیا جاتا ہے
اب اس ذہنی نابالغی کا کیا علاج جو مجموعی طور پر ہماری ملکی اور قومی عدم بلوغت کا غماز ہے ۔ یہ صورت حال تو ان ذہنی نابالغوں کی ہے جو بدنیت ہر گز نہیں ہیں بلکہ حالات و واقعات کو دیکھتے ہی اسی طرح سے ہیں اور اسی طرح بیان کر دیتے ہیں ۔
دوسرا رویہ ُاس طبقے کا ہے جو “سمجھدار،، اور “پڑھا لکھا،، گردانا جاتا ہے ۔ اس طبقے کے لوگوں کا طرز عمل یہ ہے کہ وہ حق و باطل کی پہچان تو رکھتے ہیں لیکن کوئی جھوٹ اگر ان کے مفادات کا تحفظ کرتا ہے تو یہ جانتے بوجھتے ہوئے اس جھوٹ کو سچ قرار دیں گے اور اگر کوئی سچ ان کے مقاصد کی راہ میں رکاوٹ ہے تو اسے جھوٹ قرار دینے میں کوئی ندامت محسوس نہیں کریں گے – اسے منافقت کہتے ہیں ۔ گویا من حیث القوم ہماری دو خصوصیات ہیں ، ذہنی عدم بلوغت اور منافقت
عاصمہ جیلانی جیسے لوگ اس نابالغ اور منافق معاشرے کے اندھیروں میں روشنی کے مینار ہیں – آنے والی نسلیں ایسے لوگوں پر فخر کیا کریں گی کہ چار سو پھیلی جھوٹ اور جہالت کی تاریکیوں میں ان گنے چنے لوگوں نے سچائی اور علم و آگہی کی شمع روشن کیئے رکھی کہ جس کی بدولت ہم مکمل طور پر اپنی بینائی کھو دینے سے تو بچے رہے ۔
ہمارے ذہنی نابالغ اس گہری حقیقت تک پہنچ ہی نہیں سکتے کہ آج کی دہشت گردی کے ڈانڈے قرار داد مقاصد کی منظوری سے کیسے ملتے ہیں ؟ لیکن ہمارے دین و ایمان کے وہ محافظ اور ٹھیکیدار جنہوں نے یہ سارا کھیل کھیلا وہ اس کے مضمرات سے ضرور آگاہ ہیں – یہ کھیل انتہائی مکاری کے ساتھ مرحلہ وار کھیلا گیا ۔ لیاقت علی خان کے زمانے میں قرار داد مقاصد منظور کرائی گئی – بس جی یہ تو صرف ایک قرار داد ہے ، اس کے منظور کرنے سے کیا فرق پڑتا ہے ، ملک کا اسلامی تشخص واضح ہو جائے گا، “ملک دشمن عناصر،، اور“اسلام کے دشمنوں،، کو منہ توڑجاب مل جائےگا جو یہ کہتے ہیں کہ قائداعظم پاکستان کو ایک جمہوری ، فلاحی ، سیکولر سٹیٹ بنانا چاہتے تھے ۔
بعد ازاں انیس سو چھپن میں چوہدری محمد علی کے ذریعے انہی رجعت پسندوں نے اسے آئین کا دیباچہ (پری ایمبل) بنوا دیا کہ جناب ، اسے محض پری ایمبل کے طور پر قبول کر لینے سے کیا فرق پڑتا ہے ؟
پھر دلیل و منطق ، علم و آگہی ، عقل و دانش اور ترقی پسندی کے تابوت میں آخری کیل مرد مومن مرد حق، جنرل ضیاءالحق کے ہاتھوں ٹھنکوا دیا اور اس نے اسے پری ایبمل سے اٹھا کر انیس سو تہتر کے متفقہ طور پر منظور شدہ آئیں کا حصہ بنا دیا – بظاہر سادہ اور سرسری نظر آنے والے ان اقدامات کا نتیجہ آج دہشت گردی ، انتہا پسندی ، عدم برداشت ، فرقہ واریت اور اسی نوع کی دیگر بیماریوں
کی صورت میں سامنے آ رہا ہے ۔
اب آئیے اس پوائنٹ کی جانب کہ سپریم کورٹ کے حالیہ فیصلے کا اس کہانی سے کیا تعلق ہے – تعلق اس طرح ہےکہ ذوالفقار علی بھٹو کو بظاہر سپریم کورٹ کے حکم پر ہی پھانسی دی گئی تھی لیکن آج انصاف کی دنیا میں بھٹو کیس کو عدالتی قتل (جوڈیشل مرڈر) کہا جاتا ہے ۔ جہاں تک مجھے یاد پڑتا ہے یہ اصطلاح سری لنکا کے اس وقت کے چیف جسٹس نے استعمال کی تھی ۔ بہر حال ، سپریم کورٹ کے اس فیصلے کی نطیر کسی بھی عدالت میں آج تک پیش نہیں کی گئی اس لیئے کہ منصفوں کی نظر میں اس فیصلے کی پیدائش کے عمل کو حلال نہیں بلکہ مشکوک سمجھا گیا ۔
میں کہنا یہ چاہتا ہوں کہ اس دور کے فاسق اعظم نے اسلام ، خدا ، رسول اور شریعت کے نام پر بلیک میلنگ کر کے اپنے مذموم ارادوں کو پورا کرنے کے لیئے جو کھیل کھیلے ان میں سے ایک یہ بھی ہے کہ انیس سو تہتر کے آئین میں اس نے آرٹیکل باسٹھ اور تریسٹھ کو گھسیڑ دیا ۔ عام مسلمانوں کو دھوکہ دینے کے لیئے اپنے نام نہاد ریفرینڈم کے الفاظ کی طرح ان آرٹیکز کو بھی اس نے خوبصورت لفظوں کا جامہ پہنایا ۔ یعنی قوم کے نمائیدوں کے لیئے صادق اور امین ہونے کی شرط رکھ دی گئی ۔ مقصد یہ تھا کہ عوام کے منتخب کردہ کسی شخص سے چھٹکارا پانا ہے تو اسے صادق اور امین کی خود ساختہ سولی پر لٹکا دیا جائے ۔ اور کوئی عدالت اس شخص کو صادق اور امین قرار نہ دے سکے جس کے پاس ضیاءالحق کا سرٹیفکیٹ نہ ہو۔ مُلا جنت میں جانے کا سرٹیفکیٹ دے اور مرد مومن صادق اور امین ہونے کا
بھٹو کیس کی طرح ان آرٹیکلز کو بھی قانون اور انصاف کی نظروں میں اہمیت نہ ملی اور پاکستان کی تاریخ میں ایک بھی ایسا واقعہ نہیں ہے کہ عدالت نے کسی شخص کو ان آرٹیکز کی بنیاد پر صادق اور امین نہ سمجھتے ہوئے نا اہل قرار دیا ہو ۔ سابق گورنر پنجاب اور سپریم کورٹ کے موجودہ چیف جسٹس افتخار چوہدری کےبھائی چوہدری الطاف نے کامیاب ہونے والے اپنے مخالف امیدوار راجہ افضل کے خلاف آرٹیکل باسٹھ کے تحت رٹ پٹیشن دائر کی جسے سپریم کورٹ نے مسترد کر دیا۔ چوہدری الطاف نے راجہ افضل کے خلاف شراب کا کاروبار کرنے اور دیگر خلاف شرع کاموں میں ملوث ہونے کے ثبوت عدالت میں پیش کیئے تھے لیکن سپریم کورٹ ان آرٹیکلز کی پیدائشی عمل کو جائز نہیں بلکہ بدنیتی پر محمول سمجھتی تھی لہذا پٹیشن مسترد کر دی گئی ۔
جیسا کہ بیان کیا جا چکا ہے ان آرٹیکلز کو پاکستان کےآئین کی جائز اولاد نہ ہونے کے باعث کسی عدالت نے بھی در خور اعتنا نہیں سمجھا ۔ لیکن آج کی سپریم کورٹ نے این آر او کو کالعد م قرار دینے کے لیئے اسے آئین کی جن شقوں سے متصادم قرار دیا ہے ان میں آرٹیکل باسٹھ اور تریسٹھ کو بھی شامل کر دیا ہے ۔ اس طرح گویا سپریم کورٹ نے ایک بدنام زمانہ ڈکٹیٹرکے بدنیتی پر مبنی آرٹیکز کو بھی تقدس کی سند عطا کر دی اور انہیں ویلڈ قرار دے دیا ۔
آئیندہ کے لیئے ملک کی تمام عدالتیں ان آرٹیکلز کو آئین کا لیجیٹمیٹ حصہ سمجھتے ہوئے لوگوں کے صادق اور امین ہونے کا فیصلہ دینے کی پابند ہوں گی ۔ اور ظاہر ہے کہ اس ضمن میں سپریم کورٹ آخری اتھارٹی ہو گی ۔ گویا پہلے مُلا جنت کا سرٹیفکیٹ دیا تھا اور امیرالؤمنین صادق اور امین ہونے کا اور اب یہ کام مُلا اور سپریم کورٹ کیا کریں گے ۔ ضیاء کے زمانے میں سپریم کورٹ نے امیرالؤمنین کی خواہش کے برعکس نہ کوئی فیصلہ دیا ، نہ دینا تھا ۔ بھٹو قتل کی مثال کے علاوہ مرد مومن کے صاحبزادے اعجازالحق کا بیان ریکارڈ پر ہے کہ اگرمیرا باپ زندہ ہوتا تو میں دیکھتا کہ سپریم کورٹ اس کے خلاف کیسے فیصلہ کرتی ہے ۔
تو جناب جو سفر قرار داد مقاصد کے منظور ہونے سے شروع ہو کراس کے پری ایمبل اور آئین کا حصہ بننے اور آرٹیکلز باسٹھ اور تریسٹھ کے نفاذ تک پہنچا تھا ، اس نے اپنا اگلا مرحلہ سپریم کورٹ سے حلال زدگی (لیجیٹمیسی) کا سرٹیفکیٹ لے کر طے کر لیا ہے ۔ اور اس کے منطقی نتائج جلد یا بدیر ظاہر ہو کر رہیں گے تا آنکہ انیس سو تہتر کے آئین کو اس کی اصلی حالت میں بحال کرکے تمام تر خرافات سے چھٹکارا نہیں پایا جاتا -
آخر میں ایک بات بر سبیل تذکرہ (بائی دی وے)عرض کرتا چلوں ۔ سترہ ججوں کے علاوہ شاید کوئی شخص بھی یہ نہیں کہہ سکتا کہ فیصلہ لکھنے کے دوران کس کس جج نے کیا کیا رائے دی – عین ممکن ہے کہ کوئی جج ریٹائرمینٹ کے بعد اپنی سوانح لکھتے ہوئے بعض امور کا انکشاف کردے یا کسی وقت سپریم کورٹ کے اس ریکارڈ کو کسی قانون کے تحت پبلک کے لیئے عام کر دیا جائے ۔ تاہم اگر پہیلی کے طور پر مجھ سے پوچھا جائے کہ جب این آراو کو صرف آرٹیکل پچیس کے تحت تحلیل کیا جا سکتا تھا تو پھر یہ آرٹیکل باسٹھ اور تریسٹھ کی درفنطنی کس ذرخیز ذہن کی پیدوار ہو سکتی ہے تو میرے سامنے جسٹس خلیل رمدے کے علاوہ اور کوئی نام نہیں آسکتا اس لیئے کہ ان کے علاوہ مجھے اور کوئی ایسا جج نظر نہیں آتا جس کے اندر ضیاءالحق کی روح اتنی شدت سے حلول کر چکی ہو ۔
شاید یہی وجہ ہو کہ قرار داد مقاصد سے لیکر سپریم کورٹ کے حالیہ فیصلے تک جو روح کام دکھا رہی ہے اسی روح کی طاقت رمدے صاحب کی ریٹائرمینٹ کے بعد سپریم کورٹ میں ان کی بطور ایڈہاک جج تعیناتی کے لیئے چیف جسٹس صاحب کو تحریک کر رہی ہو کہ شاید ابھی رمدے صاحب سے لیا جانے والا کوئی ادھورا رہ گیا ہو
“And Justice for all” should be basic rule for all the Pakistani. No one is above the law. It is very shamefull when Aitazaz Ahsan defends an corrupt person and his friends. It clearly shows that he is also part of them. He was with CJ only for point scoring.

