    Let's put a plug on the judicial activism. Most of the aforementioned cases are against the state. Who is the state right now? If there is a state it should facilitate in bringing the culprits to justice.

    But for the stability of the system one mafia will not touch the other. So, do not blame the apex court and hold on to your "bravo" until the PM take some real initiative.

    I respect the PM too ... this is not about AAZ or YRG but the respect for democracy and Pakistans elected representatives .... It is correct step for the future of democracy and civilian rule in Pakistan

    Lets say no to judicial activism, and no to military establishment and their evil nexus ... that has blocked any debate on their nefarious ambitions to undermine decmocracy, historically

    This whole issue is very unfortunate.

    I wish PCO judges were impartial and had taken up cases against all power brokers then everyone would have supported their initiatives and activism.

    LOL, totally forgot that frivolous case... what was that case for ...two bottles of red wine ... please Chief saab ... wth happened there ... a larger bench for that too ... lets have a roving inquiry ...call all the wineyard owners, wine producers and distributors ... big international conspiracy against the foundation of our state ... objectives resolution ...morality..etc etc etc

    @bsobaid ... for sure...had they been a just a wee bit less partisan ...they would have had everyones support...even the jialas... after all jialas will not support their party at the expense of Pakistan ... but all these cases are trumped up ...basis lost because of blatant prejudice ...this system of dark and selective justice cant prevail in Pakistan ...

    When the courts quote so many hadiths they should also mention the one where one of Quresh noble and rich woman Fatima is caught stealing and some of the ppl ask Holy Prophet (PBUH) to pardon her...and the Holy Prophet (PBUH) says that had it been even her daughter Fatima (RA) he wouldnt have spared her...the ppl, nations before you were destroyed because they were SELECTIVE in their judicial system... it is not exact but just the gist of the hadith..,

    Is it not what the case is today...selective dracanion justice for one set of people

    Long time ago I heard an ex-judge and a supporter of Ch. Iftickar that courts can not take on all power brokers at the same time. (Does this mean they have to start with the weakest??)
    How stupid is this logic?

    Indeed, this could only come from who talk about "chain of command" in judiciary.

    They did all even they confined these all ...... for four months .

    it is just not PPP who was at the recieving end..any civilian who showed spine...even Junejo after Ojhri camp and MNS after Kargill...they did mischief in both cases as well and made civilians pay the price...it is not the question of PPP alone rather all democratic forces...

    جو بھی آئین، قانون اور عدلیہ کے احکامات کی خلاف ورزی کرتا ہے اسے بلا لحاظ عہدہ الٹا لٹکا کر دوسروں کے لیے نشان عبرت بنانا چاہئیے

    تاکہ کل کوئی دوسرا ایسی جسارت کرنے کی جرات نہ کرے اور نہ ہی خود کو کسی کی قبر کے ٹرائل کے اور کسی استثنیٰ کے پیچھے چھپا سکے

    قانون اور آئین سے بلا تر کوئی بھی نہیں ہونا چاہئیے – قانون، آئین اور عدلیہ کے فیصلوں کا مذاق بہت ہو چکا ہے اور اب مزید کوئی گنجائش نہیں ہے

    اگر عدالت، حکومت، پارلیمنٹ، فوج یا کوئی اور ادارہ یا شخصیت قانون، آئین اور انصاف کے نفاذ کی رہ رکاوٹ بنتا ہے تو عوام کو اسے کرنل قذافی والے انجام تک پہچانے سے بالکل گریز نہیں کرنا چاہیے

    ہر صورت میں آئین، قانون اور انصاف کی بالا دستی قائم رکھنی چاہئیے – یہی ہمارے روشن مستقبل کی ضمانت ہے

    all above who are praising Gillani, do you all know that Gillani reached to this stage not because he have some moral stance against corruption or something like that, he is in the mess because he have through out his tenure have supported and protected the corrupt... doesn't matter which party they belong, if they are corrupt someway YRG protected them ! !bravo to all morally corrupt persons who are supporting him..

    عدالت جو بھی مجرم ہے اس کو سزا نہیں دے رہی بلکہ ایک سیاسی کھیل میں شریک ہو کر حکومت کو گرانے کی سازش کر رہی ہے ،میرے خیال ہے کے اگر کسی کو قانونی طور پر سزا دینے کی بات کی جائے تو کوئی بھی سیاستدان ،جنرل نہیں بچ سکتا ہے کیوں کے چھوٹا موٹا قانون سب ہی توڑتے ہیں

    What Mujrim??? the case have to reached the stage where anyone can be declared mujrim, wakeup and smell the coffee do not blindly believe everything these politicians has to say...

