Congratulations, To CJ and PM for consultaton, and outcome,defusing tension.

  1. Most peoples ofthe pakistan will welcome this consulation process and outcome from this process, hope tension will be defused, and judiciary will work independent and neutral.

    We request to Noon league leadership and media, don't used judiciary for their politic and let judiciary work independent and neutral for all pakistan, we know Noon leauge and media played some role in judiciary restoration but it does not mean they own this judiciary. Please don't politicize this indpendent judiciary, and expect cases should be decided on merit, not to be rewarded for your restoration role.
    Noon league leadership should not use judiciary for political game and point scoring. let democracy and justice work in pakistan.
    And hope,Mr zardari will mercy on,PPP, Bhutto legacy and pakistan. He and his future genrations already benefited enough from his marriage with Benazir Bhutto. Politically she suffered too much from this marriage, perhaps this marriage created circumstances that she had to leave pakistan and then return with compromises and had to face critical situation which end her life.
    We hope he will be able to show some maturity if fortunately he is enjoying present status because husband of Benazir Bhutto and son in law of Mr Bhutto.

    It is the Govt. which needs to rejoice. In any case, the Judiciary would have won. Lawyers movement, JI, PTI, had already said they would come to streets. Govt. would have lost their rule. Mr. Zardari, Mr. Gilani took this step to save their rule.

    I think this issue is not solved. This has been put to rest for the time being.

    Fundamental question has not been addressed.

    a) Al-jehad trust case laid down the principle of seniority.

    b) SCBA case in 2002 ,(Khailid Ramday promotion case) , SC held that move from HC to SC is not promotion but fresh appointment and hence seniority rule doesn't apply. SCBA resented to decision and refused to accept it saying that it was a PCO court decision.

    c) Al-Jehad trust case held that consulation with CJ has to be meaningful and a binding on executive until executive can give specific reasons to overrule recommendations.

    NOw in this scenario , it seems that this judgement has given a new meaning as well.

    d) Another question is that , whether CJ is bound by any rules or guidelines while making his recommendation or its absolutely his sole discreation ?

    Like , in this very scenario , question arises

    a) Why Justice Sharif , who is going to retire in Dec anyways , shouldn't be promoted to SC ?
    i) Is he not capable of serving in SC ? If not why he is in LHC ?
    ii) LHC can't run without him ? What will happen after Dec when he retires ?

    b) Why Justice Saqib nisar should become CJ LHC ?
    i ) He is not capable of becoming CJ LHC ? then why he is a judge at all ?
    ii) and then why he should be moved to SC ?

    These important questions are still un-answered.

  5. There are definitely political calculations by both parties--CJ and the Executive-- in their actions. This is kind of turf war to control judiciary. For now, thanks to the leadership of CJ and solidarity of his brother judges and other forces with him, judiciary has been able to hold its ground.

    This is no ordinary feat. Judiciary has come a long way to assert itself. CJ deserves all the credit from the day he stood alone to Musharraf's arrogant adventure in March 2007. Political forces, Lawyer community, media and public at large did a commendable job in their march on this issue for the last three years. Army did its part under the leadership of Gen. Kiani for nudging the Govt. to reinstate the judges last year. Even the present Govt can be given some credit for reversing its recent self destructive and adventurous course of action.

    Executive will continue to push back but so far so good. Democracy seems to have started to finally work. We can all take a little pride in making a turn in a better direction.

  7. Democracy always work with dialoge, understanding, between the institutions and dialoge solve this issue. However you can give 100 piyaaz to zardari and 100 jutay to those peoples, whom were trying to use these small issue to bring judiciary against democratic ppp government but failed badly, as they did in past, on many issues.
