Zardari’s order suspended by 3 member bench of Supreme Court
President Asif Ali Zardari elevated Justice Khwaja Sharif as SC Judge and Justice Saqib Nisar as acting CJ of LHC through a notification against the recommendations of Chief Justice of Pakistan.
The Chief Justice of LHC, Justice Khwaja Sharif and Justice Saqib Nisar, the senior most LHC judge have refused to accept the decision of the President.
They made it clear that they will not go against the recommendation of Chief Justice of Supreme Court of Pakistan.
Talking to Geo News’ senior correspondent Abdul Qayum Siddiqui, Justice Saqib Nisar said he was invited to take oath as acting CJ of LHC on Sunday by Governor Salman Taseer, but he refused the invitation by saying: “The orders of Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry are binding for me and I will not take any step against the recommendation or instruction of the CJP.”

Saqib Nisar as Acting CJ of LHC through a notification. Interestingly this notification was issued on Saturday, just like Nov 3, 2007 martial law. President Asif Ali Zardari setting aside the summary of Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry Saturday appointed Chief Justice of Lahore High Court (LHC) Justice Khwaja Sharif as Supreme Court’s judge, Geo News reported.
Meanwhile, Justice Saqib Nisar, the senior most judge of LHC, has been appointed Acting Chief Justice of LHC. It is for the first time in the history of Pakistan that a senior judge has been appointed as the acting chief justice.
Notifications of the above appointments have been issued. However, the presidential spokesman has refused to confirm or reject the said appointments.
Earlier, there has been some tension between the government and the Judiciary over the issue of elevating Justice Khwaja Sharif as SC judge.

Senior Most Judge principle does NOT apply here and been decided in some case previously back in to 2002 according to a lawyer on Geo News at moment. He also said that the advice of CJ is binding on President who has not given any Valid reason for not accepting the recommendations of CJ.
This government is so scared after taking this stupid decision that no one is willing to talk to the media and justify why they took this decision.

So in judges appointment, CJ consultation is BINDING on president.

Bawa ji if the rule will be just seniority then second part of your posting wil be void. CJ will have nothing to do in appointments if seniority will be the only rule.

Chief Justice has the right to interpret Constitution not make it, and Iftikhar Chaudry is willing to accept one-half of the Al-Jihad Trust case but not the other half. The reaction by Supreme Court only shows that it only has lust for power, Justice Iftikhar is as much responsible for preserving this system lekin koi din nahi guzarta jiss din yeh biyan naan de. Yeh judge apna waqar kho chukay hain, Iftikhar Chaudary ne yeh saabit kerdiya hai kay woh hukoomat ke sabar ko aakhri hud tuk aazmayein ge kyunke unhein na iss nizaam se aaj dilchaspi hai na pehle thee. Yeh koi fauji hukoomat nahi ke jiss ko pehle jhatke mein teen saal ki khuli chhoot de di jaye aur jis ki jo mansha ho uss ke mutabiq judge lagaye jaaye.

you have asked the reasons that why CJ has recommended Saqib Nisar to go to Supreme court?
Reason is : Chief Justice is an administrative post (as a judge, he is equal to any other judge of the court). Right now Khawja Sharif is handing Lahoire high court with 20 available judges (total 50 seats) in v efficient manner.
If he is sent to Supreme court now on seniority principle, then in May, another seat will b vacant in Supreme court due to retiremen of Justice Ejaz Ch (from Punjab). In that case Justice Saqib Nisar will also be sen to Supreme court and Justice Khosa will becoem chief justice of lahore high court.
This 3 months assignment is of no use to jsutice saqib nisar and by the time he will start to grip the administrative post duties, he will be moved again and that is not good for smooth and effiicent working of the courts.

People who are saying here that establishment is playing again… but tell me if Governor Punjab is establishment who has voilated the constitution by holding the judges appointment summary for more than 2 months… and tell me if Preseident Zardari is establishment who has voilated constitution by holding SC judges for more than 30 days? there is no lame argument that agencies need more time to do background check of judges etc etc … so I think people are just making false crys by blaming establishment …. its the Zardari toola its left who is cutting the branch on which they are sitting on… and its zardari toola who is cutting their own legs with an axe

Zardari tolla wants to disregard the summary for appointment of 28 judges in Lahore High court by Justice Khawja Sharif. And they proved it right there today by sending the summary back to governer after todays notification.
They want to have their own Jiyala judges in judiciary. Business of people like Babar awan , lateef khota and others is under threat due to such independent judges.
about6 weeks ago, there was a news in express newspaper ( a short line at the end of story) where PPP injected this plan through Abbas Athar.
But Justice Saqib Nisar has ruined their plan.