گذشتہ رات ناظم آباد کی مجاہد کالونی میں دو موٹر سائیکلوں پر سوار چار افراد آئے، گولیوں کی بوچھاڑ کی، چار انسانوں کو موت کے گھاٹ اتارا اور چل دیئے۔ ایک مرنے سے بچ گیا تھا لیکن وہ بھی اسپتال پہنچ کر چل بسا۔ ملزمان حسب معمول نامعلوم ہیں۔ جانے نہ جانے گل ہی نہ جانے باغ تو سارا جانے ہے۔ آئی جی صاحب انتہائی محتاط رہ کر بھی دو سیاسی گروہوں کی محاذ آرائی کی جانب اشارہ کرچکے ہیں۔ بات صرف رکشہ اسٹینڈ پر بیٹھے پانچ افراد کے قتل پر ختم نہیں ہوئی۔ ایک گولی اپنے گھر کی بالکونی میں کھڑے نوجوان کو بھی نگل گئی۔ اہل خانہ اپنے پیارے کو جگانے آئے تو ہنستے بولتے انسان کی جگہ بستر پر لاش پڑی تھی۔
وفاقی وزیر داخلہ رحمٰن ملک نے حسب معمول نوٹس لے لیا ہے جبکہ وزیر اعظم ایک دن پہلے نوٹس لے چکے ہیں۔ کراچی میں اتحادی جماعتوں کا اجلاس ہوچکا ہے۔ ان سب کا نقد نتیجہ سب کے سامنے ہے۔ گذشتہ ماہ بھی شہر میں تقریبا چالیس افراد قتل ہوئے تھے۔ اس کے بعد وفاقی وزیر داخلہ نے بہت سے وعدے کئے تھے لیکن شاید ان کے نزدیک بھی وہ وعدہ ہی کیا جو وفا ہوگیا۔

اس بات میں کسی کو شک نہیں کہ خدا کے بعد پاکستانی مسلح افواج پاکستان کا ایٹمی پروگرام پاکستان کی سلامتی کے ضامن ہیں. ہمارے دشمنوں نے ہمیں ہماری ایٹمی صلاحیت سے محروم کرنے کا تہیہ کر رکھا ہے. نائن الیون کے بہانے ہمارے گرد گھیرہ تنگ سے تنگ کیا جا رہا ہے. باہر سے براہ راست حملہ کرکے ہمیں ہماری ایٹمی صلاحیت سے محروم نہیں کیا جا سکتا کیونکہ اسمیں بہت بڑا رسک ہے. حیلوں بہانوں سے ہمارے ملک میں داخل ہو کر ہمیں اس صلاحیت سے محروم کرنے میں ناکامی کے بعد ہمیں اندرونی طور پر کمزور کرنے کا فیصلہ کیا گیا. سندھی، پنجابی، بلوچی اور پٹھان کو آپس میں لڑانے کی کوششیں شروع کی گئیں. فوج کا معاملات پر کنٹرول کمزور کرنے کے لیے این آر او کی ڈیل شروع کروائی گئی. این آر او کا بنیادی مقصد بینظر کو اقتدار میں لانا نہ تھا کیونکہ وہ تو وفاق کی علامت تھی اور اسکو بھرپور عوامی حمایت بھی حاصل تھی. اصل مقصد تو زرداری کو اقتدار میں لانا تھا. مقصد کے حصول کے لیے بینظر کو ڈیل کے بعد راستے سے ہٹایا گیا اور اپنی کرپشن کی وجہ سے مشہور آصف زرداری کو ایک جعلی وصیت کے بل بوتے پر پہلے بینظر کی پارٹی پر قابض کروایا گیا پھر ان سے پاکستان کھپے کا نعرہ فائر کروایا گیا (حالانکہ سندھ میں کوئی پاکستان نہ کھپے کا نعرہ نہیں لگا رہا تھا) اسکے بعد این آر او کے پل سے گزار کر ایوان صدر میں پہنچا کر آرٹیکل ٢٤٨ کی آہنی دیوار اسکے گرد کھڑی کر دی گئی. اب آصف زرداری کو سندھ کا بھوت بنا کر پیش کیا جائے گا اور پھر اسکو اقتدار سے نکال کر
اسلام آباد کے کوفے سے میں سندھ مدینے آیا ہوں
کا شور مچوایا جائے گا اور ذوالفقار مرزا جیسے اژدھے سندھ کے سادہ لوح لوگوں کے سامنے جاکر منہ سے صوبائیت کی آگ اگلیں گے پھر اسی زرداری سے ‘پاکستان نہ کھپے’ کا نعرہ بیک فائر کروایا جائے گا. جسکا عملی مظاہرہ ہم کچھ زور پہلے دیکھ چکے ہیں. اسطرح بھائیوں کو نہ صرف بھائیوں سے بلکہ اپنی ہی فوج سے لڑایا جائے گا اور یوں زرداری کی رخصتی کے ساتھ ہی گھر کی دیواریں گھرانے کا عمل تیز کر دیا جائے گا. جب گھر کی دیواریں گر جائیں گی تو دروازے گرا کر اس خزانے تک پہنچنے کی کوشش کی جائے گی جو ہر ایک کی آنکھوں میں کھٹک رہا ہے