    All SC asked is to write a letter to re-open the case closed under NRO, once NRO is null and void, this is logical conclusion, why govt headed by YRG is not following this simple order, the matter of immunity to the president comes later...

    But YRG who have sworn to protect all the culprits of corruption consider it blasphemy to not to protect the corrupts.. be it son of head of former qatil league or his own party members who have plunged billions in corruption..

    Now you support YRG means you support, Load-shedding, you support looting of poor in the name of different taxes and over-billing in the electricity bills, you support all the killing PPP+ANP+MQM have done in Karachi in last August and September where some 2000 people got killed just because YRG thought it is ok to have fun...

    Jes tarah es Chief justice aur judiciary ne Nawaz Sharif aur Noon league ke khalaf cases, (including IJI case) ka hashar nashar kia ha. Government should not bring any further pending case in court. It will give chance to Noon league and other opponents to clean their crimes from this supreme court.

    This chief justice allowed appeal after 9 years and dismissed case against Nawaz Sharif. Most imprtant and funny thing is, that Iftikhar Ch. himself was in that bench which earlier gave punishment to Nawaz Sharif in hijacking case.

    This supreme court and judiciary is total politicized and they have only focus against PPP government,specially against Zardari. They don't care anybody else.

    I agree, SC is politicised or at least perceived as such. This is why I always said that Ch. Iftikhar and co. should have resigned after they were reinstated.

    laikin bangladesh model aur kachchee raseedoo kay aadi CJ se aisee expectation karnaa fazool hai.

    I think this circus will continue until CJ retires.

    The post-CJ court will be in a better position to functional impartially.

    This dude Gilani deserves a chittar of the size of Micheal Jordan smack on the middle of his head. I for one would have really stood up for an elected head of the government had he been clean, honest, incorruptible and had some scruples. But this dude Gilani, his wife and children have created new records in amassing looted wealth from NICL to Hajj scams. Where was his bravado when he went unannounced to a dinner reception of Judges to make up with CJ on the eve of the showdown on appointment of Saqib Nisar as Justice and elevation of CJ Lahore high court to SC? Where was his candor and finesse when he tried to push ISI under the purview of Interior Ministry and had to eat a stinking crow when caned on his backside by the army? Where was his shame when he granted extensions to Kiyani and Pasha despite both of them being one of the most inept and sell-out military officers in the history of Pakistan?

    I know people would retort that all of the above was done by Zardari and Gilani was just paying lip service. I say that good on him for being such a humble serf of his master cause he is now gonna pay for his hood winking and carpetbagging.

    What is so amusing about it? Even Justice Nasim Hasan Shah has on record expressed his remorse on Bhutto's execution terming it to be a decision based on doctrine of necessity. If a Iftikhar Chaudhry undid his own decision from 2000 which was obviously flippant; what is wrong with it?

    سپریم کورٹ کی طرف سے وزیر اعظم کو توہین عدالت کا نوٹس جاری ہونے کے بعد جنرل ضیاء الحق کا کتا مجیب الرحمان شامی سما ٹی وی پر زور زور سے بھونک رہا تھا کہ وزیر اعظم کو عدالت طلب نہیں کر سکتی کیونکہ اسے استثنیٰ حاصل ہے، جب اسے بتایا گیا کہ نامور وکلا یہ رہے ہیں کہ توہین عدالت پر کسی کو استثنیٰ نہیں ہوتا تو اس نے بھونکتے بھونکتے فون بند کر دیا

    لگتا تھا سالے کو حکومت کی طرف سے تازہ تازہ لفافہ ملا ہے

    Funny thing is this, that, when Iftikhar Ch. was loyal with Musharaf and looking for chief justice post from Mushraf, then hijacking case true and Nawaz Sharif was guilty for this crime.

    But, when Mursharf dismissed him and Nawaz Sharif support him for restoration then same Hijacking case is fraud and Nawaz Sharif is innocent and he was allowed appeal after 9 years and dismissed case.
    That is insult for judicial system and justice, to allow anybody appeal after 9 years. It never happen in the history of justice, anywhere in the world.

    Bhutto case is different. It is not just Naseem hassan shah, most peoples in judicial system are believing that Bhutto case is shame in the history of justice. It was pre-planned decision against the spirit of justice.

    Nobody believe that Nawaz Sharif hijacking case is false. Everybody know that, Nawaz Sharif ordered, to not allow, to land Musharaf plane and forced him to stay in the air. This was attempt to kill army chief Musharaf or forced him to land in India.

