Government of Pakistan declares war on Chief Justice of Pakistan

  1. Judge Saqib Nisar appointed Acting Chief Justice by President Zardari.
    'Government has declared an all out war on Chief Justice of Pakistan', Iftikhar Mohamed Choudry, is what is being reported by media right now as of 19:50 hrs Pakistan time.

    Chief Justice Lahore High Court Justice Khwaja Sharif and Justice Saqib Nisar, the senior most LHC judge, Saturday refused to accept the decision of the government.

    They made it clear that they will not go against the recommendation or instruction of Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry.

    CJ needs to decide, how he wants to proceed in this regard. I hope, his decision will be for rule of law, to uphold the law of the land, which will be in the best interest of this nation.

    I believe, he should hold meetings, with political parties who stand with the law of the land, rule of law, Supreme Court of Pakistan.

    Mr. Zardari has totally sidelined the law of the land. He should be given exemplary punishment for this treason by the Supreme Court of Pakistan.

Cheif justice already playing politic and already united with Noon league and others to play political role against government pakistan and ppp, that is why things are going this way, he want to keep Khawaja sharif in Lahore High court, to help Noon league and Nawaz sharif,(Khawaja sharif Noon league ka banda ha,us ne khud mana ha) there is no other reason to keep him in Lahore high court.

    Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry taking suo motto notice of judges’ appointment by President Asif Ali Zardari formed a 3-judge bench, Geo News reported Saturday.

    The 3-judge special bench headed by Justice Mian Shakirullah Jan comprises Justice Raja Fayaz and Justice Jawad S. Khwaja as its members.

Nobody can expect any better role from these pco judges,they violated constitution in pass to help Mr Mushraf to kee his dictatorial rule. they are playing dirty game, they can go further to destroy this system, but i am very clear with one thing, this political pco chief justice Iftikhar ch.can not be allowed to appoint big number of judges in high courts and supreume court on his own choice.that is too dangrous for future of pakistan, there should be any other democratic and constitutional solution to appoint these judges.

    ISLAMABAD: President Asif Zardari on Saturday elevated the chief justice of the Lahore High Court (LHC) Justice Khwaja Sharif as a judge of the Supreme Court. The decision was taken without any consultation with Chief Justice Iftikhar Chaudhry, prompting him to take a suo motu notice of the judges' appointment.

    On the other hand, senior judge Justice Saqib Nisar has been made the acting Chief Justice of the LHC in place of Justice Khwaja Sharif.

    The president's decision conflicted with the reported recommendations of Chief Justice Iftikhar Muhammad Chaudhary, who had recommended that Justice Saqib Nisar be made a judge of the Supreme Court.

    However, the government seems to have done the opposite as a result of which Chaudhry took a suo motu notice against the decision of the president, suspending the federal government's notification over the appointments.

    The notification was issued in violation of Article 177 of the state's constitution that prevents the president from appointing a supreme court judge without the consultation of the Chief Justice.

  20. Looks like much anticipated drama of clash between Judiciary and Executive has started. SC bench has set aside the presidential order that appointed Justice Shareef to SC. There is also rumor of imposing Emergency.
    Lets see how this story develops.

I heard many PPP Leaders nd Law experts today in news channels constantly defending the action of President considering it a legal action as according to them they had consulted CJ in writing by advising the names of these two judges so for them,this action is not the violation of article 177 of the Constituion...a bigger game is being played by Zardari and Co to malign the reputation of CJ Ifthikar Chaudry nd the verdicts of SC...i think PPP are gonna defend this action...

    nawaz sharif chooses this time to hit zardari, if mqm & fazlu also leave zardari then he would be political isolated and may find himself very weak & vulnerable :)

    @ zingaro and others, I just want to make one thing clear, I have met a number of PPP supporters today and all including me have supported the President's actions. Unlike the lawyers movement when the opinion was deeply divided and most people were against Zardari, there is a very solid support for him on the issue.

    Also, there are those like Barister Zafarullah, Kurd and Fakharuddin G Ibrahim who have said that the decision is right. So its not black and white as is being potraied by many and public opinion is far from unanimous.

    @skunk: Through your comment/statement, are you threatening public opinion divide, if the public doesn't abide by PPP's wishes, as you do ?

    PPP is going against the constitution, the law of this nation. Why should the common man of Pakistan support PPP in this instance ?

    I believe, they are in error. Former Judges have also confirmed the CJ's interpretation of the constitution is correct.

    its time to plan another long march for "rule of law" by PMLN, JI, PTI and others because today even PPP has came out in streets of Karachi and Lahore both largest cities of Pakistan and as I see it in Lahore PPP is very weak and today's rally is giving a message that this time long march wont work and that we also have street power so now dont mess with us....

  31. This is 100% independent judiciary, they do not have any pressure from anybody, but this judiciary is not neutral, this is completely politicized judiciary, favoring one party and targeting elected democratic government for their personal revenge.
    Khawaja Sharif proven that he is more political worker of Noon league than Chief justice of Lahore high court, look high court decisions to stop elections last 12 months in NA 55 and Na 123 on the order of Nawaz sharif, till Nawaz sharif and Shabaz sharif give permission for that. And there are many other acts and decisions he is showing that. But chief justice ch. Iftikhar insisting to keep him in Lahore high court to give favor to Noon leage leadership, as reward for their passed help.

    @ HARIS, i'm not threatening, sorry if you felt threatened. The judges, PMLN, Geo and certain others including nobodies like Imran Khan have got this misconception that 'qaum' ke saath mazaq horaha hai, 'qaum' yeh bardaasht nahi kerai gi, 'qaum' phir sarkon per nikal aayi gi. Lihaaza bohat zaruri hai ke iss jhootay taasur ko sahi kiya jaaye. Qaum ya phir qaum ka bohat bara hissa PPP ke saath khara hai, jo ke pichle saal ki soorat-e-haal se bilkul mukhtalif hai. Ye aaini bohran nahi Iftikhar Chaudary ki zaati ana ka masla hai aur isko usi tarah dekhna chahiye, na uss shakhs ko dastoor se dilchaspi hai na qanoon se.

  33. please do not give me reason that these retired judges favoring and supporting chief justice on this issue, if you look these retired judges past judicial role then you will understand them, retired justice saddiqi rebeled against his own chief justice sajjad shah, he and other judges were standing against their own chief justice and standing with Nawaz sharif government, that is why Noon league rewarded him and make him presidential conadidate against zardari, now days he is working with geo channel to launch targeting compaign against democratic government and zardari, i can guess, geo group is paying him enough salary for this role.

Do not make any guess after watching geo channel that peoples of pakistan supporting justice Iftikhar chaudhry on this issue, his support is limited to Noon league and few thousand lawyers, not majortiy lawyers,. ppp,MQM,ANP,JUI,ML.PAGARA GROUP,TRIBAL AREA MNA'S, MLQ most of their leadership,not agree with Noon league and chief justice on this issue.
    Even peoples supporting this issue, have wrong favorable perception about this chief justice, because he is challenging government, many innocent peoples always support anybody who challenge government, because government is always target for their misries. when peoples will know real politicize nature of chief justice and judiciary and their one sided rule of law then nobody will ready listen this chief justice on these politicize issues.

    when it was about military operations in nwfp then same media projected mqm rallies and foreign paid ngo rallies as public opinion

    similarly this media injects foreign culture into our society by projecting saint valentine's day, why there is no voice on this spread of moral corruption?

    Is there any ambiguity ???
    Who's 'appointing authority' of SC Judges ?
    I think as per constitution of Pakistan it is President !