What is the justification of article 248 in the light Islamic Sharia if we claim the constitution of Pakistan was structured on the Quranic values of Islam. My question to those who claim so. وہ آرٹیکل ٢٤٨ کی دیوار کے پیچھے چھپنے کی بات کرتے ہیں تو انہیں بتایا جاتا ہے کہ کانسٹیچیوشن دیوار ہی نہیں ایک فصیل ہے ۔
وہ آرٹیکل ٦٢ اور ٦٣ پر زرداری کے پورا اترنے کا سوال کرتے ہیں ۔ انہیں سپریم کورٹ کے فیصلے کی روشنی میں بتایا جاتا ہے کہ ہر اس شخص کو آئین کے ان آرٹیکلز پر پورا اترتا ہوا تصور کیا جائے گا جب تک عدالت فیصلہ نہ کر دے کہ کوئی شخص ان پر پورا نہیں اترتا ۔
زرداری فوبیا میں وہ شخص نہ صرف یہ اپنا توازن برقرار نہیں رکھ سکا بلکہ بہت سے سادہ لوگوں کی گمراہی کا باعث بن رہا ہے ۔

Nice show, the thing i did not understand that Aitazaz says that ‘President can only be unseated through Article 47 of the constitution, under which an impeachment motion will be moved in the joint session of the parliament. The President can be removed from the office after the joint session of the parliament passes the impeachment motion with two-third majority. Even if the court declares the President disqualification his fate will be decided by the parliament’. Which parliament is he talking about? Does he meant Rubber Stamp parliament?

There have been two very important cases in recent decades in front of the U.S. Supreme Court involving the exemption of a sitting president from judicial process when there was possible criminal or civil misconduct at issue. In both cases, the Court ruled that separation of powers required that a president not be able to escape the judiciary and be above the law.
The first of these cases was United States v. Nixon in 1974 in response to the Watergate break-in and subsequent cover up scandal. The second was Clinton v. Jones in 1997 where the issue involved the right of a sitting president to avoid civil liability for actions that were out of the realm of his official duties. Each case proved that the Court strongly believed in the checks and balances of the original U.S. Constitution.
In Nixon’s case, it was widely believed that he had a role in the break-in of the Democratic headquarters at Watergate and sanctioned illegal wiretapping. Once elected, he was also believed to be hiding evidence crucial to the prosecution of the seven defendants as this evidence would implicate himself. He attempted to use the right of executive privilege to circumvent the special prosecutor’s subpoena of documents relating to conversations about the cover-up of the break-in.
The opinion of the Court, led by Chief Justice Warren Burger, was unanimous in its decision Justice Rehnquist recused himself due to having served under Nixon in the Justice Department during Nixon’s first administration. The remaining eight justices limited executive privilege to areas that did not interfere with due process, in this case compelling the production of evidence necessary for a fair and complete trial of the seven defendants.

U.S. Supreme Court Decides Presidents Are Not Above the Law
In the Clinton case, a sitting president attempted to avoid a civil suit arising from alleged sexual misconduct prior to his presidency and during his tenure as the governor of Arkansas. President Clinton’s response to allegations brought by Paula Jones, a former state employee, was to invoke presidential immunity, the constitutional protection that frees a president from fear of civil suits arising from unpopular consequences resulting from the performance of his official duties. This immunity has been consistently deemed necessary for the president to function and make decisions without his proverbial hands being tied by the threat of civil suits.
While the lower federal court denied Clinton’s right to categorically avoid the suit and allowed discovery to continue, it postponed any possibility of trial until after he was to be out of office. On appeal, the Supreme Court was again unanimous in its decision that judicial process had equal power to the president and refused him both immunity from the suit and an unconstitutional delay of due process for the plaintiff.
At issue in both of these cases was whether the separation of powers built into the federal government by the Constitution gave equal weight to all three branches of government. The Courts, charged with interpretation of the law since the Marshall era, answered with a resounding yes. Both cases clearly showed that the President could not invoke executive privilege or presidential immunity in matters that had no bearing on national security or interests. In Nixon’s case, his refusal to submit evidence was viewed as an obstruction of justice; in Clinton’s case, his personal behavior outside of the realm of presidential duties were seen as giving him no allowance to avoid consequences. Both of these cases served to limit presidents ability to function as absolute powers that could operate in the dark and not answer to the courts as any other citizen would have to under similar circumstances.

He is talking neither about the ” Rubber Stamp Parliament” nor about the
”Independent Judiciary” . He is just talking about the Constitution , the same Constitution under he claimed that the Chief Justice of Supreme Court could not be removed by the Prime Minister or he President. He could only be removed through the Supreme Judicial Council.
In particular, it is being asked whether Article 248 of the Constitution grants immunity to the president from any criminal or civil legal proceedings. Is that really possible?
Sub-clause (2) of Article 248 stipulates: “No criminal proceedings whatsoever shall be instituted or continued against the President or a Governor in any court during his term of office.” Repetition of this on TV news channels by the president’s protectors establishes an impression of absolute presidential immunity. However, logic and common sense cannot accept the notion of a ruler enjoying absolute immunity from prosecution despite any crime “whatsoever,” and getting away scot-free. Say, if a president commits murder, would he not be liable? We need to adopt a more nuanced interpretation of Article 248 of the Constitution and explore more deeply the whole notion of executive immunity.
The concept of immunity is not unique to the Constitution of Pakistan; it is present in most of the democratic constitutions in one form or another. The constitution of the United States furnishes one good example, and there have been some informative deliberations on this topic by the US Courts.
The archaic concept of sovereign immunity provided absolute immunity for the monarch on the basis that “the king can do no wrong.” In a democracy, however, the president is no longer the symbol of sovereignty, which, instead, is deemed to rest in the people. And, in any event, the doctrine of sovereign immunity applies to limit governmental rather than personal liabilities.
This does not mean that in a democracy a president is not eligible to any immunity. In fact, the presidency is a unique office which enjoys the greatest immunity possible in a modern state. The supporters of absolute immunity for the president of Pakistan advance this cause on two grounds, which are nevertheless recognised in most other republics. First, the head of state needs to work without any distraction and fear of being sued in a court of law, which enables him to conduct effective governance. Second, the separation of powers between the organs of state requires the various branches, in particular the judiciary, to stop interfering in the affairs of the other branches.
Interestingly, the subject of presidential immunity in Pakistan has not previously been under serious consideration. However, a good case study in this regard would be the constitutional jurisprudence in the United States, which like us has a written constitution and where presidential immunity has been the subject matter of some notable cases where the US Supreme Court elaborated on this issue.
The earliest decision of the US Supreme Court is Mississippi vs. Johnson in 1867, in which Chief Justice Marshall placed the president “beyond the reach of judicial direction, either affirmative or restraining, in the exercise of his powers, whether constitutional or statutory, political or otherwise, save perhaps for what must be a small class of powers that are purely ministerial.”
Until 1974, this remained the established principle of absolute immunity and in 1974, in the case of Nixon vs. Fitzgerald, the Supreme Court elaborated further the concept of executive immunity. In this case, the president was sued in a civil suit and the US Supreme Court was asked to consider a claim by former president Richard Nixon that he enjoyed an absolute immunity from a former government employee’s suit for damages for his allegedly unlawful official conduct in office. The Court endorsed a rule of absolute immunity, concluding that such immunity is “a functionally mandated incident of the President’s unique office, rooted in the constitutional tradition of the separation of powers and supported by our history.”