    Against ISI

    بہت عرصہ سے میرا بھی یہی نقطہِ نظر رہا ہے کہ عدلیہ نے یہ جو انتظامیہ کا کردار ادا کرنا۔۔۔۔۔۔ ازخود اپنے آپ کو آئین کا محافظ قرار دینا اور لوگوں کا ایمانی ٹمپریچر ناپنا شروع کردیا ہے یہ آگے چل کر ہمارے لئے بہت مشکلات پیدا کرے گا۔۔۔۔۔۔۔۔
    دلچسپ بات یہ ہے کہ پارلیمنٹ کے ممبران جو کہ خود آئین بناتے ہیں اور آئین اور اس میں ترامیم کا اختیار رکھتے ہیں وہ ایک متفقہ طور پر ایک ترمیم منظور کرتے ہیں۔۔۔۔۔۔۔۔ کچھ حضرات اس ترمیم کے خلاف عدالت میں چلے جاتے ہیں اور عدالت ان کو سننا شروع کردیتی ہے۔۔۔۔۔۔۔۔ حیرت کی بات ہے کہ اب ہمارے جج یہ فیصلہ کریں گے کہ پارلیمنٹ کیا ترمیم کرسکتی ہے اور کیا نہیں۔۔۔۔۔۔۔۔ ججوں کو یہ اختیار آخر کس نے دیا ہے کہ وہ یہ فیصلہ کریں کہ پارلیمنٹ کیا قانون بناسکتی ہے اور کیا نہیں۔۔۔۔۔۔۔۔ اگر پاکستان کے عوام کی اکثریت اپنے نمائندوں کے ذریعے پاکستان کا نام بدل کر کچھ اور رکھنا چاہے یا قراردادِ مقاصد کو آئین میں سے نکالنے کی ترمیم کرنے لگے تو کیا عدالت یہ نہیں ہونے دے گی۔۔۔۔۔۔۔ دنیا کی کسی پارلیمنٹ میں ایسا نہیں ہوتا۔۔۔۔۔۔۔ پارلیمنٹ کو آئینی اور قانونی حق ہوتا ہے کہ وہ جو چاہے ترمیم کرے۔۔۔۔۔۔۔
    ابھی گیلانی صاحب کی تقریر میں ایک خاص بات یہ بھی تھی کہ انہوں نے کہا کہ پارلیمنٹ لامحدود اختیارات رکھتی ہے۔۔۔۔۔۔۔۔ وہ جو چاہے قانون بنائے اور آئین(ترمیم) بنا سکتی ہے۔۔۔۔۔۔۔۔ میرے نزدیک یہ انتہائی اہم نکتہ ہے اور آئندہ کے کچھ سالوں میں یہ ایشو اور زیادہ ابھر کر سامنے آتا رہے گا۔۔۔۔۔۔۔۔ ڈیڑھ سال پہلے ہمارے چیف جسٹس صاحب نے ایک کمال کی دُرفطنی چھوڑی تھی کہ پارلیمنٹ کو لامحدود اختیارات دینے سے ملک سیکولرازم کی طرف جا سکتا ہے۔۔۔۔۔۔۔ اب کوئی یہ پوچھے کہ ججوں کو یہ اختیار کس نے دے دیا کہ وہ یہ طے کریں گے کہ پارلیمنٹ کیا ترمیم کرسکتی ہے اور کیا نہیں۔۔۔۔۔۔۔
    عاصمہ جہانگیر صحیح کہتی ہے کہ سب کچھ عدالت ہی طے کرے گی تو پارلیمنٹ کو ختم کریں اور عدالت کو ہی سب کچھ سنبھال لینا چاہئے۔۔۔۔۔۔۔۔ اس وقت آپ کو ایک اور آخری دفعہ کیلئے یہ طے کرنا ہوگا کہ کس کے کیا اختیارات ہیں۔۔۔۔۔۔۔ کیا پارلیمنٹ سپریم ہے یا عدالت سپریم ہے۔۔۔۔۔۔۔ یہاں پر ایک نکتہ انتہائی قابلِ اہم ہے کہ پاکستان کی تاریخ میں ملٹری ہمیشہ بالادست رہی ہے لیکن آئینی اور قانونی طور پر وہ حکومت یا وزیرِاعظم کے ماتحت ہوتی ہے وہ ملٹری ٹیک اوور کر کے حکومت سنبھال لیتی ہے لیکن اس کی کوئی آئینی یا قانونی پوزیشن نہیں ہوتی جبکہ یہ جو عدالت اور حکومت کی بالادستی کا جو مسئلہ ہے یہ آئینی اور قانونی ہوچکا ہے۔۔۔۔۔۔۔۔ اگر آج عدالت کو نہ روکا گیا اور اگر اعلیٰ عدالت نے پارلیمنٹ کے اوپر اپنی بالادستی بنالی تو یہ عدالت کا آئینی اور قانونی حق اور مثال بن جائی گی کہ وہ سپریم ہے۔۔۔۔۔۔۔۔ اور پھر بات صرف افتخار چوہدری تک ہی محدود نہیں رہے گی یہ اب انسٹیٹیوشنل تھنکنگ(ادارہ کی سوچ) بن چکی ہے۔۔۔۔۔۔۔
    میرے خیال میں ہماری پارلیمنٹ کو اِس وقت سے ہی عدلیہ کو نکیل ڈالنی ہوگی اور ابھی سے یہ نہ ہوا تو جس طرح آج ملٹری اسٹیبلشمنٹ کو انتہائی مضبوط تصور کیا جاتا ہے بیس پچیس سال بعد لوگ عدلیہ کیلئے بھی کچھ ایسا ہی کہیں گے۔۔۔۔۔۔۔۔۔۔ اس کے علاوہ جوڈیشئل ایکٹوازم اور سوموٹو نوٹس پر پارلیمنٹ کو ایک چَیک رکھنا ہوگا ورنہ سویلین یونہی ذلیل و خوار ہوتے رہیں گے۔۔۔۔۔۔۔۔
    مجھے آج یاد آتا ہے کہ دو ہزار سات میں جب عدلیہ کی تحریک شروع ہوئی اور چیف جسٹس کی بحالی کے بعد عدلیہ نے ملکی سیاست میں ایک بھرپور کردار ادا کرنا شروع کردیا تو نذیر ناجی نے ایک بات کہی تھی کہ یہ سارا ڈرامہ عدلیہ کا روٹی میں سے اپنا حصہ آزادانہ طلب کرنا ہے۔۔۔۔۔۔۔۔ کیونکہ اس سے پہلے تو عدلیہ شروع سے ہی ملٹری کی بے دام غلام بنی رہی تھی۔۔۔۔۔۔۔ خیر اس وقت تو جذبات کے بہاؤ میں یہ بات دَب گئی لیکن آج اس جملہ کی سچائی بہت کھل کر سامنے آگئی ہے۔۔۔۔۔۔۔۔

