Need advice on land mafia in Rawalpindi

    so our property is rented out and the tenants are not paying rent and not leaving the place either ... they might not be armed thugs but they definitely wanna take over the place as owners (by creating fake legal documents etc)

    my question: is there a way to preemptively avoid that? for example, I've heard of something called "stay order" ... can i get a stay order on our land so that even if they try to sell the place with fake documents they wouldn't be able to do it?

    or should I stay in touch with the Patwari? do I need to pay him monthly bhatta or something to avoid such a thing?

    any other advice? (any other forum/website to discuss such topics?)

    a reply would be highly appreciated

    NOTE: assume I don't have any powerful contacts (if I really need such a contact I might have to almost beg someone)

    really sad to hear your problems brother. U can get a stay order, and take this matter to court. However the court make take u years to actually get your land back. But I would suggest the stay order is the best way.

    As for contacts, u may take your problem too Nawaz Sharif at Raiwind House, u just never know he might be in a good mood. That is just another idea. Otherwise I can't think off what else u could do.

    There are many nooner's on this site, they may know someone who can easily help u, through a phone call.

    Unfortunately, this thing is pretty common in Pakistan and laws do not provide adequate protection to land lord.

    I am not a lawyer but I guess you have a rental/lease agreement which should stipulate how much notice you have to give your tenant to evacuate. Even if you do not have it, send an eviction notice to the tenant and if he does not evict, file a petition for eviction, which unfortunately will take a couple of years.

    You also must have the documents showing that you own the property. If the tenant prepares any fake docs you can register an FIR against him for fraud.

    In any case, you must contact a good lawyer immediately.

    Thanks for your comments ... I might have some old rent agreement but the tenants are not currently living under a legal written agreement ...

    Maybe I need to clarify further:

    I'm out of Pakistan right now and can't return before 6 to 8 months ... what I'm looking for is some kind of freeze of the situation until then ... so that our property is not sold illegally by the time I return ...

    maybe I'm overreacting ... nothing may happen during this time ... but I was just wondering if I wanna play it safe, what are my options?

    (NOTE: my relatives are in pakistan so if there's any paperwork needed they will be able to do it)

    You wrote about Patwari , that means it is not in proper city limits,It is very common to buy same khasrah no papers but fake paper never successful, at least you have electricity bills and may be telephone ,gas bills on your name, however the tenants can pass many years without paying rent this way.

    I think it is imperative that you contact a lawyer. The lawyer can issue in notice on your behalf asking your tenant to refrain from trying to sell the property and such notice would also be published in the newspapers.

    I am not sure whether a stay order can be granted in such case when there is only suspicion on your part but again a lawyer would be in best position to advise you regarding this.

    You are right, An advertisement in any paper through a lawyer can help a lot. It is not costly . You can use classified page and a 'normal' lawyer . Will not cost more than 5000/-.

    Why Raiwind only? Can't the "Snow White" perched in Banigala help this gentleman out? After, IK is the PM in waiting.