کواس بکواس بکواس. اگر آپ این آر او کے اتنے ہی مخالف تھے تو پی ٹی وی کو جوائن کرتے وقت آنکھوں پر لالچ کی پتی کیوں چڑھ گئی تھی؟ پی ٹی وی پر کام کرنے کے پورے عرصے میں آپکو این آر او پر تقریریں کیوں یاد نہ تھیں. اسوقت زرداری آپکو حاجی نمازی اور دنیا کا سب سے پرہیزگار آدمی نظر آرہا تھا کیونکہ اس نے اسکو پی ٹی وی کے سب سے اونچے عہدے پر بٹھایا ھوا تھا لیکن چونکہ وہاں پی پی پی والوں نے آپکی ڈال نہ گلنے دی اور آپکو پی ٹی وی چھوڑنے پر مجبور کر دیا اور پی ٹی کی سے باہر نکلتے ہی زرداری آپکے لیے دنیا کا سب سے کرپٹ آدمی بن گیا صرف اس لیے کہ اس نے پی ٹی وی کے معاملات میں آپکی حمایت نہیں کی اور آپکو اس سونے کی مرغی سے ہاتھ دھونا پڑے. اس پورے عمل میں آپکو نواز شریف کہیں کرپٹ نظر نہیں آتے اور نہ ہی آپکو اسکے منہ پر لگے ہوئے تالے نظر آتے ہیں. آپ صرف اپنے اندر لگی ہوئی آگ نکال رھے ہیں اور ہر وقت اس محرومی کا رونا روتے ہیں جو پی ٹی وی چھڑنے سے آپکے اندر رچ بس گئی ھے. آپ جتنی مرضی تقریریں اور جتنے مرضی پروگرام کرلیں زرداری آپکی تقریروں سے جانے والا نہیں. زرداری کے مخالف بھی اس خبطی آدمی کی فضول باتیں سنکر تالیاں بجانے کی بجائے پاکستان میں جمہوریت کو فروغ دینے میں تعاون کریں. جمہوریت لولی لنگڑی ہی سہی کم از کم آمریت سے ہزار درجہ بہتر ھے. آج کرپٹ لوگ حکومت میں ہیں تو کل صاف ستھرے لوگ بھی آ جائیں گے. اگر آپ جمہوریت کر پختہ یقین رکھتے ہیں تو اس گاڑی کو جیسے بھی چلتی ھے چلنے دو ورنہ ایک اور بوٹوں والا آئے گا دس پندرہ سال ملک کا بیڑا غرق کرے گا اور اسکے بعد جمہوریت کا آغاز ایسے ہی کرپٹ لوگوں سے ہوگا. دس پندرہ سال ضائع کرنے کے بعد ہم پھر وہیں کھڑے ہونگے جہاں آج کھڑے ہیں. عقلمندی کا تقاضہ یہی ھے کہ جمہوریت کو چلنے دیں اور فضول لوگوں کی باتوں سے پرہیز کریں. ان لوگوں کے اپنے اپنے ایجنڈے ہیں اور انکا ملک و قوم سے کوئی تعلق نہیں ھے. آج پارلیمنٹ موجود ھے، آپکے نمایندے وہاں بیٹھے ہیں، آپکے نمایندے آپکے علاقوں کے رہنے والے ہیں آپ انکے گریباں پکڑ سکتے ہیں. کل فوجی بوٹ آگے تو کون آپکی سنے گا؟ وہ مشرف جس نے دس سال تک اس ملک کو لوٹا اس پر تنقید کیوں نہیں کی جاتی. اصل مجرم کو چھوڑ کر بیساکھیوں کے سہارے چلتی جمہوریت ہی کو کیوں نشانہ بنایا جا رہا ھے؟ کیا پھر کسی بوٹوں والے کو خوشآمدید کہنے کی تیاریاں کی جا رہی ہیں؟ سوچیے سوچیے اور ٹھنڈے دماغ سے سوچیے کہ کہیں آپکو دوبارہ ٹریپ تو نہیں کیا جا رہا. کہیں آپکو کسی فوجی کا استقبال کرنے کو تیار تو نہیں کیا جا رہا. این آر او قابل ااعترض ضرور ھے لیکن اسکو بہانہ بنا کر جمہوریت کی بساط نہیں لپیٹی جا سکتی. جو بھی کام کیا جائے قانون کی حدود میں رہ کر کیا جائے تو کسی کو اعتراض نہیں ہونا چاہئیے. انصار عباسی کی باتوں میں بہت وزن ھے لیکن ہر کام کو کرنے کا قانونی طریق کار ھے. پارلیمنٹ کو حق حاصل ھے کہ وہ کوئی قانون پاس کرے لیکن اگر کسی کو اعتراض ھے تو عدالتیں آزاد اور موجود ہیں. اسمیں کسی بحث میں الجھنے کی ضرورت ہی نہیں. کائرہ صاحب کے دلائل بھی مضبوط تھے لیکن ان کو بات پوری کرنے کا موقع ہی نہیں دیا گیا جو کہ سراسر زیادتی اور غیر مہذب طریقہ کار تھا. اور آخر میں ڈاکٹر صاحب آپ جس تماشا ” جمہوریت ” ختم کرنے کی اور پردہ گرنے کی بات کار رھے ہیں وہ انشاالله کبھی ختم نہیں ہوگی

اس چھوٹے سے قصبےمیں جہاں میں بچپن میں رہتا تھا مہر نام کا ایک تانگہ بان رہتا تھا۔

نےایک اونچے بانس پر مہر کا ایک پتلا لٹکایا اور پورے قصبے میں پھرنا شروع ہو گیا

میں نے چھٹی جماعت میں فارسی کا مضمون پڑھنا چاہا لیکن میرے استاد حبیب اللہ او ٹی کی مار بہت جلد ہی مجھے ڈراینگ کی کلاس میں لے گءی۔ یوں میرا
فارسی کا علم ان شعروں تک محدود رہا جو اردو کی کتاب میں در ج ہوتے تھے اور جن کی تشریح کے متعلق پرچوں میں سوال آتے تھے۔ لیکن کچھ شعر
یا مصرعے اس لیے یاد رہ گءے کہ وہ اس دور کی تحریروں میں بڑی کثرت سے ستعمال ہوتے تھے ۔ انہی میں سے ایک مصرع تھا

یہ مصرع اس وقت استعمال کیا جاتا جب کسی حاسد کی بے موقع اور بے وقعت مخالفت کا جواب دینا مقصود ہوتا۔
پورا شعرایک بار میرے ایک کلاس فیلو نے مجھے اس وقت سمجھا یا جب ہم کالج جانے کے لیے لمبے روٹ کی بس کا انتظار کر رہے تھے اور ایک لوکل
بس اڈے پر کھڑی تھی۔ان دنوں بسوں کے آرٹسٹوں کا ذوق بھی خاصا بلند ہوتا تھا اور وہ بسوں پر ’جلنے والے کا منہ کالا ’ یا ’کراس کر یا صبر کر’ جیسے
فقروں کی بجاءے خاصے علمی قسم کے شعر لکھا کرتے تھے ۔ اس لوکل بس پرایک تصویر بنی ہوءی تھی جس میں بہت سے کتے ایک ملنگ بابا پر بھونک
رہے تھے اور بابا بڑی ہی بے اعتناءی کے ساتھ کھڑے ہو ءے تھے۔ تصویر کے ساتھ ایک شعر لکھا ہوا تھا

