DAWN News: Lahore High Court bars extradition of Mullah Baradar

    Friday, 26 Feb, 2010
    --------------------------------------------------------
LAHORE: The Lahore High Court (LHC) on Friday prohibited the extradition of five Afghan Taliban leaders and summoned the provincial and federal governments on March 15.

The arrested militants include Mullah Abdul Ghani Baradar who is considered the right hand man of Afghan Taliban chief Mullah Mohammad Omar.

Other arrested Afghan Taliban included Mullah Saleem, Maulvi Kabeer, Mullah Mohammad and Ameer Muavia.

The five were arrested from Faisalabad and Karachi a few weeks ago.

On February 25, a petition was filed in the LHC by Khalid Khwaja against the arrest of the five Afghan Taliban leaders. Khwaja requested that the five not be deported to any foreign country.

The case was being heard by LHC Chief Justice Khwaja Sharif. — DawnNews

Yet these recent, out of the blue arrests come as a surprise.

Is this situation good or bad ?

DAWN News: ‘Nato tankers cause annual loss of Rs50bn’

    Thursday, 25 Feb, 2010
    --------------------------------------------------------

QUETTA: Federal Minister for Communications Arbab Alamgir Khan said on Wednesday that Nato containers and tankers had been causing a yearly loss of Rs50 billion to the National Highway Authority by damaging the road network in Balochistan.

“We have taken up the issue with the US government and Nato member countries and sought compensation for the loss caused by these tankers,” he told Dawn.

“About 100 Nato containers pass through Balochistan daily before entering Afghanistan via Chaman,” he said. The road between Port Qasim and Chaman had been damaged very badly, he added.

He said the tankers had also been causing traffic accidents, claiming many lives in the province.

Earlier, the minister told a press conference that development projects worth Rs70 billion were under way in Balochistan. The province had a 41 per cent share in NHA projects, he added.

Mr Khan said he had directed the authority to expedite work on Gwadar-Turbat-Hoshab road to link Gwadar port with other parts of the country.

He said his ministry had received 5,000 applications and deserving candidates would be given jobs under the Aghaz-i-Haqooq-i-Balochistan package very soon.

    -------------------------------------------------------------------

    (1) Is this acceptable loss for Pakistani people ?

    (2) When this Govt. continues to accept losses in the name of foreigners, then what is a loyal citizen to do ?

Mullah Ghani babrber has been arrested from khi according to reports. Just wondering , how LHC can intervene into that. Its not LHC jurisdiction.

  7. Assalam-o-Alaikum-Warahmat-ULLAH ALL,

A petition was filed by Mr. Khalid Khwaja in LHC regarding Mr. Baradar and others.

What court has the proper authority/jurisdiction in this regard ?

LHC jurisdiction is for punjab. Anything happening sindh doesn't fall in LHC jurisdiction.

  10. Assalam-o-Alaikum-Warahmat-ULLAH ALL,

I can think of plenty of reasons with which to file petitions in LHC to get custody of or stop transfers of people arrested in another province.

However, if this petition just needs to go into a higher court, I don't see any problems with that.

The end result would be the same.
