    A Punjab MPA pleaded SC to take suo moto notice of handing over girl to her French mother.

    Provincial Minister Ch Abdul Ghafoor has requested the Chief Justice of Pakistan Iftikhar Muhammad Chaudhry to take suo moto notice of handing over an 11-year-old girl to her French mother by the Lahore High Court.

    Earlier, Lahore High Court ruled to hande over Amina, 11, to her French mother. Amina was born in France but two years after her birth, her father, Abdul Razzak, divorced her wife and took Amina to Pakistan.

    Amina’s mother filed a case in a French court and got the ruling in her favour. But as the girl was in Pakistan, she could not get her custody.

    The woman then filed a case in a Sessions Court in Mandi Bahuddin. The court upheld the decision of the French court. But Abdul Razzak went into hiding along with the girl.

    The French lady then moved to Lahore High Court in order to win her daugther’s custody.

    Police recovered the girl and brought her to the Lahore court. The girl refused to go with her mother and cried to stay with her father.

    Justice Manzoor Malik said that the court would issue a verdict in line with the law irrespective of the girl’s emotions.

    The LHC also upheld the previous decisions and order the girl to be handed over to her mother.

    The girl said that her father suffered a heart attack and was under treatment.

    These matters are never easy but heart-broken no matter who wins or loses the case.....all sympathies with the father especially after the news of him having heart attack, but we must not forget about girl's mother either...who must have gone thru a lot in French-Pakistani courts...imagine a single woman in a foreign country like Pakistan where things are not very orderly to say the least.....the French mother must be having lots of love for her duaghter to have gone through all those troubles.....these matters are always very unfortunate, especially for children...

    Why this Pakistani did not get a heart attack while marrying a french women? It is stupidity that first you do as you desire and when you have a baby girl then you get afraid of her look after in a non-muslim environment. All such issues should have been decided in the beginning. My sympathies are with the girl whose personality would be divided now between her mother and father.

    The court decided as per the law that a minor child has to be handed over to mother. If PML-N has concerns, they should move a resolution in the assembly and change the law.

    Courts cannot consider 'sentiments' or 'emotions' as part of thier decision making process..
    Nonetheless It was heart breaking and awful to see that kid cry...

    She is already 11 years old girl. I think, judge should give more importance to her wish.

    If her mother is living in Pakistan, then there is no problem to give her custody of this girl. But mother is living in France. In this case, perhaps she will never able to meet again to her father and his family.

    Not only this, she will lost her personality, her religion, her aims, and her future dreams as muslim girl.

    However, her father should be punshed for kidnapping and taking away her from mother. It is extremely painful for any mother.

    Judge made the right decision.

    Father was wrong to disobey the ruling of french court.

    It is not right decision. Because this decision is neglecting wish, desire and future welfare of child. Judges should make decision according to current situation and wish of 11 years old girl. Not on the base of 9 year ago facts and situation.

    If father did any crime, he should be punished but nobody should punish 11 year girl. Judge must respect wish and future welfare of girl.