میرے دوست نے مجھے اس شعر کا مطلب یوں سمجھایا کہ یہ عرفی کا شعر ہے جو ایران سے آکر ہندوستان میں آباد ہو گیا تھا۔اس شعر میں وہ خود سے
کہتا ہے کہ تمہیں رقیبوں کے شوروغل سے نہیں گھبرانا چاہہیے کیونکہ کتوں کے بھونکنے سے فقیروں کا رزق کم نہیں ہوتا۔ عرفی کے شعر والے کتے واقعی
ایسے ہوتے تھے کہ فقیران سے نہیں گھبراتے تھے۔ ان کتوں نے گاءوں کے تحفظ کی ذمہ داری لی ہوتی تھی اس لیے جیسے ہی کوءی اجنبی چہرہ دیکھتے
تھے تو اس پر بھونکنا شروع کر دیتے تھے ۔ تھوڑی دیر تک بھونکنا جاری رکھتے اور پھر اپنی دنیا میں مگن ہو جاتے۔ یوں اجنبی کو پتہ چل جاتا تھا کہ
اس کی نگرانی ہو رہی ہے اور لوگوں کو بھونکنے کی آواز سے اس بات کا علم ہوجاتا تھا کہ کوءی اجنبی گاءوں میں آیا ہے۔اس دور میں گاءوں میں کتوں کا
ایک اور استعما ل بھی ہوتا تھا۔ یہ وہ کتے تھے جو خاص طور پر پالے گءے ہوتے تھے۔جب گاوں والے شکار کا ارادہ کرتے تو ہانکے کا منصوبہ بناتے ۔
شکار والے دن ایک ٹولی ڈھول بجانے والوں اور کتوں کو لے کر جنگل کی طرف نکل جاتی ۔ ڈھول بجانے والے اور بھونکنے والے کتے ایک بڑے علاقے سے
گھیرا ڈالتے ہوءے شکار کو پریشان کرتے ہوءے ایک خاص سمت میں آنے پر مجبور کرتے ۔ آہستہ آہستہ گھیرا تنگ ہو جاتا اور کتے اور ڈھول والے شکار کو
اس علاقے کی طرف لے آتے جہاں بندوقوں والے کھڑے ہوتے اور شکار کو اپنی زد پر لے لیتے ۔
ڈاکٹر شاہد مسعود کا آٹھ نومبر کا پروگرام دیکھا ۔ این آر او کے بعد کی صورتحال پر ڈاکٹر صاحب اور شاہین صہباءی کچھ کنفیوزڈ تھے۔ سمجھ میں نہیں آرہا کہ
ان دونوں کا پچھلے کءی مہینوں کا شوروغل عرفی کے شعر والا شورتھا کہ ہانکے والا۔ اگر عرفی کے رقیبوں والا تھا تو کیا ڈاکٹر شاہد مسعود اور شاہین صہباءی
چپ ہو کر بیٹھ جاءیں گے ۔ اگر ہانکے والا تھا تو کیا شکار ایسی جگہ آچکا ہے جہاں بندوقوں والے اسے شکار کر لیں ؟ اگر شکار مقررہ جگہ نہیں پہنچا تو کیا
آنے والے دنوں میں ’آواز سگاں’ اور بلند ہو گی؟کیا بندوقوں والے شکار کی تاک میں ہی رہیں گے یا دن ڈھلنے پر گھر لوٹ جاءیں گے اورشکار کے اگلے موسم کا
انتظار کریں گے؟

How could so much money do so much harm? The first answer is simply that the Pakistani civilian government, with whom Bush signed his agreement, barely controls the Army and intelligence services — the very institutions meant to receive the bulk of U.S. funds. Until last year, the closest the Army came to accounting for its work was its annual budget submission: a single, bottom-line dollar figure that the government was constitutionally bound to approve. Even now, after a much-hailed move toward more oversight, the Army’s most recent annual budget submission was just two pages. And Pakistan’s Inter-Services Intelligence (ISI) — a powerful and independent military agency — is no better. Last year the Interior Ministry requested that it report to the government; the ISI declined the invitation.
Long before the Bush-Musharraf agreement, money from such unsupervised budgets had enabled the Army to become one of the richest and largest industrial, banking, and landowning bodies in Pakistan. The military formed its own networks of political patronage, co-opting existing political parties with threats and bribes. With the injection of the U.S. cash, this already prevalent military corruption was thrust into high gear. The extra money further discouraged the military and intelligence services from submitting to civilian control — a precondition for the country’s democratization.
Pakistan did not use the majority of the funds for the agreed objective of fighting terrorism. Instead, the money was looted and deposited in foreign banks by Musharraf cronies,now enjoying musics and indian pubs in UK…..etc. .

In recent by-elections, those who are targetted by bloggers and media have won most of the seats. THIS IS THE REALITY. One point the whole media is missing is that even if the president enjoys constitutional immunity from prosecution, shouldn’t the parliament impeach him if there is clear evidence of his Swiss accounts and corruption? Party is just a name, a dead entity. It is the members of that party which matters.
Well: It was the good characters of past who earned fames BUT what about the current
characters ?. These party members are Busy all the time..depositing

their faces with proof (say Ghamoriyat packed in 10 boxs on the TV) nation hate them.

Despite the immunity under article 248 of the constitution, Zardari should go to the court and clear his position, this is a chance he will not going to have it again.
Rule of law should be respected and justice should prevail, NRO was a ‘gift’ by the former dictators, but it is now the responsibility of the incumbent government to implement the Supreme Court verdict in its true spirit

Corruption is a result of not allowing the Democracy flourish in the country. The same Chief Justice who is heading the Supreme Court had given life to Mr. Pervaiz Musharaf in his judgment in 1999. He even went further by declaring in the verdict that this coup is according to the Islamic tenants. Now the majority is feeling some rat smell in this judgment because it is pointing all its fingers to one person called Zardari. I think a very Big Game is being played by the forces who have nothing to do with Democracy. People in Pakistan are waiting for some better sense to prevail other wise we might be heading towards some big disaster. If corruption is the only issue then All Heads are corrupt.
President Zardari has become the punching bag of Pakistan. The same old stinking rhetoric is being used pulling out his old history examples of corruption. All people see is what he did long time ago and give him no credit for what he did now. I am not well-versed with nitty gritties of Pakistan political system, but Zardari for sure is not the one to ruin the political system.
Zardari no longer has the moral authority and ground to head the federation,whether he will do so or chose to seek cover behind the cloak of immunity guaranteed to Presidents under the constitution is another question.

Arguments against Absolute Presidential Immunity
While many people believe in absolute presidential immunity, this issue has always been, and remains, contentious because there are also many who believe in the doctrine of limited presidential power and control in a nation.
Historically, presidential privilege has always conflicted with the doctrine of separate but equal distribution of powers amongst the legislative, judicial, and executive branches of government.
Those who believe in and support the doctrine of the separation of powers have argued that the powers of the legislative, judicial, and executive branches of a government constitutionally are separated but must remain coordinated and distributed equally amongst the three branches of government.
Anything short of this shall woefully amount to the abuse of power by a president. Advocates of limited presidential power and restricted privilege further argue that while the Constitution distributes and diffuses powers amongst the legislative, judicial, and executive branches of a nation’s government in order to better secure liberty and justice, it also commands coordination and interdependence amongst the three separate but equal branches of government for the purpose of equal justice and better governance.
The doctrine of separation of powers conflicts with the granting of absolute and unrestricted power to a president. Allowing a president to have absolute power could conflict with the provision of equal justice and human rights in any developed and developing society.
It could be a troubling and terrifying environment if unrestricted and unchecked powers were to be granted to a former or current president. Therefore, there must always be checks and balances on the powers of a president regardless of if he or she is a president of the Western World or in the troubled environment of Africa.
The president and other government officials are also subject to the same laws that apply to all citizens.
Since granting unlimited and unchecked powers to a president cannot be accounted for and sustained under the doctrine of the separation of powers, there is no precedent for such occurrence.
Some argue that to compel a current or former president to appear before a court to account for his or her unofficial and unlawful actions might appear to leave a nation and its executive branch of government without a president. However, it is the power and province of the courts to say what the law is.
Therefore, the legislative, judicial, and executive branches of a government must always act as checks and balances of a former or current president’s acts.
Anything short of this is equal to asking a nation, Western or African, to place its president above the rule of law, equal justice, and the respect for human rights. Please see Marbury v. Madison (1803), Baker v. Carr, Youngstown Sheet & Tube Co v. Sawyer, Article III, Sections, I and II, P15, and the Liberian Constitution Articles 65 and 66.

