  5. Assalam-o-Alaikum-Warahmat-ULLAH ALL,

    Well, it is our job to make things convenient for people.

    That is the entire meaning of our life, the jobs that we do all day, everyday. If we can make it MORE convenient for someone, that is not something bad.

    I accept, that he has to learn on his own, read on his own, make decisions on his own.

    Zardari wants to portray Ch Iftikhar as the new dictator. Second, he wants to highlight the question, why CJ wants to put Justice Sharif in punjab highcourt?? even if he had to use force. Remember the Shariefs eligibility case is there!

    Ex Pakistani.

    Nothing there is no side to it. Its just that they have to create a story to keep teh awam busy in watching their show while they steal the awam and the country.

    Its a simple matter which happens almost all the times
    but since the country is in a worse place they have to shift focus to rob us again.

    @expak bhai

    Plz read this: may be it helps you understand the matter.

    According to the Constitution of Pakistan (Article 177) on the appointment of Supreme Court judges” “The Chief Justice of Pakistan shall be appointed by the President, and each of the other Judges shall be appointed by the President after consultation with the Chief Justice.”

    The constitution clarifies “consultation” thus: “consultation shall, save in respect of appointments of Judges of the Supreme Court and High Courts, mean discussion and deliberation which shall not be binding on the President.”

    Thus President Zardari is not bound by the demands of Justice Iftikhar which are illegal and criminal.

    Khuwaja Sharif the most senior Judge and Saqib Nisar is second in line. President has appointed Kh. Sharif in Supreme court based on his seniority while CJ Iftikhar wants Saqib nisar to come to Supreme court superceding Kh. Sharif and he wants Kh. Sharif to stay in Lahore High court.

    Kh. Sharif is believed to have close associations with PMLN. And some are speculating that, the CJ Iftikhar's insistance on the same to stay in Punjab is to make things favorable for PMLN!

    @Fahim23

    "save in respect of appointments of Judges of the Supreme Court and High Courts" means

    except in respect of appointments of Judges of the Supreme Court and High Courts

    and that clearly means in case of appointment of judges, CJ's recommendations are BINDING.

  19. Assalam-o-Alaikum-Warahmat-ULLAH ALL,

    -------------------------------------------------------------------
    Article 177 of Constitution of Pakistan;

    177. Appointment of Supreme Court Judges.
    (1) The Chief Justice of Pakistan shall be appointed by the President, and each of the other Judges shall be appointed by the President after consultation with the Chief Justice.
    -------------------------------------------------------------------

    Article 260 contains definitions of words used in Constitution. The word 'consultation' is also defined there;

    -------------------------------------------------------------------
    Article 260 of the Constitution of Pakistan defines the word 'consultation' as -> ["consultation" shall, save in respect of appointments of Judges of the Supreme Court and High Courts, mean discussion and deliberation which shall not be binding on the President.]
    -------------------------------------------------------------------

    The above shows, CJ is doing exactly what the constitution of Pakistan says.
