Who should appoint Judges?

    The President of SCBA Qazi Anwar is campaigning against the Constitutional reform committee's decision that judges should be recommended by a Judicial Commission and approved by a parliamentary committee. They are also against the inclusion of Attorney General and Law minister in the committee. Personally I have two objections to the whole campaign,

    firstly that by visiting Raiwand and Mansura Qazi Anwar has effectively turned lawyers community into a political party,

    and secondly how can a judge appoint judge? In the entire civilised world the President/ PM nominates a candidate which is then questioned and approved by a committee and then appointed by the house. However, since that is unacceptable to lawyers they are quoting the Indian system of appointment whereby a committee of retired judges nominates a judge. One can only imagine a committee comprising Dogar, Malik Qayum and Nizami.

    The lawyers campaign is against the Constitutional supremacy granted to the parliament illogical in itself.

    So, I'd like the thoughts of the highly pro-judiciay members of this forum.

    Also, moderators, please remove the topic on main page regarding Indian channels, its a nuisance.

    This is the period of power showdown by judiciary, lawyers and PML-N, each sector claiming they were pivotal and main cause in resotration of "independent" judiciary. All norms of principles kept side, the power game is on - heat is on.

    About Qazi Anwar's visit to Raiwind and Mansura, I do not know how much truth exists in it, but if it was true, nothing strange! Everything is fair in love and politics for PML-N and Jamaate Islami. In this power game, since PML-N are outnumbered and since Army and ISI have taken the stand of neutrality (looks like) the only hope for them (PML-N) is to humiliate and disqualify PPP top leadership such that they get an open field in all the three small provinces and South Punjab where, in this point of time, they dont have the ground.

    qazi is too right, judges should not be appointed by judicial commision and parlimentary cmmite as they would full supreme court with judges loyal to them rather than those who are neutral and believe in natural justice.