You need integrity specially in politics. Zartdari should not have entered into politics and stayed in the background as a temorary party leader grooming his son to take over at the appropriate time. But no, he could not resist the temptation to come in the front line. This was a mistake because he did not have a clean background and also carried a bag of worms, his companero spread across in several countries, holding more than one residence and equally considered corrupt. People in the country have gone bonkers becaus of foreign interventions and weak leadership.

For the pat 63 years, the story remains the same, the military juntas who come to power mostly with the help of the CIA, serve the interest of Americans more effectively than the welfare of the people of Pakistan. ذہنی عدم بلوغت اور منافقت

افسوس کہ من حیث القوم ہم ابھی تک بالغ نظر کہلانے کے حقدار نہیں ہیں ۔ ہماری ذہنی سطح اس حد سے اوپر تو اٹھ ہی نہیں رہی کہ جو شخص سپریم کورٹ کے فیصلے کی تائید کرتا ہے اسے ہم زرداری کا دشمن قرار دیتے ہیں ۔ جو شخص سپریم کورٹ کے فیصلے پر تنقید کرتا ہے اسے زرداری کا چمچہ قرار دیا جاتا ہے
اب اس ذہنی نابالغی کا کیا علاج جو مجموعی طور پر ہماری ملکی اور قومی عدم بلوغت کا غماز ہے ۔ یہ صورت حال تو ان ذہنی نابالغوں کی ہے جو بدنیت ہر گز نہیں ہیں بلکہ حالات و واقعات کو دیکھتے ہی اسی طرح سے ہیں اور اسی طرح بیان کر دیتے ہیں ۔
دوسرا رویہ ُاس طبقے کا ہے جو “سمجھدار،، اور “پڑھا لکھا،، گردانا جاتا ہے ۔ اس طبقے کے لوگوں کا طرز عمل یہ ہے کہ وہ حق و باطل کی پہچان تو رکھتے ہیں لیکن کوئی جھوٹ اگر ان کے مفادات کا تحفظ کرتا ہے تو یہ جانتے بوجھتے ہوئے اس جھوٹ کو سچ قرار دیں گے اور اگر کوئی سچ ان کے مقاصد کی راہ میں رکاوٹ ہے تو اسے جھوٹ قرار دینے میں کوئی ندامت محسوس نہیں کریں گے – اسے منافقت کہتے ہیں ۔ گویا من حیث القوم ہماری دو خصوصیات ہیں ، ذہنی عدم بلوغت اور منافقت
عاصمہ جیلانی جیسے لوگ اس نابالغ اور منافق معاشرے کے اندھیروں میں روشنی کے مینار ہیں – آنے والی نسلیں ایسے لوگوں پر فخر کیا کریں گی کہ چار سو پھیلی جھوٹ اور جہالت کی تاریکیوں میں ان گنے چنے لوگوں نے سچائی اور علم و آگہی کی شمع روشن کیئے رکھی کہ جس کی بدولت ہم مکمل طور پر اپنی بینائی کھو دینے سے تو بچے رہے ۔
ہمارے ذہنی نابالغ اس گہری حقیقت تک پہنچ ہی نہیں سکتے کہ آج کی دہشت گردی کے ڈانڈے قرار داد مقاصد کی منظوری سے کیسے ملتے ہیں ؟ لیکن ہمارے دین و ایمان کے وہ محافظ اور ٹھیکیدار جنہوں نے یہ سارا کھیل کھیلا وہ اس کے مضمرات سے ضرور آگاہ ہیں – یہ کھیل انتہائی مکاری کے ساتھ مرحلہ وار کھیلا گیا ۔ لیاقت علی خان کے زمانے میں قرار داد مقاصد منظور کرائی گئی – بس جی یہ تو صرف ایک قرار داد ہے ، اس کے منظور کرنے سے کیا فرق پڑتا ہے ، ملک کا اسلامی تشخص واضح ہو جائے گا، “ملک دشمن عناصر،، اور“اسلام کے دشمنوں،، کو منہ توڑجاب مل جائےگا جو یہ کہتے ہیں کہ قائداعظم پاکستان کو ایک جمہوری ، فلاحی ، سیکولر سٹیٹ بنانا چاہتے تھے ۔
بعد ازاں انیس سو چھپن میں چوہدری محمد علی کے ذریعے انہی رجعت پسندوں نے اسے آئین کا دیباچہ (پری ایمبل) بنوا دیا کہ جناب ، اسے محض پری ایمبل کے طور پر قبول کر لینے سے کیا فرق پڑتا ہے ؟
پھر دلیل و منطق ، علم و آگہی ، عقل و دانش اور ترقی پسندی کے تابوت میں آخری کیل مرد مومن مرد حق، جنرل ضیاءالحق کے ہاتھوں ٹھنکوا دیا اور اس نے اسے پری ایبمل سے اٹھا کر انیس سو تہتر کے متفقہ طور پر منظور شدہ آئیں کا حصہ بنا دیا – بظاہر سادہ اور سرسری نظر آنے والے ان اقدامات کا نتیجہ آج دہشت گردی ، انتہا پسندی ، عدم برداشت ، فرقہ واریت اور اسی نوع کی دیگر بیماریوں
کی صورت میں سامنے آ رہا ہے ۔
اب آئیے اس پوائنٹ کی جانب کہ سپریم کورٹ کے حالیہ فیصلے کا اس کہانی سے کیا تعلق ہے – تعلق اس طرح ہےکہ ذوالفقار علی بھٹو کو بظاہر سپریم کورٹ کے حکم پر ہی پھانسی دی گئی تھی لیکن آج انصاف کی دنیا میں بھٹو کیس کو عدالتی قتل (جوڈیشل مرڈر) کہا جاتا ہے ۔ جہاں تک مجھے یاد پڑتا ہے یہ اصطلاح سری لنکا کے اس وقت کے چیف جسٹس نے استعمال کی تھی ۔ بہر حال ، سپریم کورٹ کے اس فیصلے کی نطیر کسی بھی عدالت میں آج تک پیش نہیں کی گئی اس لیئے کہ منصفوں کی نظر میں اس فیصلے کی پیدائش کے عمل کو حلال نہیں بلکہ مشکوک سمجھا گیا ۔
میں کہنا یہ چاہتا ہوں کہ اس دور کے فاسق اعظم نے اسلام ، خدا ، رسول اور شریعت کے نام پر بلیک میلنگ کر کے اپنے مذموم ارادوں کو پورا کرنے کے لیئے جو کھیل کھیلے ان میں سے ایک یہ بھی ہے کہ انیس سو تہتر کے آئین میں اس نے آرٹیکل باسٹھ اور تریسٹھ کو گھسیڑ دیا ۔ عام مسلمانوں کو دھوکہ دینے کے لیئے اپنے نام نہاد ریفرینڈم کے الفاظ کی طرح ان آرٹیکز کو بھی اس نے خوبصورت لفظوں کا جامہ پہنایا ۔ یعنی قوم کے نمائیدوں کے لیئے صادق اور امین ہونے کی شرط رکھ دی گئی ۔ مقصد یہ تھا کہ عوام کے منتخب کردہ کسی شخص سے چھٹکارا پانا ہے تو اسے صادق اور امین کی خود ساختہ سولی پر لٹکا دیا جائے ۔ اور کوئی عدالت اس شخص کو صادق اور امین قرار نہ دے سکے جس کے پاس ضیاءالحق کا سرٹیفکیٹ نہ ہو۔ مُلا جنت میں جانے کا سرٹیفکیٹ دے اور مرد مومن صادق اور امین ہونے کا
بھٹو کیس کی طرح ان آرٹیکلز کو بھی قانون اور انصاف کی نظروں میں اہمیت نہ ملی اور پاکستان کی تاریخ میں ایک بھی ایسا واقعہ نہیں ہے کہ عدالت نے کسی شخص کو ان آرٹیکز کی بنیاد پر صادق اور امین نہ سمجھتے ہوئے نا اہل قرار دیا ہو ۔ سابق گورنر پنجاب اور سپریم کورٹ کے موجودہ چیف جسٹس افتخار چوہدری کےبھائی چوہدری الطاف نے کامیاب ہونے والے اپنے مخالف امیدوار راجہ افضل کے خلاف آرٹیکل باسٹھ کے تحت رٹ پٹیشن دائر کی جسے سپریم کورٹ نے مسترد کر دیا۔ چوہدری الطاف نے راجہ افضل کے خلاف شراب کا کاروبار کرنے اور دیگر خلاف شرع کاموں میں ملوث ہونے کے ثبوت عدالت میں پیش کیئے تھے لیکن سپریم کورٹ ان آرٹیکلز کی پیدائشی عمل کو جائز نہیں بلکہ بدنیتی پر محمول سمجھتی تھی لہذا پٹیشن مسترد کر دی گئی ۔
جیسا کہ بیان کیا جا چکا ہے ان آرٹیکلز کو پاکستان کےآئین کی جائز اولاد نہ ہونے کے باعث کسی عدالت نے بھی در خور اعتنا نہیں سمجھا ۔ لیکن آج کی سپریم کورٹ نے این آر او کو کالعد م قرار دینے کے لیئے اسے آئین کی جن شقوں سے متصادم قرار دیا ہے ان میں آرٹیکل باسٹھ اور تریسٹھ کو بھی شامل کر دیا ہے ۔ اس طرح گویا سپریم کورٹ نے ایک بدنام زمانہ ڈکٹیٹرکے بدنیتی پر مبنی آرٹیکز کو بھی تقدس کی سند عطا کر دی اور انہیں ویلڈ قرار دے دیا ۔
آئیندہ کے لیئے ملک کی تمام عدالتیں ان آرٹیکلز کو آئین کا لیجیٹمیٹ حصہ سمجھتے ہوئے لوگوں کے صادق اور امین ہونے کا فیصلہ دینے کی پابند ہوں گی ۔ اور ظاہر ہے کہ اس ضمن میں سپریم کورٹ آخری اتھارٹی ہو گی ۔ گویا پہلے مُلا جنت کا سرٹیفکیٹ دیا تھا اور امیرالؤمنین صادق اور امین ہونے کا اور اب یہ کام مُلا اور سپریم کورٹ کیا کریں گے ۔ ضیاء کے زمانے میں سپریم کورٹ نے امیرالؤمنین کی خواہش کے برعکس نہ کوئی فیصلہ دیا ، نہ دینا تھا ۔ بھٹو قتل کی مثال کے علاوہ مرد مومن کے صاحبزادے اعجازالحق کا بیان ریکارڈ پر ہے کہ اگرمیرا باپ زندہ ہوتا تو میں دیکھتا کہ سپریم کورٹ اس کے خلاف کیسے فیصلہ کرتی ہے ۔
تو جناب جو سفر قرار داد مقاصد کے منظور ہونے سے شروع ہو کراس کے پری ایمبل اور آئین کا حصہ بننے اور آرٹیکلز باسٹھ اور تریسٹھ کے نفاذ تک پہنچا تھا ، اس نے اپنا اگلا مرحلہ سپریم کورٹ سے حلال زدگی (لیجیٹمیسی) کا سرٹیفکیٹ لے کر طے کر لیا ہے ۔ اور اس کے منطقی نتائج جلد یا بدیر ظاہر ہو کر رہیں گے تا آنکہ انیس سو تہتر کے آئین کو اس کی اصلی حالت میں بحال کرکے تمام تر خرافات سے چھٹکارا نہیں پایا جاتا -
آخر میں ایک بات بر سبیل تذکرہ (بائی دی وے)عرض کرتا چلوں ۔ سترہ ججوں کے علاوہ شاید کوئی شخص بھی یہ نہیں کہہ سکتا کہ فیصلہ لکھنے کے دوران کس کس جج نے کیا کیا رائے دی – عین ممکن ہے کہ کوئی جج ریٹائرمینٹ کے بعد اپنی سوانح لکھتے ہوئے بعض امور کا انکشاف کردے یا کسی وقت سپریم کورٹ کے اس ریکارڈ کو کسی قانون کے تحت پبلک کے لیئے عام کر دیا جائے ۔ تاہم اگر پہیلی کے طور پر مجھ سے پوچھا جائے کہ جب این آراو کو صرف آرٹیکل پچیس کے تحت تحلیل کیا جا سکتا تھا تو پھر یہ آرٹیکل باسٹھ اور تریسٹھ کی درفنطنی کس ذرخیز ذہن کی پیدوار ہو سکتی ہے تو میرے سامنے جسٹس خلیل رمدے کے علاوہ اور کوئی نام نہیں آسکتا اس لیئے کہ ان کے علاوہ مجھے اور کوئی ایسا جج نظر نہیں آتا جس کے اندر ضیاءالحق کی روح اتنی شدت سے حلول کر چکی ہو ۔
شاید یہی وجہ ہو کہ قرار داد مقاصد سے لیکر سپریم کورٹ کے حالیہ فیصلے تک جو روح کام دکھا رہی ہے اسی روح کی طاقت رمدے صاحب کی ریٹائرمینٹ کے بعد سپریم کورٹ میں ان کی بطور ایڈہاک جج تعیناتی کے لیئے چیف جسٹس صاحب کو تحریک کر رہی ہو کہ شاید ابھی رمدے صاحب سے لیا جانے والا کوئی ادھورا رہ گیا ہو
Democracy does not come easily, but it clearly needs strong leadership. Chaos seems to be the current stand in Pakistan.
“And Justice for all” should be basic rule for all the Pakistani. No one is above the law. It is very shamefull when Aitazaz Ahsan defends an corrupt person and his friends. It clearly shows that he is also part of them. He was with CJ only for point scoring.
Democarcy does not mean the rule of corrupt and incompetent peoples. Getting the vote on gun point and by buying vote is not democracy.
Corruption has increased since this govt. has come into power because lesson people have learnt is do maximum corruption to gain highest post. This is what zardari is doing. They claim he has indemnity and you can’t do his accountability when his tenure will finish they will cry this is political victimisation.

