    It is time for SC of Pakistan to show judicial restraint and leave the final resolution of NRO to THE PEOPLE OF PAKISTAN, the true owners of the constitution of Pakistan ... I hope better sense prevails, else whatever the reality the defiant PPP will come out stronger as a martyr ... to the dismay of all their opponents ...

    Option 6 from the judgement of Supreme Court ...

    Option No. 6: The constitutional balance vis-à-vis trichotomy and separation of powers between the Legislature, the Judiciary and the Executive is very delicately poised and if in a given situation the Executive is bent upon defying a final judicial verdict
    and is ready to go to any limit in such defiance then instead of insisting upon the Executive to implement the judicial verdict and thereby running the risk of bringing down the constitutional structure itself this Court may exercise judicial restraint and leave
    the matter to the better judgment of the people of the country or their representatives in the Parliament to appropriately deal with the delinquent. After all the ultimate ownership of the Constitution and of its organs, institutions, mechanisms and processes rests
    with the people of the country and there may be situations where the people themselves may be better suited to force a recalcitrant to obey the Constitution. It may be advantageous to reproduce here the relevant words of the

    Preamble to the Constitution of the Islamic Republic of Pakistan, 1973:

    “we, the people of Pakistan ------- Do hereby, through
    our representatives in the National Assembly, adopt,
    enact and give to ourselves, this Constitution”.

    ... and btw the SC judgement declare PM to be "not honest" as widely reported in the media ... rather the five-judge bench, said the PM did not appear to be a “sagacious” person ...which was evident from his defiance of the court orders in the NRO case

    سپریم کورٹ نے این آر او عملدرآمد کیس میں فیصلہ سنا دیا – حکومت کو مزید ڈھیل

    جب تمام قانونی راستے بند ہو جاتے ہیں تو پھر آخری فیصلے عوام ہی کرتے ہیں

    لیکن جب عوام فیصلہ کرتے ہیں تو پھر اسمیں ڈھیل یا اگر مگر یا کوئی مصلحت نہیں ہوتی

    عوام کے فیصلے بزدلانہ نہیں جرات مندانہ ہوتے ہیں

    عوام نہ صرف گلے میں پٹا ڈال کر، گلی گلی گھسیٹ کر اور الٹا لٹکا کر انصاف کرتے ہیں بلکہ بغیر سزا پائے مرنے والے مجرموں کی لاشیں بھی التی لٹکا کر انصاف فراہم ہیں

    عوام کے ہاتھ اب ہر مجرم اور چور لٹیرے تک جائیں گے بے شک وہ کتنے ہی اونچے عہدے پر بیٹھا ہوں اور کتنے ہی بڑے قلعے میں چھپا ہو

    عوام کے فیصلے ہی اب مسائل کا حل ہیں

  4. It seems, in the end, SC can barely do anything tangible against the excesses of a sitting Govt. It is hard and heavy only on the average Citizen.

    If this is the outcome, why are they spending enormous time and resources into trying things like NRO and Memo stuff. They should just toss out petitions against the big and powerful on day one with a plain standard statement that defendants are too big to reach.

    @Bawa ... very nicely put ...but these same ppl make tombs and shrines for leaders who have laid their lives for their betterment ...there are many of those in PPP fold .... let the ppl be the judge ... their collective wisdom ... u r "just bawa" not "bawa-e-qaum" ... it is not that ur word is the word of God ... being human their is a possibility that all of us even "u" can err too ... lets always keep that in mind ...before we start passing judgements :)))

    @GT ... i hope someone can create a log of last 4 years...the amount of time that SC has kept the entire nation...media ...the sitting givernemnt consumed in the circus that they have orchestrated ... sowing the seeds of discord and nurturing those... justice has to be blind ...not selective...and doubters like me feel that SC has gone beyond its mandate trying to persecute one party and just one party alone..they have been and are a major stumblingblock to the growth of Pakistani society and democracy...

    @bawa ...zaban-e-khalaq sirf apkee hai ... meri bhi to hai na...is ka aap ko so fesad yakeen hai kia...zaan-e-khalq sirf apka yeh prerogative or privilige to nahi ho sakta...hum sub ka bhi haq hai ...

    I am against being judgemental ... give respect and space to other opinions and ideas too ...

    I don't agree to this one party being the victim. PPP appears to be claiming the right to corruption and other excesses of power. That is exactly the opposite of the norms for public mandate.

