Elevation of Judges to SC

  1. Today , i read that two judges from sindh are being elevated to SC.

    I think, these are not the senior most judges of SHC which is a requirement under the guidelines laid down by SC in historic Al-Jehad Trust Case.

    Lets see , how our legal fertinitiy and press reacts to these appointments.

    I would appreciate if someone who has better knowlege of this historic judgement can throw some light on to this. Because, if so is the case then the whole movement for independent judiciary is gone.

  2. Just to add a bit more.

    Justice Rehmat Hussain Jaffery is an ex-judge of SHC . He got into prominence when he heard High Jacking Case Against Nawaz Sharif in 2000 and handed him a life imprisonment.

    Just Khilji is a sitting judge and on number 5 in official seniority list.

    A further search has comfirmed that in Al-Jehad Trust case , SC ruled that senior most judge from a high court should be elevated to SC. Now , its becoming mind boggling that why these two judges have been recommended by CJP and why the seniority rule has been ignored specially in case of Justice Khilji.

  4. Yaa. i want this scared cows action to be discussed:) All those who have been putting him as a champ of law , will get to know him very well.

    Another interesting aspect about Justice Rehmat Hussain Jaffery is that he handed NS life imprisonment instead of death punishment as required by ATA 1997 (framed by NS himself) which calls for maximum punishment to be awarded in case of a conviction. Probably he has been rewarded for this.

    Mush did the same thing

    NS and BB did the same thign

    so whats the issue

    The trend is being maintained

    I think it would be better if u go through the procedure of appointments of judges as laid down by SC in al-jehad trust case. It has nothing to do with being jiyala or not. Did u struggled only for restoration of CJP ? I think noo. U struggled for the supremecy of law and independent judiciary.

    If i remember correctly , NS and BB didn't do this. In fact , around 30 judges appointed by bb in 1996 were laid off by this al-jehad trust case and this case ultimately led to fall of ppp govt in 1996.

    Similary , NS didn't do such thing and infact the judicial crisis of 1997 which started with ATA of 1997 and ended with downfall of Sajjad Ali Shah also involved this controversy where NS was reluctant to escalation of CJ Lahore HIgh Court (I think Rashid Aziz Khan) but ultimately agreed to that as well.

    Yes , In Mush era this thing happened.

    But point is the appointment of judges is done by President of Pakistan on the recommendation of CJP and CJ of relevant high court and these recommendations are binding on executive until executive records a specific reason .

    My point is again that the whole 2 years of struggle which started with removal of CJP was only meant for restoration of one person's service. ?

  10. just wondering where all champs are who claimed that restoration of IMC will results in free judiciary .

    I did a bit of search on to that and found that when Justice Ramadaey , Faqir M Khokar and another were elevated to SC by Mush on advice of Arshad Hassan Khan and the elevation was challenged by Bar.

    Lets see what bar does this time .

  11. Free and independent judiciary has been an important issue for last 2 years or so and we have seen people on this forum who were ready to die for this cause.

    Just wondering why it has fallen back in priorities ?

  12. Now , i m getting frustated about the champs of Free Judiciary.

    Aur tu aur apni Beenai Bibi bi ghayab haain. Woh tu Free judiciary kii aaik azeem aawaz thii. AAwaz daaey kaahaan haai .