گذشتہ رات ناظم آباد کی مجاہد کالونی میں دو موٹر سائیکلوں پر سوار چار افراد آئے، گولیوں کی بوچھاڑ کی، چار انسانوں کو موت کے گھاٹ اتارا اور چل دیئے۔ ایک مرنے سے بچ گیا تھا لیکن وہ بھی اسپتال پہنچ کر چل بسا۔ ملزمان حسب معمول نامعلوم ہیں۔ جانے نہ جانے گل ہی نہ جانے باغ تو سارا جانے ہے۔ آئی جی صاحب انتہائی محتاط رہ کر بھی دو سیاسی گروہوں کی محاذ آرائی کی جانب اشارہ کرچکے ہیں۔ بات صرف رکشہ اسٹینڈ پر بیٹھے پانچ افراد کے قتل پر ختم نہیں ہوئی۔ ایک گولی اپنے گھر کی بالکونی میں کھڑے نوجوان کو بھی نگل گئی۔ اہل خانہ اپنے پیارے کو جگانے آئے تو ہنستے بولتے انسان کی جگہ بستر پر لاش پڑی تھی۔
وفاقی وزیر داخلہ رحمٰن ملک نے حسب معمول نوٹس لے لیا ہے جبکہ وزیر اعظم ایک دن پہلے نوٹس لے چکے ہیں۔ کراچی میں اتحادی جماعتوں کا اجلاس ہوچکا ہے۔ ان سب کا نقد نتیجہ سب کے سامنے ہے۔ گذشتہ ماہ بھی شہر میں تقریبا چالیس افراد قتل ہوئے تھے۔ اس کے بعد وفاقی وزیر داخلہ نے بہت سے وعدے کئے تھے لیکن شاید ان کے نزدیک بھی وہ وعدہ ہی کیا جو وفا ہوگیا۔