    پسِ تحریر۔۔۔۔۔۔ ویسے میں نے اپنی تحریر میں عدلیہ کو ملٹری کی بے دام غلام لکھا ہے تو کیا مجھ پر بھی توہینِ عدالت کا مقدمہ بنتا ہے۔۔۔۔۔۔۔۔

    If CJ failed to put Zardari and Co in jail it will be very bad thing for Pakistan.

    We already have Shameless democracy; jaldi degree, jaldi votes choor President or PM. People of Pakistan must need to take stand against corruption... either start from political or army leadership...but look like in this War against corruption some people are more willing to protect political figures.

    when I used to watch hockey, I remember Pakistani players always wanted to make goals themselves and wont pass the ball to other players.

    I remember often center half wanted to go all the way to make goal instead of passing to forwards and forwards when got the ball would not want to pass it to other forwards.

    Lawyer's movement kay baad CJ sahab uar onn saathioo kaa dimaagh kharab hogaya thaa and they started thinking they can be an establishment in their own. This however can not and will not happen as they dont have the physical power (unlike bahadur afwaaj) to stage a coup. All they can do is pass judgements and hope media will rally enough support for them.

    This is all extremely flawed and unsustainable thinking.

    A center half's position is center of the field and his job is to ensure forwards receive the ball. If center halfs or defence dont like forwards for whatever reason then still should not start to play forwards. Laikin jiss kay haath mein thori bhi power aajatee hai oss kay dimagh mein yeh cheezein nahi aati.

    BTW, naji ne roti nahi cake mein hissa likha thaa.

    I am not sold out. so I always try to speak truth, does not matter, it is Musharaf, Imran, Zardari or anybody else.

    This is very open truth that this judiciary is totally partial and politicized and working against PPP and Zardari. Now they have support from Military establishment and ISI. It is shame for justice and rule of law.

    It became vry clear that this court has an agenda to keep the establishment strong.

    Not one case of an army general has been picked up by the court, all such cases are instantaneously dismissed, no suo moto notices are taken, no comments are made but here we have a bloody civilian Prime Minister so why did he dare disobey.

    PCO judges get a contempt of court notice but when someone questioned about serving the same to army officers in 3rd November case, the judges said stability is more important.

    But bravo, Prime Minister ko bulanay se tou stability ko barbad kernay qaabil e qubool hai

    It is very funny on the PCO Judges part

    Once they are asked about oath taking under PCO they say Parliment has endorsed their oath later through 18th Amendment.
    In this case They accept the Parliment to be supreme ..

    But when it comes to their own powers they express themselves above the Constitution.
