Parliament Supreme? SC strikes down PM’s order promoting 54 bureaucrats

(27 posts)
  1. PPP and PML-N these days are making their throat soar yelling "Parliament is Supreme" (which in in itself is an indication it is NOT) and spreading the lie that SC has no right to interpret law (what else is it there for?).

Well, today SC struck down PM’s order promoting 54 bureaucrats out of turn (superseding the positions of 173 officers awaiting promotions).

Was Gilanis' act 'illegal'? Did SC Do the right thing? If it did, doesn't the PPP/PML-N argument fall flat on it's face? Will Gilani now yell "I represent 17 Crore Awam and SC had no right to go against the will of the people!"?

NOTE: Do keep in mind these latest statements by PML-N and PPP to see if they themselves believe "Parliament is supreme":
Kiyani- a blessing for Pak: Sharif

  2. Another case:
Supreme Court urges review of LNG contract
    http://www.dawn.com/wps/wcm/connect/dawn-content-library/dawn/the-newspaper/front-page/sc-urges-review-of-lng-contract-740

(In case you are not familiar, a $20 Billion plus contract was awarded WITHOUT BID to a French firm)

Should SC had let it through because "Awami Reps" made this deal and "Parliament is supreme"????

  3. No, nota, we are wholly behind the SC decisions in general and this one in particular and wholly against those Awami Reps and the Parliament is supreme types. But, tell me this, often the poor SC sounds ineffectual. Hands out decisions which are not enacted by the powers that be. What hope if any for the future if this carries on?

  4. Assalam-o-Alaikum-Warahmat-ULLAH ALL,

Constitution is supreme. Parliament/Executive, Judiciary are equals.

I/We will back ALL! decisions of SC, as long as they remain within the bounds of the law of the land i.e., Islam, constitution of Pakistan.

"What hope if any for the future if this carries on? "

That I believe is a rhetorical question, right? :(

Best news so far, Supreme Court is well on its path to commit suicide. Funny when the PM was saying seniority matters Supreme Court refused on the grounds that no such rule exists. Then he uses the same excuse to strike down appointments by PM.

Hypocrisy thy name is Iftikhar Muhammad Chaudry

  7. i agree, constitution is supreme, all institutions are to work under constitution.

parliament makes the laws but supreme court has 100% powers to review and decide in line with constitution.

    @ true pakistani

There is a fine line between Constitutional amendments and normal laws made by parliament. Supreme Court has 100% powers to strike down any law but not a constitutional amendment.

The Supreme Court of Pakistan has given 7 verdicts whereby Supremacy of Parliament has been upheld with regard to making of laws. One such verdict was given by a bench which included PCO Iftikhar and his crony Javed Iqbal.

  9. somebodies learn the lesson from their wrong deeds somebodies not.

if someone turn to be good and adopt right path, who should not refer his past.

Zardari got golden opportunity to correct himself after murder of Benazir Bhutto but he could not.

Supreme Court has been reinstade by public not Zaardari.

Corrupt mafia led by Zardari is opposing independance of judicery.

Supreme Court with the backing of peoples is only barrier to stop corruption of Zardari mafia.

Todays orders of Supreme court regarding LND contract is best example.

    Supreme Court zindabad.

It's the Law given by Allah Swt' which is Supreme.

in our case, it's the man made secular constitution which is supreme and the Judiciary makes sure that the parliament doesn't exceed it's limits.

  11. If the people sitting in the parliament will misbehave under the guise of "we are supreme" and paliament is supreme and refuse to look after the interest of people then any institute or person who stand in the way will be considered as messiah by the popolus. It is the question od moral authority.

If a father does not provide for his children despite the fact that he has the means to feed and cloth his children and spend thoses resources for buy good cloths and foos for himself then the children will be looking towards someone else for their needs. The children will go to anyone who can provide for their needs.

The best way for members of parliament is to behave as they should be and execute their duties for what they are elected for. They should concentrate on looking after the interest of the nation and the people and not wasting their time by shouting all the time that parliament is supreme. If they do their duty rightfully then thay dont have to shout for the supermacy of parliament as they will have the moral authority and NO ONE can take away their supermacy.

  12. Majority of pakistan parliament is corrupt, fake degree holders, lusty of wealth, womanizers, drinkers, land grabers, Bhattakhor, chandamafia, turncoats, and devbandi molvees being elected in each elections since last 40/50 years.

    Rori kapra aur makan and
islam i nizam branded deobandi molvees have become curse on our national image.

very small number of parliament members are sincere but who listens to them, their voice is too weak.

sometimes these members start rent a jehad,
sometimes take action against same those mujahideen now declared terrorists.

all this is game of power, $$$$$$$ and wealth.

No one serious about people and pakistan.

What can i say totally disappointed in regards to missing people. This has become a joke, i sincerely and honestly thought they would deliver justice after the awam got them re-instated but been let down so far, i still have a glimmer of hope but that's all it is hope.