    مجھے آج تک یہ سمجھ نہیں آیا کہ یہ زبانِ خلق یا نقارہِ خدا کبھی حدَیبیہ پیپر مل کے کئی ملین ڈالر کے منی لانڈرنگ کیس (نواز شریف کے سمدھی اسحٰق ڈار کے اعترافی بیان کے باوجود) پر نہیں بولتی۔۔۔۔۔۔۔ یہ کیا ماجرا ہے۔۔۔۔۔۔۔۔ لگتا ہے یہ نقارہِ خدا بھی سِلیکٹو جسٹس پر یقین رکھتی ہے۔۔۔۔۔۔۔۔ یا حسین نواز کے برطانیہ میں بلین ڈالر بزنس(اخباری اطلاعات کے مطابق) پر بھی خلقِ خدا خاموش ہے۔۔۔۔۔۔۔۔ یہ خوب ہے۔۔۔۔۔۔۔۔

    This Ch ifftekhar sahib is pretty much, cant provide justice to awam.

    If the issue of selective justice was not there, I'd have recommended the strictest possible option.

    Unfortunately, SC compromised its credibility by selective justice.

    NRO case should proceed and legal action must be taken. I just hope, SC show some activity on missing person case, Hudabia paper mills and Asghar Khan case.

    laikin CJ sahab ko tou sipah salar kee qurbaania yaad karnay se hee fursat nahi.

    The same sipha-e-salar who unlawfully pressurised the CJ along with others to give resignation ... he was part and parcel of Musharrafs unconstitutional regime ... if ever Musharraf is prosecuted (which we all doubt) for subverting constitution then current COAS cant escape trial as well..

  17. Supreme court and Ch. Iftikhar have to first prove their impartiality, neutrality and self accountability to take any action against PPP government for anything.

    Unfortunately, so far, the supreme court and chief justice failed to prove himself as chief justice of Pakistan. Judiciary is acting as Noon league judicial branch.

    If in present situation, supreme court take any action against government. That will be biggest blunder of the Pakistan judicial history. History will prove that this Supreme court is responsible to destroy democratic system of Pakistan.

    I second that totally ...PPP rank and file would rally together ... kind of victim mentality ...and Pakistani in general love underdogs and martyrs ...

    ... this step of supreme court is against the interest of democracy and Pakistan ... most would want PPP and its allies to complete their term so that their is no excuse for them not implementing their manifestoes ...and let ppl of Pakistan bring a change through ballot once their term is up... let the last four years not become a zerosum game and a futile exercise by making them martyr yet again in this last leg of their term.....this should rather be an experience(very bitter for a few) in the evolution of democratic dispensation in Pakistan ...

    SC was politicised since day 1.

    CJ and CO. should have resigned after first 3 months to maintain the impartiality of the honorable institution.

    laikin aisay CJ kay baray mein kiaa kaha jaey jo dictator se wazeer-e-azam bannay kee farmaish kartaa raha hoo

    ہماری عدالت نے جو آئین کے بنیادی ڈھانچے کا تصور دیا ہوا ہے یہ آگے چل کر پاکستان کیلئے بہت خطرناک ثابت ہوگا۔۔۔۔۔۔۔۔ اسی طرح یہ جوڈیشل ایکٹوزم کا لگام ڈالنی بہت ضروری ہے۔۔۔۔۔۔۔۔ جس طرح سپریم کورٹ انتظامی امور میں مداخلت کر کے ایک متوازی حکومت قائم کرنے کی کوشش کر رہی ہے یہ پارلیمنٹ کی سپرمیسی کو شدید دھچکا پہنچائے گی۔۔۔۔۔۔۔۔۔

    لیکن کیا میں اپنے حقیقت پر مبنی خیالات کا اظہار نہیں کر سکتا؟ کیا میرے اظہار خیال سے پی پی پی کی "جمہوریت" میں کوئی خلل پڑتا ہے؟ یا پھر سوئس اکاونٹس کی حرمت پر کوئی حرف آتا ہے؟

    I wouldn't let people of Pakistan decide anything. A bunch of people who have elected these cronies and have served these thieves can't be relied to do anything positive as a whole.

    The world is moving ahead, the Bedouins are rising, indians are rising against corruption, the poor people of the West are rising against corporations. Pakistani's just sit there like cows crying about their own destiny.