تھی جو وہ ایک تمثیل ماضی آخری منظر اسکا یہ تھا
پہلے ایک سایا سا نکل کہ گھر سے باہر آتا ہے
اسکے بعد کئی سایے سے اسکو رخصت کرتے ہیں
پھر دیواریں ڈھ جاتی ہیں دروازہ گر جاتا ہے
‘ایک سایہ گھر سے نکل کر باہر آتا ہے اور پھر کئی سایے اسکو رخصت کرتے ہیں. اسکے بعد گھر کی دیواریں زمین بوس ہو جاتی ہیں دروازہ ٹوٹ کر گر جاتا ہے’
ان اشعار کو اگر ماضی کے واقعات کے ملا کر پارہا جائے تو سارا گیم پلان واضح ہو جاتا ہے.
اس بات میں کسی کو شک نہیں کہ خدا کے بعد پاکستانی مسلح افواج پاکستان کا ایٹمی پروگرام پاکستان کی سلامتی کے ضامن ہیں. ہمارے دشمنوں نے ہمیں ہماری ایٹمی صلاحیت سے محروم کرنے کا تہیہ کر رکھا ہے. نائن الیون کے بہانے ہمارے گرد گھیرہ تنگ سے تنگ کیا جا رہا ہے. باہر سے براہ راست حملہ کرکے ہمیں ہماری ایٹمی صلاحیت سے محروم نہیں کیا جا سکتا کیونکہ اسمیں بہت بڑا رسک ہے. حیلوں بہانوں سے ہمارے ملک میں داخل ہو کر ہمیں اس صلاحیت سے محروم کرنے میں ناکامی کے بعد ہمیں اندرونی طور پر کمزور کرنے کا فیصلہ کیا گیا. سندھی، پنجابی، بلوچی اور پٹھان کو آپس میں لڑانے کی کوششیں شروع کی گئیں. فوج کا معاملات پر کنٹرول کمزور کرنے کے لیے این آر او کی ڈیل شروع کروائی گئی. این آر او کا بنیادی مقصد بینظر کو اقتدار میں لانا نہ تھا کیونکہ وہ تو وفاق کی علامت تھی اور اسکو بھرپور عوامی حمایت بھی حاصل تھی. اصل مقصد تو زرداری کو اقتدار میں لانا تھا. مقصد کے حصول کے لیے بینظر کو ڈیل کے بعد راستے سے ہٹایا گیا اور اپنی کرپشن کی وجہ سے مشہور آصف زرداری کو ایک جعلی وصیت کے بل بوتے پر پہلے بینظر کی پارٹی پر قابض کروایا گیا پھر ان سے پاکستان کھپے کا نعرہ فائر کروایا گیا (حالانکہ سندھ میں کوئی پاکستان نہ کھپے کا نعرہ نہیں لگا رہا تھا) اسکے بعد این آر او کے پل سے گزار کر ایوان صدر میں پہنچا کر آرٹیکل ٢٤٨ کی آہنی دیوار اسکے گرد کھڑی کر دی گئی. اب آصف زرداری کو سندھ کا بھوت بنا کر پیش کیا جائے گا اور پھر اسکو اقتدار سے نکال کر

کا شور مچوایا جائے گا اور ذوالفقار مرزا جیسے اژدھے سندھ کے سادہ لوح لوگوں کے سامنے جاکر منہ سے صوبائیت کی آگ اگلیں گے پھر اسی زرداری سے ‘پاکستان نہ کھپے’ کا نعرہ بیک فائر کروایا جائے گا. جسکا عملی مظاہرہ ہم کچھ زور پہلے دیکھ چکے ہیں. اسطرح بھائیوں کو نہ صرف بھائیوں سے بلکہ اپنی ہی فوج سے لڑایا جائے گا اور یوں زرداری کی رخصتی کے ساتھ ہی گھر کی دیواریں گھرانے کا عمل تیز کر دیا جائے گا. جب گھر کی دیواریں گر جائیں گی تو دروازے گرا کر اس خزانے تک پہنچنے کی کوشش کی جائے گی جو ہر ایک کی آنکھوں میں کھٹک رہا ہے
گیم پلان بنانے والے یاد رکھیں. یہ گھر اتنا خستہ حالت میں نہیں ہے جتنا انھوں سے اسے سمجھ رکھا ہے. یہ ملک خدا کے نام پر حاصل کیا گیا ہے اور وہ اسکی حفاظت کر رہا ہے. اس گھر کے سترہ کروڑ باسی اور اسکی مسلح افواج بھی اسکی حفاظت کرنا بخوبی جانتے ہیں. عوام کسی کو بد روح نکالنے کے بہانے اس گھر میں داخل ہونے اور اسکی دیواریں گرانے اور دروازے توڑ کر اپنے اساسوں تک پہنچنے کی ہرگز اجازت نہیں دیں گے. اس گھر کی طرف اٹھنے والی ہر آنکھ نکال دی جائے گی اور ہر ہاتھ کاٹ دیا جائے گا. عوام کو آپس میں یا اپنی فوج سے لڑانے کی ہر کوشش ناکام بنا دی جائے گی. ہم اپنے دوستوں اور دشمنوں کو خوب جانتے ہیں. زرداری کرپٹ ہے تو یہ ہمارا اندرونی معاملہ ہے. اس سے ہم اپنے قانون اور آئیں کے مطابق نپٹ لیں گے

What is the justification of article 248 in the light Islamic Sharia if we claim the constitution of Pakistan was structured on the Quranic values of Islam. My question to those who claim so. Does Islamic Sharia protect the position of a head of the state in case of corruption charges or any criminal or civil charges whatsoever? If it does not then Zardari should resign and face the charges otherwise we should stop calling the constitution of Islamic republic of Pakistan.

آصف زرداری کا کرپٹ ہونا یہ ثابت نہیں کرتا کہ شاہد مسعود کا رویہ درست ہے ۔
آپ شاہد مسعود کی ذہنی حالت مالاحظہ فرمائیں ، کیا اسے فوبیا لاحق نہیں ہو گیا ۔
یہ اپنے ذاتی بغض کے باعث اس قدر ذہنی عدم توازن کا شکار ہو چکا ہے کہ :
ملک کے نامور قانون دان ، جن کا علم ، تجربہ اور کنڈکٹ شک وشبہ سے بالا تر ہے انہیں بھی چاہیئے کہ وہ ڈاکٹر صاحب کے پاس آکر آئین اور قانون کو سمجھنے کا ٹیکہ لگوائیں ۔
وہ اس قدر متقی اور پرہیز گار اور بزرگی کے مقام پر فائز ہیں کہ لوگوں کو ان کے پاس آکر اخلاقی اقدار کا سبق لینا چاہیئے ۔
وہ مالی ، مالٹے ، چور اور درخت پر چڑھنے کی مثال دیتے ہیں لیکن بات نہیں بنتی ۔
وہ آرٹیکل ٢٤٨ کی دیوار کے پیچھے چھپنے کی بات کرتے ہیں تو انہیں بتایا جاتا ہے کہ کانسٹیچیوشن دیوار ہی نہیں ایک فصیل ہے ۔
وہ آرٹیکل ٦٢ اور ٦٣ پر زرداری کے پورا اترنے کا سوال کرتے ہیں ۔ انہیں سپریم کورٹ کے فیصلے کی روشنی میں بتایا جاتا ہے کہ ہر اس شخص کو آئین کے ان آرٹیکلز پر پورا اترتا ہوا تصور کیا جائے گا جب تک عدالت فیصلہ نہ کر دے کہ کوئی شخص ان پر پورا نہیں اترتا ۔
زرداری فوبیا میں وہ شخص نہ صرف یہ اپنا توازن برقرار نہیں رکھ سکا بلکہ بہت سے سادہ لوگوں کی گمراہی کا باعث بن رہا ہے ۔

Why u always invite the govt. or pro govt peoples in ur programe?
Even a cheapest leader of any unpopuler party can come in ur programe but the true man can’t come there.
If incidently any true person comes but whenever he start speaking u never let him clear his point and always try to hide reality. Always u go for break or ur time going to finish when anything true comes but u give open time to govt. and pro.govt peoples to say any foolish.
This is the whole behavior of all media in every chanel thats why people’s interest and faith is falling from media.
