Government is delaying appointment of Judges

  1. Assalam-o-Alaikum-Warahmat-ULLAH ALL,

    Has anyone noticed Govt. has delayed appointment of judges ?

    By law, it is noted that Judges must be appointed within 30 days. In case a Judge dies, the next judge must be appointed within 90 days (which is not the case here).

    This current Govt. has spent 60 days, which is well over the 30 days requirement by law of our land, in appointment of new judges.

    Judges are missing in at least a 100 positions divided over ALL four provinces of Pakistan.

    This is one way through which the current Govt. is delaying delivery of justice.

    This deed alone is enough to convict current Govt. officials for 'High Treason' according to Article 6 of the constitution of Pakistan. Everyone from President, to Prime Minister to LAW minister, to many others come under this decree.

    What do you, the common man of Pakistan think about it ?

    A case was already filed for Supreme Court to look into this matter;

    DAWN News: SC adjourns judges’ appointment case till Feb 18

    ISLAMABAD: The Supreme Court on Friday directed the government to submit a concise statement regarding the judges’ appointment issue on the case’s next hearing.

    The court adjourned the case until February 18, when the government will be required to submit its statement.

    The Supreme Court also issued notices to the Attorney-General and four Advocate-Generals.

    Advocate Akram Sheikh, the lawyer for the main petitioner, said that as the government had rejected the appointment of judges recommended by the Supreme Court, it was the people who were suffering as a result.

    Does that which is gong on in this nation make sense to the people of this nation ?

    How will the people see output of judicial system, when there are no judges to process the cases ?

    This is bad instance on the part of Government. In stead of gaining something, government will lose much more. It may backfire on Peoples Party to the extent that they may fall apart.

    There is nothing wrong with the system. The system is not flawed at all. The wrong is with the few individuals of a political party. If they take wise actions it will be in their own interest. Please try to have constructive approach towards the issue.

    identification of the root cause is a constructive approach, ignoring it by terming it as "few bad apples" is actually 'destructive' approach :)

    system has so many holes that allow these few individuals to manipulate as the way they like

    it is the failure of system that we have convicted people ruling over us. they don't pay the penalty, never, only poor masses end up paying for everything

    It is not the failure of system. With the passage of time, the system will get refined. Criminals will ultimately be brought to justice by the system. They will be forced to pay the penalty. Just relax and don't worry please.

    just relax and don't worry, you have already said this twice so shall i take it as you are not worried about current state of peoples of Pakistan?

    passage of time doesn't bring change, it is the will of the people, vision of the leaders and power of ideas that bring change. we got to learn from 60 years of failure and see what is the cause and cure to the problem.

    Yes, I am worried about the state people of Pakistan, but with the developments taking place in the present time, as compared to recent past, I feel a bit optimistic. Yes, will of people is there that will influence the vision of leaders in the system. We cannot afford to make another experiment, on the back of power of ideas, as we did in the past and lost 11 precious years plus huge troubles being faced yet today.

    good to see that you realize problem and are concerned about it. it would be naive to term zia's rule as 'another experiment' because it was 'same experience' as before, i hope you realize this fact.

    we are still a colony same as we were before 1947 only difference now is that before colonial masters used to reside locally while now they reside overseas :)

    And you wish to convert the so-called colony into an empire headed by obstinate illiterates even if the results are no different to what were witnessed when corpses of dead were scattered in the mountains with survived ones running to the same colony for shelter. No way my friend.

    My comment above is pretty clear if you are able to read and understand English and are literate. It was in no way addressed to you as you can never be the head of an empire. So why is this arrogance as usual?

    By the way, are you not trying to detrack your own thread so that later you may write a sentence like “Admin Mod please delete all the off topic comments even if these are my own”. Please try to be a balanced person.

    First you started to assume about zia as representative of islamic governance then you started to assume about a wish to turn a third world country in to an empire headed by illiterates?

    Well confusion is quite clear to me so let me clarify to you that zia never wanted an islamic state, he just fooled both seculars & islamists by editing british penal codes -lolzz

This is independent but politicize judiciary, Now it is united with that political parties, whom were helping to restore these judges, Now they are working on one agenda, to create this kind of situation, which make impossible for government to function and then bring Noon league in power, for this purpose,first they order government to open cases against president of pakistan.
    How it is possible for any political government to request other country government to prosecute it's own president? Supreume court ignore constitution of pakistan with bad intentions, president have Immunity under the constitution of pakistan.If Supreume court does not have power to order,to prosecute president inside pakistan,then how they can order government of pakistan to request other country to prosecute him outside pakistan. they clearly violated constitution of pakistan with political reasons and personal revenge, to destablize this system.
    Beside this they are trying to appoint judges,with one point priority, that these judges must be anti-ppp and must be loyal to chief justice and Noon league. That is why they want to keep justice Sharif in Lahore high court because Noon leauge can get more help and favor from Mr Sharif whenever they need. this is very very serious situation, pakistan can not afford this kind of political judges in big numbers for comming years,this is not one or two judges appointment, issue is for many dozen judges in high courts and Supreume court, if this kind of judges will be appointed then situation will be worse than dictatorship, and soon whole system will be destroyed.
    I will request government of pakistan that they must stop appointments of these political judges in any condition, till parliament pass alternative rules to appoint judges for high courts and supreume court, according to international democrative rules and regulations,but not with one personal choice.

    quite logical support for zardari but your post lacks evidence on accusations made on higher judiciary.

    how did you conclude that judges being picked are anti-ppp and pro-pml n or pro chief justice?

    zardari is a convict and an absconder but had protection under NRO enacted by general mushy, now that the cover is removed people find zardari 'naked' while his supporters trying to dress him up with indemnity cloak :)

    I hate to zardari as anybody else for his corruption, but nobody can voilate constitution for their personal revenge, against any person, does not matter it is corrupt zardari or any other person, specially cheif justice and supreume court can not act like this, if they really want rule of law then why they are focus only zardari , why not Nawaz sharif , why not other parties and their leaders, why not these pco judges face rule of law theirself for their passed unconstitutional acts and decisions during Murshraf rule. they want to enjoy illegal and unconstitutional immunity for their passed illgal acts but they do not want to give immunity to zardari which is written in constitution.

    i am sure that these judges are not zardari's favorite but labeling accusation without evidence is also not fair.

    zardari & co have already politicized this issue and if they had any evidence to substantiate this accusation they would have 'leaked' it to the media

    taseer owns a propaganda house he could have leaked these evidences as lead for other channels

    asking to wait and see means that accuser doesn't have any defense except his blind loyalty to a party

    ISLAMABAD: The Supreme Court on Saturday constituted a five-member bench to hear the case of delays in the judges’ appointments.

    The bench would be headed by Justice Shakirullah Jan. Justice Fiaz Raja, Justice Jawad S. Khwaja, Justice Rehmat Hussain Jafri and Justice Anwar Zahir Jamali will be part of the larger bench.

    The bench will hear the case on February 18 and 19.

    The delay in the judges’ appointments has become a sticking point, with the government claiming that no summary for the appointments has been received so far.

    On Friday, the Supreme Court directed the government to file a concise statement regarding its position in the case’s next hearing.
